  WRIT PETITION UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA           <\/p>\n
  1.   Challenge  in  this petition is to  the  order  dated
\n       10.10.2008  (Annexure P\/5) whereby promotion  of  the
\n       petitioners  to the post of Lecturer by  order  dated
\n       27.09.2008,  has been cancelled and the  order  dated
\n       02.12.2008 (Annexure P\/7), whereby the representation of the
\n       petitioners against the cancellation of their promotion was
\n       rejected  by  the Commissioner, Public  Instructions,
\n       Government of Chhattisgarh.\n<\/p>\n
2.   The indisputable facts, in nutshell, are that the
\npetitioners were working as Physical Training Instructor
\nwhen their case was considered and recommended for promotion
\nto the post of Lecturer by the Departmental Promotion
\nCommittee after following due process of selection. The
\npetitioners were promoted to the post of Lecturer, History,
\nPolitical Science and Economics, respectively and
\nthereafter, they joined accordingly. Within a period of 14
\ndays, to their utter surprise, they received the order dated
\n10.10.2008 whereby their promotion was cancelled on the
\nground that they were not eligible for promotion.
\nThereagainst, the petitioners made representations which
\nwere also rejected by a common order dated 02.12.2008. Thus,
\nthis petition.\n<\/p>\n
3.   According to Shri Rajput, learned counsel appearing for
\nthe petitioners, the post of Physical Training Instructor is
\nequal to the post of Upper Division Teacher and as such
\nunder the provisions of Chhattisgarh School Shiksha
\nRajpatrit Sewa (Shala Stariya) Bharti Tatha Padonnati Niyam,
\n2008 (for short `the Niyam, 2008), the petitioners are
\nentitled to be considered and promoted to the post of
\nLecturer. Even otherwise, the appointment has been cancelled
\nwithout affording an opportunity of hearing. Thus, the
\nimpugned orders are vitiated and deserve to be quashed.\n<\/p>\n
4.   Per contra, Shri Roy, learned counsel appearing for the
\nrespondents submits that the petitioners are not eligible to
\nbe considered for appointment on the post of Lecturer as
\nSchedule II to the Rules, 2008 clearly provides that 100%
\nposts of lecturer would be filed up from feeder cadre of
\nUpper Division Teachers having the requisite experience of
\nthree years. Since the promotion was not in accordance with
\nlaw and the facts are admitted, no show cause notice or
\nopportunity of hearing was necessary as it would have become
\na mere formality.\n<\/p>\n
5.   Heard learned counsel for the parties, perused the
\npleadings and documents appended thereto.\n<\/p>\n
6.   Schedule II to the Rules, 2008 provides for appointment
\nof lecturers on promotion from the post of Upper Division
\nTeachers cadre having different experiences. Reliance of the
\npetitioner that the order dated 02.12.2008 itself indicates
\nthat the PTIs are equal to Upper Division Teacher, the
\npetitioners are eligible to be considered for promotion on
\nthe post of Lecturer, is not sustainable as on careful
\nconsideration of the entire order, it is clear that there is
\nno provision for promotion to the post of Lecturer from the
\npost of PTI. It was clarified that the PTI can be considered
\nfor promotion to the post of Assistant District Sports
\nOfficer and Lecturer, Physical Training only.\n<\/p>\n
7.   With regard to show cause notice, law is well settled
\nthat the principles of natural justice cannot be put in a
\nstraitjacket. It depends on other factors also, viz. whether
\naffording opportunity of hearing would serve any  purpose,
\nwhen the facts are admitted. In the case, the legal position
\nis clear, even the qualification of the petitioners are also
\nadmitted. Thus, it was not necessary to afford opportunity
\nof hearing before passing the impugned order.\n<\/p>\n
8.   In the case of Ashok Kumar Sonkar v. Union of India &
\nOthers1,<\/a> relied on by the respondents, the Hon’ble Supreme
\nCourt held as  under:\n<\/p>\n
                 “26.  This  brings us to the  question
\n                 as   to  whether  the  principles   of
\n                 natural  justice were required  to  be
\n                 complied  with. There  cannot  be  any
\n                 doubt   whatsoever   that   the   audi
\n                 alteram  partem is one  of  the  basic
\n                 pillars   of  natural  justice   which
\n                 means   no  one  should  be  condemned
\n                 unheard.  However,  whenever  possible
\n                 the   principle  of  natural   justice
\n                 should  be followed. Ordinarily  in  a
\n                 case  of  this nature the same  should
\n                 be  complied with. Visitor  may  in  a
\n                 given  situation issue notice  to  the
\n                 employee who would be effected by  the
\n                 ultimate order that may be passed.  He
\n                 may  not be given an oral hearing, but
\n                 may    be    allowed   to    make    a
\n                 representation in writing.”\n<\/p><\/blockquote>\n
                 “27.   It   is  also,  however,   well
\n                 settled   that  it  cannot   put   any
\n                 straitjacket formula. It  may  not  be
\n                 applied  in  a  given  case  unless  a
\n                 prejudice   is  shown.   It   is   not
\n                 necessary where it would be  a  futile
\n                 exercise.”\n<\/p><\/blockquote>\n
                 “28.  A  court of law does not  insist
\n                 on  compliance with useless formality.
\n                 It  will  not issue any such direction
\n                 where  the  result  would  remain  the
\n                 same,  in  view of the fact  situation
\n                 prevailing  or in terms of  the  legal
\n                 consequences.  Furthermore   in   this
\n                 case,  the  selection of the appellant
\n                 was  illegal. He was not qualified  on
\n                 the cut-off date. Being ineligible  to
\n                 be   considered  for  appointment,  it
\n                 would  have been a futile exercise  to
\n                 give   him  an  opportunity  of  being
\n                 heard.”\n<\/p><\/blockquote>\n
  9.   The  Hon’ble  Supreme Court in Viveka Nand  Sethi  v.
\n  Chairman, J<\/a>&K Bank Ltd. & others2, held as under:-.\n<\/p>\n
                    “22.  The  principle  of  natural
\n                    justice,  it  is  trite,  is   no
\n                    unruly  horse.  When  facts   are
\n                    admitted, an enquiry would be  an
\n                    empty    formality.   Even    the
\n                    principle of estopple will apply.
\n                    (See  Gurjeewan Garewal (Dr.)  v.
\n                    Dr.  Sumitra Dash) The<\/a> principles
\n                    of  natural justice are  required
\n                    to be complied with having regard
\n                    to  the  fact situation obtaining
\n                    therein.  It cannot be put  in  a
\n                    straitjacket formula.  It  cannot
\n                    be  applied  in a vacuum  without
\n                    reference  to the relevant  facts
\n                    and  circumstances of  the  case.
\n                    (See  State  of Punjab  v.  Jagir
\n                    Singh   and  Karnataka  SRTC<\/a>   v.
\n                    S.G.Kotturappa)”\n<\/p><\/blockquote>\n
  10.  Looking  from all angles, the petition fails  and  is
\n       accordingly dismissed. However, having regard to the fact
\n       that the letter dated 20.08.2008 (Annexure P\/8) whereby all
\n       the District Education Officers have been directed to send
\n       the information with regard to ACRs and other relevant
\n       information of the Music Teacher and PTIs for consideration
\n       of their candidature for promotion to the post of Lecturer,
\n       the same may be done at the earliest.\n<\/p>\n
