Justice K.HEMA\n\n Dated :17\/09\/2008\n\n O R D E R\n                               K.HEMA, J.\n                     ------------------------------\n                        B.A. No.5417 OF 2008\n                     ------------------------------\n             Dated this the 17th day of September, 2008\n\n\n                               O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 143, 147, 148,<\/p>\n<p>149, 452, 427, 323, 324, 379 of I.P.C. According to the<\/p>\n<p>prosecution, the petitioners along with others trespassed into the<\/p>\n<p>office of a cashew company, in which the defacto complainant is an<\/p>\n<p>employee, assaulted him, committed mischief in the building and<\/p>\n<p>also committed theft of a mobile phone.\n<\/p>\n<p>      3. Learned counsel for the petitioners submitted that a lorry<\/p>\n<p>was being taken into the cashew company, while it hit against an<\/p>\n<p>electric post, the line was damaged thereby and there was lack of<\/p>\n<p>light in locality and people of the locality were agitated and some<\/p>\n<p>incident happened. But things have not transpired as alleged.<\/p>\n<p>Though mobile phone is allegedly lost, offence under Section 379 of<\/p>\n<p>I.P.C. was included only as per a report dated 01.08.2008, after<\/p>\n<p>about 5 days of the incident. Such an allegation was not there in<\/p>\n<p>the First Information Statement, it is submitted. The only non<\/p>\n<p>bailable offence is under Section 452 of I.P.C. But in the<\/p>\n<p>circumstances in which the incident happened, it cannot be said<\/p>\n<p>B.A.5417 of 2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>that the allegations would constitute offence under Section 452 of<\/p>\n<p>I.P.C., it is submitted.\n<\/p>\n<p>      4. Learned Public Prosecutor submitted that the petitioners<\/p>\n<p>trespassed into the building and committed mischief in the cashew<\/p>\n<p>company. But it is true that the allegation of offence under Section<\/p>\n<p>379 of I.P.C. was brought in only after 5 days of the incident.<\/p>\n<p>However, he has no objection in granting anticipatory bail on<\/p>\n<p>conditions.\n<\/p>\n<p>      Hence, the following order is passed:\n<\/p>\n<blockquote><p>                   The petitioners shall surrender before the<\/p>\n<p>             Investigating Officer within 7 days from today and<\/p>\n<p>             in the event of their arrest, if any, they will be<\/p>\n<p>             released on bail on their executing bond for<\/p>\n<p>             25,000\/- each with two solvent sureties each for<\/p>\n<p>             like sum to the satisfaction of the Arresting Officer<\/p>\n<p>             on condition that they will co-operate with the<\/p>\n<p>             investigation and report before the Investigating<\/p>\n<p>             Officer as and when directed.\n<\/p><\/blockquote>\n<p>      The petition is allowed.\n<\/p>\n<\/p>\n<p>                              K.HEMA, JUDGE<br \/>\npac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Aneesh.D.R.
