The brief factsof&#8217;j&#8217;the&#8217;_V: &#8220;ara&#8217;A:&#8217;th_at thelurban Local<br \/>\nBodies [&#8216;U.i..B.s&#8217; roar short1Va&#8217;r;e an the basis of the<\/p>\n<p>population and  falctbra\u00e9l  in Section 3 of<\/p>\n<p>Karnataka Mahicirpa;iitid\u00e9sr Act; .:1j_9&#8217;64V&#8217;:g[&#8216;the said Act&#8217; for short].<\/p>\n<p>Section   that the Municipal Council<\/p>\n<p>shall coneist of  of directly elected councilors<\/p>\n<p>narnaly<\/p>\n<p>speci\ufb02g;-..m_ column&#8217; oflthehttabie below in respect of municipal<\/p>\n<p>&#8216;f,_Va&#8217;reas&#8221;ipn thevvcorrespondlng entries in column 2 thereof,<\/p>\n<p> &#8216; -.  Population of the municipal area<\/p>\n<p>No. of<br \/>\nCouncilors<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p> ! Sl.No}&#8221;&#8212;-\n<\/p>\n<p>4* 1- t  <\/p>\n<p>r .,_  a municipal area with a population of not less<br \/>\n_ &#8216;_1h_an__2_0.0D0 out less than 40.0% &#8216;<\/p>\n<p><span class=\"hidden_text\">23<\/span><\/p>\n<p>&#8216; for a municipal area with a population of not less<\/p>\n<p>than 40.000 b_u_t lugs than 59,000<\/p>\n<p><span class=\"hidden_text\">27<\/span><\/p>\n<p>for a municipal area with a population of &#8220;not less<br \/>\nthan 50,000 but less than one iaith<\/p>\n<p>4I<\/p>\n<p><span class=\"hidden_text\">31<\/span><\/p>\n<p>for a municipal area with a population of not lax<\/p>\n<p>than 50.000 but less than three ia_i_ti___is<\/p>\n<p><span class=\"hidden_text\">35<\/span><\/p>\n<p>HBH,<\/p>\n<p>3. As per the afor extracted legislative <\/p>\n<p>number of counciiors for Madiken City <\/p>\n<p>[&#8216;MadIkeri C.M.C.&#8217; for short], is 23.<\/p>\n<p>4. The first respondent b&#8217;rought an to<br \/>\n3 of the said Act incorporating  provisonpigto\ufb01sub-section<\/p>\n<p>(2), which reads as foilowszkf&#8217; T __ <\/p>\n<p> on      Quaneis &#8216;is situated<br \/>\nin  igsrnailer  age the Gouemor may,<br \/>\n &#8221;  sta&#8217;:!&#8217;:&#8217;&#8211;an2a&#8217;*&#8211;to bescity municipal area even<br \/>\n   population of less than my<\/p>\n<p>5. In ii&#8217;iew_oi&#8221;  arnendment, Madikeri Town Municipal &#8211;<\/p>\n<p>.v.\u00a7ounci&lt;!i.&#039;wa&#039;s upgradeVd_;__gii: attained the status of City Municipal<\/p>\n<p>eeccmiirrom theyear 2oo3.\n<\/p>\n<p>  The  respondent issued a Noti\ufb01cation, dated 15&#8243;&#8216;<\/p>\n<p>. .:_.&#8217;;&#8217;;..74.._&#8217;;lune 20GfIj__A{Annexure-B) for Madikeri C.M.C. fixing the number<\/p>\n<p>I    at _31. This was objected to by some residents of<\/p>\n<p>V&#8217;  Incl-udlng a former Minister, Sri M.C. Nanaiah. The<\/p>\n<p>  second respondent State Election Commission, acting on the<\/p>\n<p>representation of the said Sri Nanaiah, pointed out the<br \/>\n\ufb01.BH.\n<\/p>\n<p>impemlissibllity of fixing the number of MadIken_;t:;iit&#8217;.s.&#8217;t._j:<\/p>\n<p>However, the first respondent vide its letter,  <\/p>\n<p>2007-justified the fixing of the number ofci:nl&#8217;ncilors \u00e9dfl\ufb01ulljdgltil\ufb02  u<\/p>\n<p>C.M.C. at 31 and called upon&#8217; the r&#8217;es:ponde:lt&#8221;&#8221;  <\/p>\n<p>necessary steps for holding tiladlilteri C.M.C. &#8216;<\/p>\n<p>Therefore the second  the process by<br \/>\nIssuing the calendar of ovootsybiliiliosoptunbor, 2oo7.<br \/>\nPursuant thereto;  have place. I<\/p>\n<p>7. Srl&#8230;A_bdilila~El\u00a7.._the il.s.alllil.lii.-cum: for the petitioner<\/p>\n<p>urged th\u00a7&#8230;foIiowin'&#8221;gcententioiisi&#8217; &#8216;l<\/p>\n<p>(I) _.&#8217;The&#8217;t&#8221;i\ufb021.Fu9noed&#8221;v_&#8221;noti\ufb01cation at Annexure-B &#8216; for the<\/p>\n<p> conduct otei&#8217;liliL*tions for 31 territorial wards In Madiken<\/p>\n<p>  a.  t4&#8217;dhI\u00a7!pal Council is in utter violation of Section 11<\/p>\n<p>ll&#8217;  of.&#8217;the\u00ab_.saId Act. As -per the table extracted hereinabove<\/p>\n<p>__  as per the last population census, there can be only<br \/>\nit   23 wards. I<\/p>\n<p>  &#8216;(ii)&#8211;&#8216;\u00a7 A Theexecutlve has no discretion in \ufb01xing the strength of 4<\/p>\n<p>a U.L.B.
