Jani, for the petitioner.\n<\/p>\n<p>2.\t\tLearned Advocate<br \/>\ninvited attention of this Court to the relevant para\/portion of the<br \/>\naward dated 24th February, 2011, passed by the learned<br \/>\nJudge of the Labour Court No.5, Ahmedabad, in Reference(L.C.A.)<br \/>\n1401\/2004.\n<\/p>\n<p>3.\t\tLearned Advocate for<br \/>\nthe petitioner, prima<br \/>\nfacie, demonstrated before the<br \/>\nCourt that the learned Judge has committed an error in overlooking<br \/>\nthe contents of the documents produced at Exh.15\/1, 15\/7, 15\/8 and<br \/>\nalso at Exhibit-100.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdvocate for the petitioner submitted that the respondent was never<br \/>\nemployed by the present petitioner. He was only a Contractor<br \/>\nand on the basis of the work received by the petitioner, which was<br \/>\nassigned to the respondent on contract basis, the bills were drawn<br \/>\nand accordingly he was paid the labour charges.\n<\/p>\n<p>5.\t\tLearned Advocate for<br \/>\nthe petitioner also submitted that, though, it is stated by the<br \/>\nrespondent that he was getting miscellaneous work from the other<br \/>\ndealers of &#8216;Maruti&#8217;, which are four in numbers in the City of<br \/>\nAhmedabad.
