JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tYOUR<br \/>\nLORDSHIPS may be pleased to admit and allow this petition.\n<\/p>\n<p>(B)\tYOUR<br \/>\nLORDSHIPS may be pleased to direct the respondents to consider and<br \/>\ndecide the representation and case of the petitioner for granting<br \/>\nfamily pension and gratuity.\n<\/p>\n<p>(C)\tYOUR<br \/>\nLORDSHIPS may be pleased to declare that the petitioner is entitled<br \/>\nto get retirement benefits which includes the family pension and<br \/>\ngratuity and further be pleased to direct the respondents to give<br \/>\narrears of family pension and gratuity with interest thereon.\n<\/p>\n<p>(D)\tPending<br \/>\nhearing and final disposal of this Special Civil Application, YOUR<br \/>\nLORDSHIPS may be pleased to direct the respondents to give family<br \/>\npension from February, 2011 onwards every month.\n<\/p>\n<p>(E)\tYOUR<br \/>\nLORDSHIP may be pleased to pass such other order and further order as<br \/>\nmay be deemed just and proper in the interest of justice.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Mr. Vicky Mehta, learned advocate for the petitioner<br \/>\nstates that the interest of justice would be met, if the petitioner<br \/>\nis permitted to make a representation to respondent No.3, in light of<br \/>\nGovernment Resolution dated 27.01.2000, who may be directed to<br \/>\nconsider and decide the same, expeditiously.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>(a)\tThe<br \/>\npetitioner is permitted to make a fresh representation to respondent<br \/>\nNo.3, within a period of two weeks from today.\n<\/p>\n<p>(b)\tIn<br \/>\nthe event that the petitioner makes a representation within the<br \/>\nstipulated period of time, respondent No.3 shall consider and decide<br \/>\nthe same, in accordance with law, and keeping in mind the provisions<br \/>\nof Government Resolution dated 27.01.2000.\n<\/p>\n<p>(C)\tThe<br \/>\ndecision shall be rendered within a period of three months from the<br \/>\ndate of receipt of the representation.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing the order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>4.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>\t\t\t\t\t(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>Safir*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Sangitaben vs State on 31 January, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
