NOs. 1082 &amp; 1417 OF 2009\n             = = = = = = = = = = = = = = =\n      Dated this the 17th day of February, 2010.\n\n                       J U D G M E N T\n<\/pre>\n<p>      These appeals are preferred against the common award<\/p>\n<p>passed by the Motor Accidents Claims Tribunal, Thalassery in<\/p>\n<p>O.P.(MV)Nos.193\/03 an 194\/03.         The claimants are the<\/p>\n<p>mother and daughter who were hit by a jeep resulting in<\/p>\n<p>injuries to him.     In O.P.(MV)193\/03 the claimant was<\/p>\n<p>awarded a compensation of Rs.8,000\/- and in the other the<\/p>\n<p>claimant was awarded a sum of Rs.28,000\/- and liability was<\/p>\n<p>cast on the insurance company.       It is aggrieved by that<\/p>\n<p>decision the insurance company has come up in appeal.<\/p>\n<p>      2.   The contention of the insurance company is to the<\/p>\n<p>effect that the driver of the offending vehicle did not have a<\/p>\n<p>valid driving licence to drive a jeep and therefore there was<\/p>\n<p>breach of policy conditions and so the insurance company is<\/p>\n<p>at least entitled to get the right of reimbursement.      The<\/p>\n<p>learned Tribunal had considered this issue in paragraph 10 of<\/p>\n<p>M.A.C.A. Nos. 1082<br \/>\n&amp; 1417 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>the award. It is made clear by the Tribunal itself that R1 was<\/p>\n<p>having a driving licence to drive a motor vehicle other than a<\/p>\n<p>transport vehicle. The licence was given only to drive a light<\/p>\n<p>mother vehicle. The Tribunal took the view that since the<\/p>\n<p>insurance company had not succeeded in proving that the<\/p>\n<p>jeep involved in the accident is a transport vehicle it cannot<\/p>\n<p>sustain the plea and therefore rejected its contentions.<\/p>\n<p>     3.    At the out set I may like to state that the policy<\/p>\n<p>issued to the owner itself will reveal that it is issued to a<\/p>\n<p>passenger carrying commercial vehicle. The vehicle involved<\/p>\n<p>in the accident is KL-11\/B-7349. So the policy issued would<\/p>\n<p>reveal that the jeep had been issued with a policy covering<\/p>\n<p>passengers carried in commercial vehicle. A copy of the<\/p>\n<p>charge sheet made available also revealed that the vehicle<\/p>\n<p>involved is a taxi jeep.     Whether a passenger carrying<\/p>\n<p>commercial vehicle will come within the ambit of a transport<\/p>\n<p>vehicle can be seen from S.2(47) of the M.V.Act which<\/p>\n<p>defines the transport vehicle. A transport vehicle means a<\/p>\n<p>public service vehicle, a goods carriage, an educational<\/p>\n<p>M.A.C.A. Nos. 1082<br \/>\n&amp; 1417 OF 2009<br \/>\n<span class=\"hidden_text\">                                 -:3:-<\/span><\/p>\n<p>institution bus or a private service vehicle. Admittedly the<\/p>\n<p>jeep in this case is a commercial vehicle to carry passengers<\/p>\n<p>and therefore it has to be held that it is a transport vehicle<\/p>\n<p>as contemplated u\/s 2(47) of the M.V.Act.<\/p>\n<p>      4.    The next question is whether a vehicle can be<\/p>\n<p>driven with a light motor vehicle licence.        There was a<\/p>\n<p>previous view that as per the definition of the light motor<\/p>\n<p>vehicle if the laden weight is less than 7,500 kgs. it would be<\/p>\n<p>only a light motor vehicle and therefore it is sufficient to<\/p>\n<p>drive.   But subsequently the Hon&#8217;ble Supreme Court has<\/p>\n<p>made it clear relying upon S.3 and 10 of the M.V.Act. U\/s 10<\/p>\n<p>of the M.V.Act the word transport vehicle is substituted and<\/p>\n<p>S.3 makes it clear that,<\/p>\n<p>            &#8220;No person shall drive a motor vehicle in<\/p>\n<p>            any public place unless he holds an<\/p>\n<p>            effective driving licence issued to him<\/p>\n<p>            authorizing him to drive the vehicle; and no<\/p>\n<p>            person shall so drive any transport vehicle<\/p>\n<p>            unless   his  driving    licence specifically<\/p>\n<p>            entitles him so to do.&#8221;\n<\/p>\n<p>M.A.C.A. Nos. 1082<br \/>\n&amp; 1417 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>      5.    So there must be a specific entitlement to drive<\/p>\n<p>and that specific entitlement is normally called as a badge.<\/p>\n<p>So as seen in this case from the materials available it can be<\/p>\n<p>held that the vehicle involved in the accident is a public<\/p>\n<p>service vehicle which comes under the definition of transport<\/p>\n<p>vehicle and that the driver did not have an effective valid<\/p>\n<p>driving licence to drive such a vehicle. When it is so there is<\/p>\n<p>breach of policy conditions and therefore the insurance<\/p>\n<p>company is entitled to get right of reimbursement. Therefore<\/p>\n<p>the appeals are allowed and the finding of the Tribunal<\/p>\n<p>making the insurance company totally liable is set aside and<\/p>\n<p>it is held that the insurance company is directed to pay the<\/p>\n<p>amount to the third party and recover that amount from the<\/p>\n<p>owner of the vehicle by execution of the very same award.<\/p>\n<p>                            M.N.
