Patil, S.R.Babu\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>Rajendra Babu, J.  :\n<\/p>\n<p>      Leave granted.\n<\/p>\n<p>      Respondent filed a suit seeking a mandatory injunction<br \/>\nto  the\t appellants  to\t sanction and  pay  family  pension,<br \/>\nG.P.F.,\t Death-cum- Retirement Gratuity, ex-gratia grant and<br \/>\nleave  encashment etc.\tHer case is that she is the  widowed<br \/>\nsister\tof Shri Dalip Chand, who was working as a Lineman in<br \/>\nthe appellants establishment at the time of his death.\tThe<br \/>\nsuit  was resisted by the appellant and it is contended that<br \/>\ndeceased  Dalip Chand did not nominate any person to be paid<br \/>\nthe  family pension or G.P.F.  nor any member of his  family<br \/>\nwas  dependent on Dalip Chand for payment of family pension.<br \/>\nThe  trial  court  decreed the suit in\trespect\t of  various<br \/>\nclaims\tmade  by the respondent.  The matter was carried  in<br \/>\nappeal\tunsuccessfully.\t  In the second appeal in  the\tHigh<br \/>\nCourt  it  was\tnoticed that the matter is  covered  by\t the<br \/>\ndecision  in  Jasohdhan Devi vs.  State of Punjab  and\tAnr,<br \/>\n1989 (6) S.L.R.\t 664 and therefore no interference is called<br \/>\nfor  as\t the widowed sister is recognized as member  of\t the<br \/>\nfamily entitled to family pension.\n<\/p>\n<p>      The contention put forth before this Court is that the<br \/>\nrespondent  is\tnot  a member of the family as per  the\t new<br \/>\npension rules which came into force in 1964 under which only<br \/>\nspouse and children of the deceased employee will constitute<br \/>\nmembers\t of  the family.  In addition it is  contended\tthat<br \/>\neven  if the respondent is a member of the family under\t the<br \/>\nold  rules, in which an unmarried widowed sister is included<br \/>\nin  the definition of family, still she has to fulfil  other<br \/>\nconditions  arising  under the other relevant provisions  of<br \/>\nthe Rules and those conditions having not been fulfilled the<br \/>\nCourts\tbelow  were not justified in passing the decree\t for<br \/>\ngrant  of  family  pension.   The learned  counsel  for\t the<br \/>\nrespondent submitted that the view taken by the Courts below<br \/>\nis absolutely justified and no interference is called for.\n<\/p>\n<p>      Though  three claims had been made by the\t respondent,<br \/>\nthe learned counsel for the appellant confined his case only<br \/>\nto  one aspect of the matter namely, grant of family pension<br \/>\nand  in\t regard to other two aspects did not  challenge\t the<br \/>\ndecree\tpassed\tby the Courts below as affirmed by the\tHigh<br \/>\nCourt  of  Punjab &amp; Haryana.  Therefore, we will  rivet\t our<br \/>\nattention only to the question of grant of family pension to<br \/>\nthe respondent.\n<\/p>\n<p>      The  fact\t that respondent is a widowed sister of\t the<br \/>\ndeceased employee of the appellant is not in dispute.  It is<br \/>\nalso  not in dispute that he did not exercise his option  to<br \/>\nbe  governed  by the Pension Scheme 1964 and  therefore\t the<br \/>\nrestricted  definition\tgiven  to  the\texpression  `Family<br \/>\nconfining  only to spouses, sons and unmarried daughters has<br \/>\nno  application.   On the other hand, the relevant rules  in<br \/>\nPunjab\tCivil  Services\t Rules Vol.  II 1960 Ed.   would  be<br \/>\napplicable  wherein  in Rule 6.16- D (1) an  explanation  is<br \/>\nadded  to  define as to what family is and  that  definition<br \/>\nadopts\tthe definition set out in Rule 6.16-B (1)(a)  except<br \/>\ncertain\t persons  and that rule clearly includes  a  widowed<br \/>\nsister.\t  Therefore in the absence of any option having been<br \/>\nexercised  by the deceased employee to adopt new Rules,\t old<br \/>\nRules govern him as rightly held by the High Court following<br \/>\nthe decision in Jasodhan Devi v.  State of Punjab (supra), a<br \/>\nwidowed\t sister does become a member of the family who could<br \/>\nclaim  pension under those Rules.  So far as this aspect  of<br \/>\nthe  matter is concerned, the view taken by the Courts below<br \/>\nis absolutely justified and calls for no interference.\n<\/p>\n<p>      However,\tthe  matter  does not rest at what  we\thave<br \/>\nstated\tso far.\t In order to become entitled to claim family<br \/>\npension, the conditions specified in Chapter VI, sub-heading<br \/>\nD:`Family  Pensions,  have to be fulfilled.  Clause (a)\t of<br \/>\nRule  6.16-D  provides\tthat no pension is  payable  without<br \/>\nproduction  of\tany proof that such person was dependent  on<br \/>\nthe deceased officer for support in respect of those falling<br \/>\nwithin\tsub-rule  (4)(b).   Sub-rule   (4)  applies  to\t two<br \/>\ncategories of the members of the family.  The first category<br \/>\nconsists  of  spouses  and children.   The  second  category<br \/>\ncoming\tunder  clause  (b) are all other  relatives  of\t the<br \/>\ndeceased  such as parents and siblings.\t So far as relatives<br \/>\nother  than  spouse  and children are concerned there  is  a<br \/>\ncondition  that they are dependents on the deceased employee<br \/>\nfor  support  has to be established by\tadducing  reasonable<br \/>\nproof  to  claim  pension.  Further the scheme of  grant  of<br \/>\npension\t is  by way of exclusion of a relative mentioned  in<br \/>\nthe  earlier category with reference to the one mentioned in<br \/>\nthe  latter  category.\t In  the first place  it  is  to  be<br \/>\nestablished  that there was no nomination in respect of\t any<br \/>\none  of\t them  and that such person was a dependent  of\t the<br \/>\ndeceased  employee at the time of the death.  In the absence<br \/>\nof  such  proof\t family pension cannot be  granted.   Indeed<br \/>\nwhether\t a  widowed sister, as in the present case, has\t her<br \/>\nown  source  of\t income\t or was not  a\tdependent  upon\t the<br \/>\ndeceased  is  a\t matter\t to   be  established  by   adducing<br \/>\nappropriate  proof.   However,\tnone  of  the  Courts\thave<br \/>\nadverted  their\t attention  to this aspect  of\tthe  matter,<br \/>\nthough\tthe  defence  raised  by  the  appellants  has\tbeen<br \/>\nnoticed.  Thus we have no option but to set aside the decree<br \/>\npassed by the trial court as affirmed by the first appellate<br \/>\ncourt  and  the\t High Court in second appeal to\t the  extent<br \/>\nindicated  above  in  so  far it relates  to  direction\t for<br \/>\npayment of family pension.\n<\/p>\n<p>      This  appeal  is thus allowed to the extent  indicated<br \/>\nabove  setting\taside the decree in so far as it relates  to<br \/>\nthe  direction\tto  grant  of family pension  and  in  other<br \/>\nrespects  remains undisturbed and the matter is remitted  to<br \/>\nthe  trial court for fresh consideration on the question  as<br \/>\nto  whether  the  respondent is dependent  of  the  deceased<br \/>\nemployee  so  as to claim pension in terms of the  rules  to<br \/>\nwhich  we have adverted to.
