Challenge  in  this petition is to  the  order  dated<br \/>\n       10.10.2008  (Annexure P\/5) whereby promotion  of  the<br \/>\n       petitioners  to the post of Lecturer by  order  dated<br \/>\n       27.09.2008,  has been cancelled and the  order  dated<br \/>\n       02.12.2008 (Annexure P\/7), whereby the representation of the<br \/>\n       petitioners against the cancellation of their promotion was<br \/>\n       rejected  by  the Commissioner, Public  Instructions,<br \/>\n       Government of Chhattisgarh.\n<\/p>\n<p>2.   The indisputable facts, in nutshell, are that the<br \/>\npetitioners were working as Physical Training Instructor<br \/>\nwhen their case was considered and recommended for promotion<br \/>\nto the post of Lecturer by the Departmental Promotion<br \/>\nCommittee after following due process of selection. The<br \/>\npetitioners were promoted to the post of Lecturer, History,<br \/>\nPolitical Science and Economics, respectively and<br \/>\nthereafter, they joined accordingly. Within a period of 14<br \/>\ndays, to their utter surprise, they received the order dated<br \/>\n10.10.2008 whereby their promotion was cancelled on the<br \/>\nground that they were not eligible for promotion.<br \/>\nThereagainst, the petitioners made representations which<br \/>\nwere also rejected by a common order dated 02.12.2008. Thus,<br \/>\nthis petition.\n<\/p>\n<p>3.   According to Shri Rajput, learned counsel appearing for<br \/>\nthe petitioners, the post of Physical Training Instructor is<br \/>\nequal to the post of Upper Division Teacher and as such<br \/>\nunder the provisions of Chhattisgarh School Shiksha<br \/>\nRajpatrit Sewa (Shala Stariya) Bharti Tatha Padonnati Niyam,<br \/>\n2008 (for short `the Niyam, 2008), the petitioners are<br \/>\nentitled to be considered and promoted to the post of<br \/>\nLecturer. Even otherwise, the appointment has been cancelled<br \/>\nwithout affording an opportunity of hearing. Thus, the<br \/>\nimpugned orders are vitiated and deserve to be quashed.\n<\/p>\n<p>4.   Per contra, Shri Roy, learned counsel appearing for the<br \/>\nrespondents submits that the petitioners are not eligible to<br \/>\nbe considered for appointment on the post of Lecturer as<br \/>\nSchedule II to the Rules, 2008 clearly provides that 100%<br \/>\nposts of lecturer would be filed up from feeder cadre of<br \/>\nUpper Division Teachers having the requisite experience of<br \/>\nthree years. Since the promotion was not in accordance with<br \/>\nlaw and the facts are admitted, no show cause notice or<br \/>\nopportunity of hearing was necessary as it would have become<br \/>\na mere formality.\n<\/p>\n<p>5.   Heard learned counsel for the parties, perused the<br \/>\npleadings and documents appended thereto.\n<\/p>\n<p>6.   Schedule II to the Rules, 2008 provides for appointment<br \/>\nof lecturers on promotion from the post of Upper Division<br \/>\nTeachers cadre having different experiences. Reliance of the<br \/>\npetitioner that the order dated 02.12.2008 itself indicates<br \/>\nthat the PTIs are equal to Upper Division Teacher, the<br \/>\npetitioners are eligible to be considered for promotion on<br \/>\nthe post of Lecturer, is not sustainable as on careful<br \/>\nconsideration of the entire order, it is clear that there is<br \/>\nno provision for promotion to the post of Lecturer from the<br \/>\npost of PTI. It was clarified that the PTI can be considered<br \/>\nfor promotion to the post of Assistant District Sports<br \/>\nOfficer and Lecturer, Physical Training only.\n<\/p>\n<p>7.   With regard to show cause notice, law is well settled<br \/>\nthat the principles of natural justice cannot be put in a<br \/>\nstraitjacket. It depends on other factors also, viz. whether<br \/>\naffording opportunity of hearing would serve any  purpose,<br \/>\nwhen the facts are admitted. In the case, the legal position<br \/>\nis clear, even the qualification of the petitioners are also<br \/>\nadmitted. Thus, it was not necessary to afford opportunity<br \/>\nof hearing before passing the impugned order.\n<\/p>\n<p>8.   In the case of <a href=\"\/doc\/693792\/\">Ashok Kumar Sonkar v. Union of India &amp;<br \/>\nOthers1,<\/a> relied on by the respondents, the Hon&#8217;ble Supreme<br \/>\nCourt held as  under:\n<\/p>\n<blockquote><p>                 &#8220;26.  This  brings us to the  question<br \/>\n                 as   to  whether  the  principles   of<br \/>\n                 natural  justice were required  to  be<br \/>\n                 complied  with. There  cannot  be  any<br \/>\n                 doubt   whatsoever   that   the   audi<br \/>\n                 alteram  partem is one  of  the  basic<br \/>\n                 pillars   of  natural  justice   which<br \/>\n                 means   no  one  should  be  condemned<br \/>\n                 unheard.  However,  whenever  possible<br \/>\n                 the   principle  of  natural   justice<br \/>\n                 should  be followed. Ordinarily  in  a<br \/>\n                 case  of  this nature the same  should<br \/>\n                 be  complied with. Visitor  may  in  a<br \/>\n                 given  situation issue notice  to  the<br \/>\n                 employee who would be effected by  the<br \/>\n                 ultimate order that may be passed.  He<br \/>\n                 may  not be given an oral hearing, but<br \/>\n                 may    be    allowed   to    make    a<br \/>\n                 representation in writing.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                 &#8220;27.   It   is  also,  however,   well<br \/>\n                 settled   that  it  cannot   put   any<br \/>\n                 straitjacket formula. It  may  not  be<br \/>\n                 applied  in  a  given  case  unless  a<br \/>\n                 prejudice   is  shown.   It   is   not<br \/>\n                 necessary where it would be  a  futile<br \/>\n                 exercise.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                 &#8220;28.  A  court of law does not  insist<br \/>\n                 on  compliance with useless formality.<br \/>\n                 It  will  not issue any such direction<br \/>\n                 where  the  result  would  remain  the<br \/>\n                 same,  in  view of the fact  situation<br \/>\n                 prevailing  or in terms of  the  legal<br \/>\n                 consequences.  Furthermore   in   this<br \/>\n                 case,  the  selection of the appellant<br \/>\n                 was  illegal. He was not qualified  on<br \/>\n                 the cut-off date. Being ineligible  to<br \/>\n                 be   considered  for  appointment,  it<br \/>\n                 would  have been a futile exercise  to<br \/>\n                 give   him  an  opportunity  of  being<br \/>\n                 heard.&#8221;\n<\/p><\/blockquote>\n<p>  9.   The  Hon&#8217;ble  Supreme Court in <a href=\"\/doc\/507731\/\">Viveka Nand  Sethi  v.<br \/>\n  Chairman, J<\/a>&amp;K Bank Ltd. &amp; others2, held as under:-.\n<\/p>\n<blockquote><p>                    &#8220;22.  The  principle  of  natural<br \/>\n                    justice,  it  is  trite,  is   no<br \/>\n                    unruly  horse.  When  facts   are<br \/>\n                    admitted, an enquiry would be  an<br \/>\n                    empty    formality.   Even    the<br \/>\n                    principle of estopple will apply.<br \/>\n                    <a href=\"\/doc\/1867627\/\">(See  Gurjeewan Garewal (Dr.)  v.<br \/>\n                    Dr.  Sumitra Dash) The<\/a> principles<br \/>\n                    of  natural justice are  required<br \/>\n                    to be complied with having regard<br \/>\n                    to  the  fact situation obtaining<br \/>\n                    therein.  It cannot be put  in  a<br \/>\n                    straitjacket formula.  It  cannot<br \/>\n                    be  applied  in a vacuum  without<br \/>\n                    reference  to the relevant  facts<br \/>\n                    and  circumstances of  the  case.<br \/>\n                    <a href=\"\/doc\/313314\/\">(See  State  of Punjab  v.  Jagir<br \/>\n                    Singh   and  Karnataka  SRTC<\/a>   v.<br \/>\n                    S.G.Kotturappa)&#8221;\n<\/p><\/blockquote>\n<p>  10.  Looking  from all angles, the petition fails  and  is<br \/>\n       accordingly dismissed.
