PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent application has been filed by the applicant for grant of<br \/>\n\tregular bail under section 439 of Code of Criminal Procedure, 1973<br \/>\n\tafter the charge sheet is filed.\n<\/p>\n<p>The<br \/>\n\tapplicant is charged with having committed offences under sections<br \/>\n\t376, 506(2), 344 and 114 of Indian Penal Code for which F.I.R. being<br \/>\n\tI-C.R.No.175 of 2010 has been registered with Vejalpur Police<br \/>\n\tStation.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Khan, referring to the FIR as well as the other papers<br \/>\n\tincluding the statement of the prosecutrix dated 7.4.2010, Annexure\n<\/p>\n<p>\t-D, has submitted that it was an affair and she had accompanied the<br \/>\n\tapplicant with her consent.  It was submitted that both are major<br \/>\n\tand only because of caste factor, the complaint has been given by<br \/>\n\tthe father after delay.  He has also submitted that the applicant is<br \/>\n\talso educated.  He therefore, submitted that present application may<br \/>\n\tbe allowed.\n<\/p>\n<p>Learned<br \/>\n\tAdditional Public Prosecutor Mr.Mengde resisted the application.  He<br \/>\n\treferred to the papers including the statement given by the Doctor<br \/>\n\tof General Hospital, Sola at Annexure F, wherein the victim has<br \/>\n\tstated about the history.  He also referred to further statement of<br \/>\n\tthe victim as to what has transpired and therefore, submitted that<br \/>\n\tpresent application may not be entertained.  Learned advocate Mr.<br \/>\n\tKhan has submitted that the statement of Doctor at annexure F to<br \/>\n\temphasize the last line that there was a prior relation and<br \/>\n\ttherefore, present application may be allowed.\n<\/p>\n<p>In<br \/>\n\tview of rival submissions, it is required to be considered whether<br \/>\n\tthe application can be entertained or not.\n<\/p>\n<p>\tIt is well accepted<br \/>\n\tthat this Court is not required to appreciate and scrutinize<br \/>\n\tevidence elaborately at this stage.  However, for considering prima<br \/>\n\tfacie case, the relevant aspects like the nature of<br \/>\n\toffence\/gravity, the manner in which it is alleged to have been<br \/>\n\tcommitted, the role attributed to the applicant, the statement of<br \/>\n\tthe victim and the medical evidence are required to be considered.<br \/>\n\tAs learned advocate Mr. Khan has submitted in detail, referring to<br \/>\n\tthe papers, only for considering prima facie case, the same have<br \/>\n\tbeen considered and without further elaboration, it cannot be said<br \/>\n\tthat there was a consent.  In fact, the statement of the victim,<br \/>\n\twhich has been recorded while giving the history before the<br \/>\n\tindependent person\/doctor of the General Hospital, Sola, itself<br \/>\n\tsuggested the prima facie case.  Not only that having regard to the<br \/>\n\tfurther statement as to what has transpired and considering the<br \/>\n\tgravity of the evidence and the observations made by the Hon&#8217;ble<br \/>\n\tApex Court in the case of  State of Punjab Vs. Gurmit Singh and<br \/>\n\tothers reported in AIR 1996 SC 1393 and in the case of<br \/>\n\t Rajinder alias Raju Vs. State of Himachal Pradesh reported in<br \/>\n\t(2009) 16 SCC 69, the present application cannot be<br \/>\n\tentertained even though, charge sheet has been filed.  Considering<br \/>\n\tthe gravity of the offence as well as the manner in which it is<br \/>\n\talleged to have been committed, present application deserves to be<br \/>\n\trejected and accordingly, it stands rejected.
