PUBLIC\nPROSECUTOR for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present<br \/>\napplication has been filed by the applicant for grant of regular bail<br \/>\nunder sec. 439 of the Code of Criminal Procedure after the charge<br \/>\nsheet is filed.\n<\/p>\n<p>2.\tThe applicant-accused<br \/>\nis charged with having committed offences under sections 408, 409,<br \/>\n420, 477A and 114 of IPC for which FIR, being C.R. No. I-65\/2009, has<br \/>\nbeen registered with Paliyad Police Station.\n<\/p>\n<p>3.\tLearned Sr. Counsel<br \/>\nMr. P.M. Thakkar  submitted that the applicant who is a Sarpanch has<br \/>\nbeen attributed with negligence in verification of the work and some<br \/>\nirregularities in the scheme. He submitted that considering the<br \/>\nnature of offence, he may be released as now the charge sheet has<br \/>\nbeen filed. He further submitted that other co-accused have been<br \/>\nreleased as per order passed in Criminal Misc. Application Nos.<br \/>\n10707\/2010 and 11094\/2010.\n<\/p>\n<p>4.\tLearned APP Ms. Shah<br \/>\nresisted the application. She referred to the FIR and the  order<br \/>\npassed by the Sessions Court and submitted that there is a prima<br \/>\nfacie case.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned Sr. Counsel Mr. Thakkar and learned APP Ms. Shah and<br \/>\nhaving considered the nature of offence, the manner in which the<br \/>\noffence is alleged to have been committed, the role attributed and<br \/>\nalso considering the fact that charge sheet has now been filed and<br \/>\nthe other co-accused have been released, the present application<br \/>\ndeserves to be allowed.\n<\/p>\n<p>6.\tThe application is<br \/>\naccordingly allowed.  The applicant is ordered to be released on bail<br \/>\nin connection with C.R. No. I-65\/2009 registered with  Paliyad Police<br \/>\nStation,  on his executing a personal bond of Rs. 5,000\/- (Rupees<br \/>\nFive Thousand only) with one solvent surety for the like amount to<br \/>\nthe satisfaction of the lower court and subject to the further<br \/>\nconditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the trial commences.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
