DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\nmatter was listed yesterday and was ordered to be kept today on the<br \/>\nrequest made by learned for the respondent &#8211;  corporation that<br \/>\nlearned Senior Counsel appears in this matter.\n<\/p>\n<p>\tToday,<br \/>\nwhen the matter is called out, similar request is made to adjourn the<br \/>\ncase and such request is rejected.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase, it appears that in Special Civil Application No.9562 of 2001<br \/>\nlearned advocate appearing for the respondent &#8211; corporation<br \/>\nstated on instructions that, upon scrutiny of the case of the<br \/>\npetitioner, it was found to be genuine and it was resulted that the<br \/>\npetitioner should be and shall be granted benefits to which he is<br \/>\nentitled, including regularization in service with retrospective<br \/>\neffect and all consequential benefits in accordance with rules of the<br \/>\nrespondent, later on.  However, the corporation has taken a different<br \/>\nstand and the petitioner, who has put about 24 years of service, is<br \/>\nwithout any promotion though the vacancies on the post are available.\n<\/p>\n<p>\tIn<br \/>\nview of the above, Rule returnable on 19th<br \/>\nOctober, 2011.\n<\/p>\n<p>\tIn<br \/>\nthe meanwhile, the respondent authorities are directed not to<br \/>\nterminate the services of the petitioner.\n<\/p>\n<p>[Anant<br \/>\nS.
