By the impugned order-dated<br \/>\n15.6.2010 &#8211; Annexure P\/1, he has been transferred to Chitrangi in<br \/>\nDistrict Singrauli.\n<\/p>\n<p>      Contending that petitioner is a patient of diabetes and high<br \/>\nblood pressure and if he is transferred to Singrauli, he will not have<br \/>\nany facility for treatment and further pointing out that petitioner is<br \/>\ntransferred at the instance of respondent No.4, a Minister in the<br \/>\nDepartment, challenge is made to the order of transfer.\n<\/p>\n<p>      Shri Mrigendra Singh, learned counsel for the petitioner,<br \/>\npointed out that in the order of transfer, the dispatch number<br \/>\nreference is made of a word &#8220;Minister&#8221;, which indicates that the<br \/>\ntransfer is at the instance of the Minister and, therefore,<br \/>\nunsustainable.\n<\/p>\n<p>      Respondents represented by Shri Vivek Agrawal refute the<br \/>\naforesaid and point out that merely because the word &#8220;Minister&#8221; is<br \/>\nindicated in the dispatch number, that by itself would not mean that<br \/>\nthe transfer is at the instance of the Minister. It is submitted that the<br \/>\npetitioner has not pointed out any malafides in the matter and is<br \/>\nseeking interference only on the grounds of his personal<br \/>\ninconvenience and on such grounds, it is argued by Shri Agrawal<br \/>\nthat judicial review of an order of transfer is not permissible.\n<\/p>\n<p><span class=\"hidden_text\">                                                                     2<\/span><\/p>\n<p>        Having heard learned counsel for the parties and on<br \/>\nconsideration of the facts that have come on record, it is clear that<br \/>\npetitioner has only challenged the transfer on the grounds of breach<br \/>\nof any transfer policy or malafides. The so called malafide of the<br \/>\nMinster is not apparent from the record. No allegations of malafide<br \/>\nor the facts constituting the malafides are available. The only<br \/>\nallegations are in paragraph 6.3 and 6.4, which are vague and<br \/>\npertain to the reference of the word &#8220;Minister&#8221; in the dispatch<br \/>\nnumber. The allegations of malafide are not established from the<br \/>\naverments made in this petition and, therefore, on such grounds<br \/>\ninterference into the order of transfer cannot be made.\n<\/p>\n<p>        The other grounds raised are the personal inconveniences of<br \/>\nthe petitioner and breach of transfer policy. These are grounds<br \/>\nwhich are to be appreciated by the competent authority of the State<br \/>\nGovernment and it is not for a writ court to interfere on such<br \/>\nconsideration when petitioner is being transferred after completing<br \/>\nhis tenure posting in the interest of administration.\n<\/p>\n<p>        Accordingly, finding no case for interference on the grounds<br \/>\nraised, the petition is dismissed.\n<\/p>\n<p>                                         (RAJENDRA MENON)<br \/>\n                                              JUDGE<br \/>\nAks\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Sunil Kumar Singhparihar vs The State Of Madhya Pradesh on 2 July, 2010 02.07.2010.
