Heard     the    learned counsel appearing for               the<\/p>\n<p>      Applicant     and    the learned A.P.P.for the state.                  The<\/p>\n<p>      present    application       has been filed by       the      original<\/p>\n<p>      accused    No.3.      The    Applicant alongwith         four      other<\/p>\n<p>      accused    were     prosecuted for the     offence        punishable<\/p>\n<p>      under section 376 (2)(g) of the India Penal Code.                      The<\/p>\n<p>      Sessions    Court     passed    an order of     acquittal.             The<\/p>\n<p>      Respondent       State    of Maharashtra preferred an            Appeal<\/p>\n<p>      against    the acquittal.       By judgement and order             dated<\/p>\n<p>      1st   July,      2004, this Court overturned the            order       of<\/p>\n<p>      acquittal     and    convicted the accused for the              offence<\/p>\n<p><span class=\"hidden_text\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 14:16:44 :::<\/span><br \/>\n                                      ( 2 )<\/p>\n<p>    punishable under section 376(2)(g) of the Indian Penal<\/p>\n<p>    Code.       The accused were sentenced to suffer                  rigorous<\/p>\n<p>    imprisonment for seven years.            Fine of Rs.2,000\/- each<\/p>\n<p>    was    imposed      and in default of payment of              fine,        the<\/p>\n<p>    accused      were directed to suffer imprisonment for                      one<\/p>\n<p>    month.\n<\/p>\n<p>    2.          By    the present application, the Applicant has<\/p>\n<p>    invoked      section 7A of the Juvenile Justice (Care                      and<\/p>\n<p>    Protection         of   Children)     Act,     2000        (hereinafter<\/p>\n<p>    referred      as    the said Act of 2000).          On the basis            of<\/p>\n<p>    the    birth      certificate a copy of which is annexed                    to<\/p>\n<p>    the application it is contended that the date of birth<\/p>\n<p>    of the Appellant is 8th July, 1971.               It is pointed out<\/p>\n<p>    that    the      offence has been committed on 7th and 8                    th<\/p>\n<p>    May    1988      and therefore on the date of commission                    of<\/p>\n<p>    offence,      the    Applicant    was a    juvenile          within        the<\/p>\n<p>    meaning of clause (k) of sub section (1) of section                           2<\/p>\n<p>    of    the    said    Act of 2000.     By an     order        dated       19th<\/p>\n<p>    December,        2008   this   Court directed        the      Respondent<\/p>\n<p>    State of Maharashtra to make an inquiry and to examine<\/p>\n<p>    the    birth      certificate.      This     Court       directed          the<\/p>\n<p>    Respondent        State   to   record    the    statement           of     the<\/p>\n<p>    officials of Gram Panchayat to verify the claim of the<\/p>\n<p>    Applicant.        Accordingly, a report dated 29th December,<\/p>\n<p>    2008    has been submitted by the Assistant Inspector of<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 14:16:44 :::<\/span><br \/>\n                                          ( 3 )<\/p>\n<p>    Police,      Manchar      Police Station.         Various         documents<\/p>\n<p>    have      been annexed to the Report.            The first          document<\/p>\n<p>    is    a    certificate        issued by the Head master               of     the<\/p>\n<p>    Hutatma      Babu      Genu    Vidyalaya,      Mahalunge        &#8211;     Padwal,<\/p>\n<p>    Taluka      Ambegon,      District      Pune     stating        that         the<\/p>\n<p>    Applicant        was a bonafide students of the said                   school<\/p>\n<p>    in    the    year 1987-88 and as per the general                    register<\/p>\n<p>    maintained        by    the School, his date of birth                 is     8th<\/p>\n<p>    July,      1971.    Alongwith the report a birth certificate<\/p>\n<p>    issued      under      sections 12\/17 of the          Registration            of<\/p>\n<p>    Births      and    Deaths      Act, 1969 and Rules 8\/13               of     the<\/p>\n<p>    Maharashtra        Registration        of Births and Deaths              Rule,<\/p>\n<p>    2000      has<\/p>\n<p>                     been produced.        The officer       concerned           has<\/p>\n<p>    recorded        statements      of    five   witnesses.           The      said<\/p>\n<p>    statements as well as the documents produced alongwith<\/p>\n<p>    the    report      substantiates the case of             the      Applicant<\/p>\n<p>    that his date of birth was 8th July, 1971.                      The report<\/p>\n<p>    certifies        the    case    made    out by    the      Applicant          as<\/p>\n<p>    regards his date of birth.\n<\/p>\n<p>    3.          Under      sub section 1 of section 7A of the said<\/p>\n<p>    Act of 2000, this Court is under an obligation to make<\/p>\n<p>    an enquiry so as to determine the age of the Applicant<\/p>\n<p>    on    the date of commission of the offence.                    In view of<\/p>\n<p>    the documents produced by the Police Officer alongwith<\/p>\n<p>    the    report,      I    find that the date of           birth        of     the<\/p>\n<p><span class=\"hidden_text\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 14:16:44 :::<\/span><br \/>\n                                      ( 4 )<\/p>\n<p>    Applicant        is 8th July 1971 and therefore at the                 time<\/p>\n<p>    of commission of offence, he was a juvenile within the<\/p>\n<p>    meaning of clause (k) of sub Section 1 of section 7 of<\/p>\n<p>    the said Act of 2000.\n<\/p>\n<p>    4.          Sub section 2 of section 7 (A) of the said Act<\/p>\n<p>    of    2000 requires this Court to forward a person found<\/p>\n<p>    to be juvenile to the Board constituted under the said<\/p>\n<p>    Act    of    2000    for passing appropriate order              and      the<\/p>\n<p>    sentence,        if any passed by this Court shall be deemed<\/p>\n<p>    to    have      no effect.    Hence, the order of sentence                as<\/p>\n<p>    against      the    Applicant under the Judgment            and      order<\/p>\n<p>    dated    1st<\/p>\n<p>                      July,   2004    shall be deemed        to     have      no<\/p>\n<p>    effect.\n<\/p>\n<p>    5.          Section 15 of the said Act 2000 reads thus :\n<\/p>\n<blockquote><p>                (1) Where a Board is satisfied on inquiry that<\/p>\n<p>                a    juvenile    has committed an      offence,          then,<\/p>\n<p>                notwithstanding       anything   to      the        contrary<\/p>\n<p>                contained     in any other law for the time being<\/p>\n<p>                in force, the Board may, if it so thinks fit,-<\/p><\/blockquote>\n<p>                (a) allow the juvenile to go home after advice<\/p>\n<p>                or    admonition     following appropriate            inquiry<\/p>\n<p>                against    and counselling to the parent or                  the<\/p>\n<p><span class=\"hidden_text\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 14:16:44 :::<\/span><br \/>\n                              ( 5 )<\/p>\n<p>      guardian and the juvenile ;\n<\/p>\n<p>      (b)    direct    the    juvenile to          participate            in<\/p>\n<p>      group counselling and similar activities ;\n<\/p>\n<p>      (c)    order    the juvenile to perform                 community<\/p>\n<p>      service ;\n<\/p>\n<p>      (d)    order    the parent to the juvenile or                      the<\/p>\n<p>      juvenile     himself to pay a fine if he is                      over<\/p>\n<p>      fourteen years of age and earns money;\n<\/p>\n<p>      (e)<\/p>\n<p>             direct    the    juvenile to be             released         on<\/p>\n<p>      probation of good conduct and placed under the<\/p>\n<p>      care    of   any   parent, guardian or                other        fit<\/p>\n<p>      person,      on such parent, guardian or other fit<\/p>\n<p>      person    executing      a     bond,      with       or     without<\/p>\n<p>      surety, as the Board may require, for the good<\/p>\n<p>      behaviour      and well-being of the juvenile                      for<\/p>\n<p>      any period not exceeding three years ;\n<\/p>\n<p>      (f)    direct    the    juvenile to be             released         on<\/p>\n<p>      probation of good conduct and placed under the<\/p>\n<p>      care    of   any   fit institution             for      the      good<\/p>\n<p>      behaviour      and well being of the juvenile                      for<\/p>\n<p>      any period not exceeding three years;\n<\/p>\n<p><span class=\"hidden_text\">                                             ::: Downloaded on &#8211; 09\/06\/2013 14:16:44 :::<\/span><\/p>\n<blockquote><p>                                      ( 6 )<\/p>\n<\/blockquote>\n<blockquote><p>              (g) make an order directing the juvenile to be<\/p>\n<p>              sent      to a special home for a period of                     three<\/p>\n<p>              years :\n<\/p><\/blockquote>\n<blockquote><p>              Provided       that    the     Board        may,      if     it     is<\/p>\n<p>              satisfied      that having regard to the nature of<\/p>\n<p>              the offence and the circumstances of the case,<\/p>\n<p>              it    is    expedient so to do, for reasons to                      be<\/p>\n<p>              recorded      reduce    the period of stay                to     such<\/p>\n<p>              period as it thinks fit.&#8221;\n<\/p><\/blockquote>\n<pre>    When    it    is\n                         \n                        found that a Juvenile has              committed          an\n\n    offence,      there    are several options open                before        the\n                        \n    Board.       Making an order directing the juvenile to                        be\n\n    sent    to a Special Home for a period of three years is\n\n    not    the    only    option open for       the       Juvenile         Board.\n      \n\n\n    Considering        the facts and circumstances of the                     case,\n   \n\n\n\n    various      courses provided in clause (a) to (f) can                        be\n\n    adopted.       The    learned    counsel      appearing             for      the\n\n\n\n\n\n    Applicant      has drawn my attention to section 6 of                        the\n\n    said    Act and in particular sub section 2 thereof.                          It\n\n    provides      that the powers conferred by the said Act of\n\n\n\n\n\n    2000    on    the    Board may also be exercised by                   a    High\n\n    Court    when      proceeding    comes     before this            Court       in\n\n    Appeal,      Revision or otherwise.         Therefore, in a given\n\n\n\n\n<span class=\"hidden_text\">                                                     ::: Downloaded on - 09\/06\/2013 14:16:44 :::<\/span>\n                                     ( 7 )\n\n    case    in a pending Appeal or otherwise when this Court\n\n    finds      that on the date of commission of the                offence,\n\n    the    alleged      accused was a juvenile or a child,                 this\n\n    Court      can exercise the powers of the Board in view of\n\n\n\n\n                                                                         \n<\/pre>\n<blockquote><p>    sub section 2 of section 6 of the said Act, 2000.\n<\/p><\/blockquote>\n<p>    6.          Under    section 15 of the said Act of 2000                  the<\/p>\n<p>    most    stringent       action which can be taken           against         a<\/p>\n<p>    juvenile      is of directing the juvenile to be sent to a<\/p>\n<p>    Special      Home for a period of three years.              As     stated<\/p>\n<p>    earlier,      the offence was committed more than 20 years<\/p>\n<p>    back.       The present age of the Applicant is 37                 years.\n<\/p>\n<p>    The<\/p>\n<p>           Applicant has already suffered in the sense                     that<\/p>\n<p>    it    is    an    admitted position that the         Applicant           has<\/p>\n<p>    undergone sentence in terms of the order of this Court<\/p>\n<p>    passed       in     Appeal   for   more   than       three         years.\n<\/p>\n<p>    Considering        the facts of the case and especially                  the<\/p>\n<p>    fact    that      the   present age of the      Applicant          is     37<\/p>\n<p>    years,      now no purpose will be served by adopting                    any<\/p>\n<p>    of    the options open under sub section 1 section 15 of<\/p>\n<p>    the    said      Act of 2000.   This view is required              to     be<\/p>\n<p>    taken      in the light of the peculiar facts of the                   case<\/p>\n<p>    in    as    much    as the Applicant has      already         undergone<\/p>\n<p>    sentence for more than three years.\n<\/p>\n<p>    7.          Therefore, the only course open which needs to<\/p>\n<p><span class=\"hidden_text\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 14:16:44 :::<\/span><br \/>\n                               ( 8 )<\/p>\n<p>    be adopted is of directing that the Applicant shall be<\/p>\n<p>    forthwith released unless he is required in connection<\/p>\n<p>    with any other case.\n<\/p>\n<p>    8.      Hence, the following order :\n<\/p>\n<pre>                       ::    O R D E R ::\n\n\n\n\n                                        \n            i.      Application is allowed.\n\n\n\n\n                               \n            ii.     The    Applicant shall be forthwith                 set\n                  \n<\/pre>\n<p>            at liberty unless he is required in connection<\/p>\n<p>            with some other case.\n<\/p>\n<pre>            ii.
