DAVE\n\t\t\n\t\n\n \n\nDate\n: 13\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nlearned Counsel for the parties.\n<\/p>\n<p>2.\t\tWithout<br \/>\nconsidering the subject matter in detail, since affidavit dated 13th<br \/>\nOctober, 2011, is filed by Shri. Dinesh Parmar, Under Secretary,<br \/>\nHealth and Family Welfare Department, Sachivalaya, Government of<br \/>\nGujarat, by which it is submitted that, in answer to earlier<br \/>\ncommunication of GPSC, by letter dated 11.10.2011, the Secretary,<br \/>\nGujarat Public Service Commission, has been informed that the draft<br \/>\nrules for the posts in question have been finalized and to be<br \/>\nsubmitted, accordingly.\n<\/p>\n<p>\t\tParagraph<br \/>\nNos. 5 and 6 of the affidavit read as under:\n<\/p>\n<p>&#8220;5.\t\tI say and<br \/>\nsubmit that by letter dated 18-03-2011, the Gujarat Public Service<br \/>\nCommission requested the State Government to send draft recruitment<br \/>\nrules including the cadre of Professor and Associate Professor along<br \/>\nwith the cadre of Assistant Professor along with the cadre of<br \/>\nAssistant Professor.  In this regard, the State Government vide<br \/>\nHealth and Family Welfare Department&#8217;s letter dated 11-10-2011 has<br \/>\nclarified that the State Government has decided to make separate<br \/>\nrecruitment rules for the cadre of Professor, Associate Professor and<br \/>\nAssistant Professor instead of the existing combined recruit rules<br \/>\nfor the said three cadres published by the Notification dated<br \/>\n20-03-2002.  at present, draft recruitment rules for the cadre of<br \/>\nAssistant Professor has been finalized by State Government and<br \/>\ntherefore the same has been sent to the Gujarat Public Service<br \/>\nCommission for its concurrence. Attached hereto and marked as<br \/>\nAnnexure R-2 is a copy of<br \/>\nthe letter dated 11-10-2011.\n<\/p>\n<p>6.\t\tI<br \/>\nrespectfully submit that the draft of the recruitment rules for the<br \/>\ncadre of Professor and Associate Professor is under process and will<br \/>\nbe finalized soon in consultation with the Gujarat Public Service<br \/>\nCommission as well as the Legislative and Parliamentary Affairs<br \/>\nDepartment of the State Government.  The draft recruitment rules for<br \/>\nthe cadre of Assistant Professor will soon be sent to the Legislative<br \/>\nand Parliamentary Affairs Department for the purpose of legal vetting<br \/>\nafter the Gujarat Public Service Commission gives its concurrence to<br \/>\nthe said draft rules.  &#8221;\n<\/p>\n<p>3.\t\tConsidering<br \/>\nthe above, at this stage, the grievance of the petitioner stands<br \/>\nredressed to the aforesaid extent.
