This  appeal by special leave arises from the  judgment<br \/>\nof the Division Bench of the Bombay High Court in Appeal No.<br \/>\n681  of\t 1990 dated 12-9-1991.\tThe  appellants\t filed\tWrit<br \/>\nPetition No. 3571 of 1989 seeking that the former  employees<br \/>\nof the respondent-Corporation who retired prior to  1-1-1989<br \/>\n(clerical cadre) employed in the Bombay region are  entitled<br \/>\nto  the parity in payment of pension with the employees\t who<br \/>\nretired\t on  that date in other regions of  the\t respondent-<br \/>\nCorporation  and  the non-payment thereof  is  violative  of<br \/>\nArticles  14 and 21 of the Constitution.  To understand\t the<br \/>\ncontention, it is necessary to mention the background of the<br \/>\ncase.\n<\/p>\n<p>3.   Consequent\t upon the nationalisation of  the  erstwhile<br \/>\nBurmah-Shell  on  24-1-1976, the Burmah-Shell  Pension\tFund<br \/>\noperating prior to the nationalisation was taken over and  a<br \/>\nnew  trust  fund  was  created\twith  terms  and  conditions<br \/>\nmentioned  therein  found beneficial to the  employees\teven<br \/>\nafter  the  nationalisation.  According to  the\t terms,\t the<br \/>\npension\t is  payable on the basic salary and  not  on  basic<br \/>\nsalary\tplus  DA.   In 1978, disputes  were  raised  by\t the<br \/>\nemployees&#8217;  union  including  the dispute  relating  to\t the<br \/>\nincrease  of  the pension by merging DA\t with  basic  salary<br \/>\nwhich had been referred to the Industrial Tribunal.  In\t its<br \/>\naward  dated  24-10-1983, the Industrial  Tribunal  rejected<br \/>\ndemand\t3 i.e. claim to increase the pension with merger  of<br \/>\nDA  in\tthe basic salary and computation of the\t pension  on<br \/>\nthat  basis.   In  respect  of\tthis  rejected\tdemand,\t the<br \/>\nemployees filed WP No. 1568 of 1985 and in respect of  other<br \/>\ndemands\t allowed  by the Tribunal, the\trespondent  employer<br \/>\nfiled  WP  No. 757 of 1984.  Therein a compromise  had\tbeen<br \/>\nreached\t by  and between the parties and the  relevant\tpart<br \/>\nreads thus:\n<\/p>\n<blockquote><p>\t      &#8220;(d)  The\t old  clerical\temployees  who\thave<br \/>\n\t      retired from the Corporation prior to 1-1-1989<br \/>\n\t      will be paid as one time lump sum compensation<br \/>\n\t      in lieu of awarded amount of HRA, gratuity and<br \/>\n\t      duty  allowance (so far as divisional  offices<br \/>\n\t      are  concerned) amounting to Rs 50,000  within<br \/>\n\t      four weeks from that date.&#8221;\n<\/p><\/blockquote>\n<p>Clause\t (4)  is  relevant  for\t this  purpose.\t  It   would<br \/>\narticulate that &#8220;award in respect of items and demands other<br \/>\nthan those items settled above will operate&#8221;.\n<\/p>\n<p>4.   The  Industrial Tribunal has stated in respect  of\t the<br \/>\ndemand for increasing the pension at para 11 thus:\n<\/p>\n<p><span class=\"hidden_text\">18<\/span><\/p>\n<blockquote><p>\t      &#8220;The  present demand of the Union is that\t the<br \/>\n\t      existing pension scheme should be modified and<br \/>\n\t      revised so to include:\n<\/p><\/blockquote>\n<blockquote><p>\t      (a)   pension  amount should be calculated  on<br \/>\n\t      the   wages\/salaries  inclusive  of   Dearness<br \/>\n\t      Allowance and other non-personal allowances.\n<\/p><\/blockquote>\n<blockquote><p>\t      (b)   it\tshould be assessed on the  basis  of<br \/>\n\t      50%  of  wages\/salaries  last  drawn  by\t the<br \/>\n\t      workman without any deduction.&#8221;\n<\/p><\/blockquote>\n<p>5.   Considering this aspect of the matter, the Tribunal had<br \/>\nheld  that the demand for the revision and  modification  of<br \/>\nthe pension scheme, if granted, would impose an unreasonable<br \/>\nfinancial  burden on the company without any  justification.<br \/>\nIt  was,  therefore,  held  that  &#8220;no  question\t arises\t for<br \/>\nrevising  calculation  of pension or checking the  basis  of<br \/>\ncalculating  pension from basic wages to total\twages.\t The<br \/>\ndemand\tis,  therefore, rejected.&#8221; In view of the  terms  of<br \/>\nconsent\t referred to hereinbefore, this finding on demand  3<br \/>\nfor  increasing\t the pension stood concluded and  binds\t the<br \/>\nappellants.\n<\/p>\n<p>6.   Subsequently,  another attempt had been made by  filing<br \/>\nWP  No. 2907 of 1989 to reopen the consent order  seeking  a<br \/>\ndeclaration that the terms of consent dated 14-2-1989 in the<br \/>\nwrit  petition do not bind the appellant Association.\tThat<br \/>\nwrit  petition was dismissed by the High Court on  19-2-1990<br \/>\nand that order was allowed to become final.\n<\/p>\n<p>7.   Yet another attempt was made by filing a writ  petition<br \/>\nunder Article 32 of the Constitution in this Court in WP No.<br \/>\n527  of 1989.  This Court permitted the appellants by  order<br \/>\ndated  27-10-1989 to withdraw the petition with\t liberty  to<br \/>\napproach   the\tappropriate  forum.   In  consequence,\t the<br \/>\nappellants  filed  WP  No. 3571 of 1989,  which,  as  stated<br \/>\nearlier,  was dismissed and the Division Bench concluded  in<br \/>\nits order thus:\n<\/p>\n<blockquote><p>\t      &#8220;It  is now well settled that in\trelation  to<br \/>\n\t      persons  drawn from different backgrounds\t and<br \/>\n\t      who   have   functioned\tunder\tdifferential<br \/>\n\t      conditions  of service, and who had their\t own<br \/>\n\t      advantages   and\t disadvantages\t under\t the<br \/>\n\t      employment patterns in existence of  different<br \/>\n\t      industrial  units, no absolute equality  could<br \/>\n\t      be predicated.  It has been a mixed bag,\tthat<br \/>\n\t      by  and large, had satisfied the\trequirements<br \/>\n\t      of   the\temployees  and\tthe  conscience\t  of<br \/>\n\t      industrial  jurisprudence.  The  establishment<br \/>\n\t      in  question had agile and  agitating  unions.<br \/>\n\t      The  terms  and conditions had  been  subject-<br \/>\n\t      matter  of  settlements and awards,  and\teven<br \/>\n\t      judicial\torders.\t When the establishment\t has<br \/>\n\t      punctiliously  adhered to the requirements  of<br \/>\n\t      such   settlements,   claims   and    judicial<br \/>\n\t      decisions, courts are not expected to break  a<br \/>\n\t      ripple in the otherwise translucent waters  of<br \/>\n\t      industrial relations.&#8221;\n<\/p><\/blockquote>\n<p>8.   It\t is sought to be contended for the  appellants\tthat<br \/>\nwhen  the  other employees similarly situated  in  the\tsame<br \/>\nrespondent-Corporation, are receiving pensionary benefits on<br \/>\nDA-merged  basis,  the denial thereof to the  appellants  is<br \/>\narbitrary, unjust and unfair offending the right to equality<br \/>\nand  impinges  on the livelihood of  the  retired  employees<br \/>\nviolating  Articles 14 and 21 of the Constitution.  We\tfind<br \/>\nno substance in the contention.\t It is seen<br \/>\n<span class=\"hidden_text\"> 19<\/span><br \/>\nfrom  the  narrative that the  appellants  had\tspecifically<br \/>\nraised the demand for increasing the pension on the basis of<br \/>\nDA  merger with basic pay and demand that 50% of  the  total<br \/>\nwages  should  be  the foundation  for\tcalculation  of\t the<br \/>\npension.   In  the industrial adjudication this\t demand\t was<br \/>\nexpressly  negatived and was allowed to become final.\tThat<br \/>\napart,\tit is seen that in the industrial  adjudication\t the<br \/>\nother  demands also had been raised and while  granting\t the<br \/>\nbenefits  on other demands the parties &#8211; Management and\t the<br \/>\nworkmen\t entered  into\ta  compromise  in  the\tHigh  Court,<br \/>\nagreeing  to pay to the employees retired prior to  1-1-1989<br \/>\nhigher\tamount\tof Rs 50,000 and the working  employees\t the<br \/>\nbenefit of Rs 25,000.\n<\/p>\n<p>9.   Thus,  it\tcould be seen that having consented  to\t the<br \/>\nadjudication  made  by the Tribunal and having\tallowed\t the<br \/>\nindustrial  award  to become final, it is not  open  to\t the<br \/>\nappellants  to\tgo  behind the award and  claim\t pension  on<br \/>\nparity with others on the anvil of Articles 14 and 21.\tThat<br \/>\napart the difference of payment of the pension had arisen on<br \/>\naccount\t of  the  revision of the wages\t etc.  only  in\t the<br \/>\nindustrial  adjudication and demands by the union on  behalf<br \/>\nof the workmen.\t The discrimination was due to the  judicial<br \/>\ndetermination  and not due to the acts of  the\trespondents.<br \/>\nIt  is no longer, therefore, open to the workmen to  contend<br \/>\nthat  they are entitled to parity in the payment of  pension<br \/>\nwith  the  employees  in the  other  regions.\tThe  retired<br \/>\nemployees  in other regions are getting higher pension\tthan<br \/>\nthe retired employees of Bombay region but it is only due to<br \/>\njudicial adjudication.\n<\/p>\n<p>10.  Considered\t in the said perspective and in view of\t the<br \/>\nfacts  and circumstances, we are of the view that  the\tHigh<br \/>\nCourt  was  well justified in refusing to grant\t the  relief<br \/>\nclaimed\t by  the  appellant.   The  appeal  is\t accordingly<br \/>\ndismissed.
