Justice K.T.SANKARAN\n\n Dated :03\/07\/2008\n\n O R D E R\n                               K.T.SANKARAN, J.\n                       --------------------------------------------\n                       W.P.(C) NO. 19682 OF 2008 R\n                       --------------------------------------------\n                        Dated this the 3rd July, 2008\n\n                                    JUDGMENT\n<\/pre>\n<p>         The petitioner in this Writ Petition is aggrieved by the non-<\/p>\n<p>consideration of the application submitted by him for the issue of &#8220;No<\/p>\n<p>Objection Certificate&#8221; by the State Government for the purpose of<\/p>\n<p>affiliation of his school to the Central Board of Secondary Education.<\/p>\n<p>         2. The reliefs prayed for in the Writ Petition are the following:-<\/p>\n<p>         &#8220;i)    To issue a Writ of Mandamus directing the 2nd<br \/>\n                respondent to process petitioner&#8217;s application for<br \/>\n                C.B.S.E affiliation without insisting for States NOC.<\/p>\n<p>         ii)    To issue a writ of mandamus or other appropriate<br \/>\n                order of direction directing the 1st respondent to take<br \/>\n                a decision on petitioner&#8217;s application for NOC for<br \/>\n                petitioner&#8217;s school for C.B.S.E. affiliation within a<br \/>\n                short reasonable time.\n<\/p>\n<\/p>\n<p>         iii)   To grant such other reliefs as are just and proper in<br \/>\n                the nature of this case.&#8221;\n<\/p>\n<\/p>\n<p>         3. The learned Government Pleader submitted that the application<\/p>\n<p>submitted by the petitioner would be considered by the first respondent<\/p>\n<p>without much delay. The first respondent is legally bound to dispose of<\/p>\n<p>W.P.(C) NO.19682 OF 2008<\/p>\n<p>                                        :: 2 ::\n<\/p>\n<p>the application in accordance with law.           Therefore, I hold that the<\/p>\n<p>petitioner is entitled to the relief of a writ of mandamus directing the first<\/p>\n<p>respondent to dispose of the application submitted by him for the issue<\/p>\n<p>of N.O.C. The first respondent shall dispose of the application submitted<\/p>\n<p>by the petitioner for the issue of N.O.C. in accordance with law within a<\/p>\n<p>period of one month.       The petitioner shall produce a copy of the Writ<\/p>\n<p>Petition and also copy of I.A.No.8484 of 2008 before the first respondent<\/p>\n<p>within a period of ten days for the effective consideration and disposal of<\/p>\n<p>the application submitted by him.        The petitioner is also permitted to<\/p>\n<p>produce such other documents and materials before the first respondent<\/p>\n<p>for the proper and effective consideration of the application.
