Mr.H.L. Jani waives service of Rule on behalf of the<br \/>\n\trespondent-State of Gujarat.\n<\/p>\n<p>\tThe<br \/>\n\tpresent application has been filed by the applicant-accused praying<br \/>\n\tfor modification\/ relaxation of condition no.7(e) imposed while<br \/>\n\treleasing the applicant on bail as per the order passed in Criminal<br \/>\n\tMisc. Application No.13041\/2010 dated 18.11.2010, which reads as<br \/>\n\tunder :-\n<\/p>\n<p>&#8220;(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 P.M. till<br \/>\nthe trial commences.&#8221;\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel, Mr.Barot has stated that for relaxation of the condition,<br \/>\n\tgrounds are mentioned in the memo of application inter alia that the<br \/>\n\tpetitioner is leaving for Tirupati and he will be returning back on<br \/>\n\t17.03.2011. Therefore, he may not be able to mark his presence on<br \/>\n\t07.03.2011 (1st Monday) as directed by the Court while<br \/>\n\treleasing him on bail, which may be relaxed.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned counsel appearing for the parties and having<br \/>\n\tconsidered the facts of the present case, the present application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthis application stands allowed. The Condition No.7(e) stands<br \/>\n\trelaxed only for the purpose of marking presence on 07.03.2011 (1st<br \/>\n\tMonday). All other conditions will remain unaltered.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
