RAMKUMAR, J.\n                    .........................................\n                       B.A. No. 619 of 2011\n                    ..........................................\n            Dated this th 8th day of February, 2011.\n\n                                        ORDER\n<\/pre>\n<p>     Petitioner who is the first accused in Crime No.550 of<\/p>\n<p>2010 of Cherpulassery Police Station, Palakkad for offences<\/p>\n<p>punishable under Sections 143, 147, 148, 341, 324 and 308 r\/w<\/p>\n<p>Section 149 I.P.C., seeks anticipatory bail.<\/p>\n<p>     2.    The    learned        Public         Prosecutor       opposed   the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated       2-12-2010            of the Apex Court       in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a> (2010 (4) KLT 930),                         I am of the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer          has not had                the advantage of<\/p>\n<p>interrogating the petitioner.              But at the same time,         I am<\/p>\n<p>inclined to permit the petitioner to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p><span class=\"hidden_text\">B.A. No. 619\/2011                2<\/span><\/p>\n<p>have his application for bail considered by the Magistrate or the<\/p>\n<p>Court     having jurisdiction.   Accordingly, the petitioner shall<\/p>\n<p>surrender before the investigating officer on 21.02.2011 or on<\/p>\n<p>22.02.2011 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. In case the investigating officer<\/p>\n<p>is of the view that having regard to the facts of the case arrest<\/p>\n<p>of the petitioner is imperative he shall record his reasons for the<\/p>\n<p>arrest in the case-diary as insisted in paragraph 129            of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                   The<\/p>\n<p>petitioner shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.      In case the interrogation of the petitioner is<\/p>\n<p>without arresting him, the petitioner shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned        and apply for<\/p>\n<p>regular bail on the same day or the next day. The Magistrate or<\/p>\n<p>the Court on being satisfied that        the petitioner has been<\/p>\n<p>interrogated by the police shall, after hearing the prosecution as<\/p>\n<p>well,    consider and dispose of his application for regular<\/p>\n<p>bail preferably on the same date on which it is filed.<\/p>\n<p>      4.     In case the accused while surrendering before the<\/p>\n<p><span class=\"hidden_text\">B.A. No. 619\/2011                 3<\/span><\/p>\n<p>Investigating Officer has deprived       the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect       to the Magistrate or the<\/p>\n<p>Court concerned.
