Justice V.GIRI\n\n Dated :26\/05\/2009\n\n O R D E R\n                         V.GIRI, J.\n               ------------------------------------\n                 W.P.(C).No.13186 of 2009\n               ------------------------------------\n            Dated this the 26th day of May, 2009\n\n\n                        JUDGMENT\n<\/pre>\n<p>        Heard    Mr.P.K.Ravindran        Puzhankara,   learned<\/p>\n<p>counsel for the petitioner, Mr.Siby Mathew, learned counsel<\/p>\n<p>for the Municipality and Mr.Madhavankutty for the Housing<\/p>\n<p>Board.\n<\/p>\n<p>        2. The petitioner is aggrieved by the construction<\/p>\n<p>being made by the 4th respondent in a housing colony<\/p>\n<p>established by the Housing Board.             According to the<\/p>\n<p>petitioner, an Arabic College is being established in a<\/p>\n<p>housing colony. This should not have been permitted by<\/p>\n<p>the Housing Board or Municipality, it is contended. There<\/p>\n<p>is also a challenge to Ext.P5 permit issued by the<\/p>\n<p>Municipality.\n<\/p>\n<p>        3. The petitioner is entitled to challenge Ext.P5<\/p>\n<p>before the    Local Self-Government Department.           But,<\/p>\n<p>according to the petitioner, he came to know of Ext.P5 only<\/p>\n<p>recently and representations were also sent to the<\/p>\n<p>Municipality as evidenced by Ext.P6.<\/p>\n<p>W.P.(C).No.13186 of 2009<\/p>\n<p>                            :: 2 ::\n<\/p>\n<\/p>\n<p>         4. I am of the view that the petitioner should be<\/p>\n<p>permitted to prosecute an appeal against Ext.P5.<\/p>\n<p>         5. Accordingly, it is directed that if the petitioner<\/p>\n<p>files an appeal against Ext.P5 within one month from today<\/p>\n<p>before the tribunal, the Tribunal shall treat the same as<\/p>\n<p>one presented before the Tribunal within time and proceed<\/p>\n<p>to dispose of the same on merits, after hearing the<\/p>\n<p>Housing Board, the Municipality and the 4th respondent,<\/p>\n<p>within two months from the date of receipt of the appeal.<\/p>\n<p>It is open to the petitioner to move the Tribunal for<\/p>\n<p>appropriate interim orders as well.<\/p>\n<p>         The writ petition is disposed of as above.<\/p>\n<p>                                               Sd\/-\n<\/p>\n<p>                                           (V.GIRI)<br \/>\n                                               JUDGE<br \/>\nsk\/<br \/>\n           \/\/true copy\/\/<\/p>\n<p>                    P.S. to Judge<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sony Kurian vs Kerala State Housing Board on 26 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 13186 of 2009(P) 1.
