No. 103 OF 2008\n              ````````````````````````````````````````````````````\n             Dated this the 16th day of January, 2008\n\n                                O R D E R\n<\/pre>\n<p>          This    revision        petition       is    directed    against a<\/p>\n<p>concurrent verdict of guilty, conviction and sentence in a<\/p>\n<p>prosecution under Section 138 of the N.I Act. The petitioner<\/p>\n<p>now faces a sentence of simple imprisonment for a period of<\/p>\n<p>six months. There is a further direction to pay an amount of<\/p>\n<p>Rs.75,000\/- as compensation and in default to undergo simple<\/p>\n<p>imprisonment for a further period of two months.<\/p>\n<p>     2.   The cheque is for an amount of Rs.1,00,000\/-. It<\/p>\n<p>bears the date 27.1.2005. Before the learned Magistrate, the<\/p>\n<p>complainant examined himself as PW1 and proved Exts.P1 to<\/p>\n<p>P11. No defence evidence was adduced. The courts below<\/p>\n<p>concurrently came to the conclusion that the complainant has<\/p>\n<p>succeeded in establishing all ingredients of the offence<\/p>\n<p>punishable under Section 138 of the N.I.Act. Accordingly they<\/p>\n<p>proceeded to pass the impugned concurrent judgments.<\/p>\n<p>Crl.R.P.103\/08<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>      3.     Called upon to explain the nature of challenge,<\/p>\n<p>which the petitioner wants to mount against the impugned<\/p>\n<p>concurrent judgments, the learned counsel for the petitioner<\/p>\n<p>does not strain to assail the verdict of guilty and conviction on<\/p>\n<p>merits.     The learned counsel only prays that the sentence<\/p>\n<p>imposed may be modified and reduced.\n<\/p>\n<p>      4.     Having gone through the impugned concurrent<\/p>\n<p>judgments, I am satisfied that, that is an informed and fair<\/p>\n<p>stand taken by the learned counsel for the petitioner. The<\/p>\n<p>impugned verdict of guilty and conviction are found to be<\/p>\n<p>absolutely reasonable and unexceptionable. In the absence<\/p>\n<p>of challenge on any specific grounds, it is not necessary for<\/p>\n<p>me to advert to facts in any greater detail in this order.<\/p>\n<p>      5.     Coming to the question of sentence, I find merit in<\/p>\n<p>the prayer for leniency.      I have already adverted to the<\/p>\n<p>principles governing imposition of sentence in a prosecution<\/p>\n<p>under Section 138 of the N.I Act in the decision reported in<\/p>\n<p>Anilkumar v. Shammi [2002(3) KLT 852]. I am satisfied that<\/p>\n<p>Crl.R.P.103\/08<br \/>\n<span class=\"hidden_text\">                                 : 3 :<\/span><\/p>\n<p>there are no compelling       reasons    which  can  persuade<\/p>\n<p>this Court to insist on imposition of any deterrent substantive<\/p>\n<p>sentence of imprisonment.         Leniency can be shown on the<\/p>\n<p>question of sentence, but subject only to the compulsion of<\/p>\n<p>ensuring      adequate     and    just  compensation  for  the<\/p>\n<p>victim\/complainant,     who has been compelled to fight two<\/p>\n<p>rounds of legal battle by now and to wait from 27.1.05 for the<\/p>\n<p>redressal of his grievances. I am satisfied that there must at<\/p>\n<p>least a direction to pay the actual cheque amount as<\/p>\n<p>compensation and an appropriate default sentence to<\/p>\n<p>adequately compensate the victim on condition that the<\/p>\n<p>deterrent substantive sentence of imprisonment is avoided.<\/p>\n<p>      6.     In the result:\n<\/p>\n<pre>       a)    This Crl.R.P is allowed in part;\n\n       b)    The impugned concurrent verdict of guilty and\n\n<\/pre>\n<p>conviction of the petitioner under Section 138 of the N.I Act<\/p>\n<p>are upheld;\n<\/p>\n<p>       c)    But the sentence imposed is modified and reduced.<\/p>\n<p>Crl.R.P.103\/08<br \/>\n<span class=\"hidden_text\">                                : 4 :<\/span><\/p>\n<p>In supersession of the sentence imposed on the petitioner by<\/p>\n<p>the courts below, he is sentenced to undergo imprisonment till<\/p>\n<p>rising of court. He is further directed to pay the actual cheque<\/p>\n<p>amount of Rs.1,00,000\/- (Rupees one lakh only) as<\/p>\n<p>compensation under Section 357(3) Cr.P.C. and in default to<\/p>\n<p>undergo simple imprisonment for a period of three months.<\/p>\n<p>      7.     The petitioner shall have time till 29.2.08 to comply<\/p>\n<p>with the directions for payment of compensation.              This<\/p>\n<p>modified sentence shall not be executed till that day. The<\/p>\n<p>petitioner shall appear and his sureties shall produce him<\/p>\n<p>before the learned Magistrate         on or before 1.3.08 for<\/p>\n<p>execution of the sentence.\n<\/p>\n<p>      8.
