Justice M.SASIDHARAN NAMBIAR\n\n Dated :09\/06\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               Tr.P.(CRL.)NO.102 OF 2008\n              ------------------------------------------\n\n                 Dated       9th     June 2009\n\n\n                           O R D E R\n<\/pre>\n<p>            Petitioner        is      the      accused     and   first<\/p>\n<p>respondent the complainant in S.T.4195\/2005 on the<\/p>\n<p>file of Judicial First Class Magistrate-II, North<\/p>\n<p>Paravoor.   Magistrate has taken cognizance for the<\/p>\n<p>offence under Section 138 of Negotiable Instruments<\/p>\n<p>Act.  First  respondent         was      examined       as  early   as<\/p>\n<p>22\/4\/2008 and case was posted for questioning under<\/p>\n<p>Section 313 of Code of Criminal Procedure.                        The<\/p>\n<p>petitioner did not appear and a non bailable warrant<\/p>\n<p>was issued. It is pending. This              petition is filed for<\/p>\n<p>transfer  of  the     case      from       Judicial      First   Class<\/p>\n<p>Magistrate, North Paravoor to Judicial First Class<\/p>\n<p>Magistrate, Kanjirappally contending that petitioner<\/p>\n<p>is laid up due to cancer and             he is not in a position<\/p>\n<p>to  travel  and      appear        before       the     Magistrate at<\/p>\n<p>Paravoor and give evidence.                  Petitioner has also<\/p>\n<p>contended  that   court        at     North       Paravoor    has  no<\/p>\n<p>jurisdiction and therefore it is to be transferred.<\/p>\n<pre>\n\nTPCR 102\/08\n<span class=\"hidden_text\">                              2<\/span>\n\n\n           2.   Learned   counsel    appearing   for\n\n<\/pre>\n<p>petitioner and first respondent were heard.<\/p>\n<pre>           3.   Learned   counsel    appearing   for\n\npetitioner submitted that    medical records produced\n\nestablish that petitioner is suffering     from bone\n\ncancer and is being administered    Chemotherapy and\n\n<\/pre>\n<p>it is not possible for him to travel to North<\/p>\n<p>Paravoor   and   give  evidence.    Learned   counsel<\/p>\n<p>submitted   that   the     case  be  transferred   to<\/p>\n<p>Kanjirappally and petitioner is prepared to co-<\/p>\n<p>operate for early disposal and there can be a<\/p>\n<p>direction to dispose the same within a time frame.<\/p>\n<p>           4.   Learned counsel appearing for first<\/p>\n<p>respondent opposed the application contending that<\/p>\n<p>petitioner   absconded when the case was posted for<\/p>\n<p>questioning and in such circumstances, he is not<\/p>\n<p>entitled to get a transfer. Learned counsel also<\/p>\n<p>submitted that if the case is to be transferred,<\/p>\n<p>first    respondent,  a   lady  has  to   travel  to<\/p>\n<p>Kanjirapally and   engage a counsel and appear before<\/p>\n<p>the court and it would be a punishment for her and<\/p>\n<p>therefore the case may not be transferred.<\/p>\n<p>           5.   Considering the records establishing<\/p>\n<p>the illness of the petitioner, it is in the interest<\/p>\n<p>TPCR 102\/08<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>of justice to transfer the case    to Judicial First<\/p>\n<p>Class Magistrate, Kanjirappally. Apprehension of the<\/p>\n<p>first   respondent\/complainant    that  she  had   to<\/p>\n<p>undertake     journey to Kanjirappally which would<\/p>\n<p>cause difficulty to her,   could be removed by making<\/p>\n<p>it clear that she need not be present    before  the<\/p>\n<p>court and    she can represent through her counsel.<\/p>\n<p>So also the apprehension of the further protraction<\/p>\n<p>of the case could be avoided by directing the<\/p>\n<p>Magistrate to dispose the case within a time frame.<\/p>\n<p>            6. In such circumstances,    petition is<\/p>\n<p>allowed. S.T.4195\/2005 on the file of Judicial First<\/p>\n<p>Class Magistrate-II, North Paravoor   is transferred<\/p>\n<p>to Judicial First Class Magistrate-I, Kanjirappally<\/p>\n<p>for trial, making it clear that the Magistrate has<\/p>\n<p>continue    the  proceedings  from   the   stage   of<\/p>\n<p>questioning the accused on the evidence already<\/p>\n<p>recorded under Section 313      of Code of Criminal<\/p>\n<p>Procedure. It is also made clear that the Magistrate<\/p>\n<p>to give exemption to first respondent\/complainant<\/p>\n<p>from personal appearance   as her evidence is already<\/p>\n<p>over and personal appearance of the complainant is<\/p>\n<p>not at     all necessary. Magistrate to dispose the<\/p>\n<p>case within two months from the date of receipt of<\/p>\n<p>TPCR 102\/08<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>the records.
