Justice ANTONY DOMINIC\n\n Dated :29\/11\/2010\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                      -------------------------------\n                    W.P.(C).No.35578 of 2010\n                      -------------------------------\n            Dated this the 29thday of November, 2010.\n\n                          J U D G M E N T\n<\/pre>\n<p>     Petitioners say that they are now attending 3rd year<\/p>\n<p>B.Sc.Nursing classes in Mar Sleeva College of Nursing affiliated<\/p>\n<p>to the 1st respondent University. Going by the pleadings, it is seen<\/p>\n<p>that in the first year, they failed in few subjects and in the<\/p>\n<p>supplementary examination also they were unsuccessful. They<\/p>\n<p>applied for revaluation and results are awaited. The second year<\/p>\n<p>examinations are scheduled to commence on 13.12.2010. For<\/p>\n<p>the reason that they have not passed all the subjects of the first<\/p>\n<p>year, the University authorities are not accepting the examination<\/p>\n<p>fee and has not issued the hall tickets. It is under the above<\/p>\n<p>circumstances, this writ petition has been filed.<\/p>\n<p>     2. As per the revised syllabus of the University (clause 11<\/p>\n<p>of Ext.P1), unless the petitioners have passed all the subjects of<\/p>\n<p>the first year, they can not appear for the second year<\/p>\n<p>examination.    Therefore at present, as the petitioners do not<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><br \/>\nW.P.(C).No.35578 of 2010<\/p>\n<p>satisfy the conditions of the Regulations for appearing in the<\/p>\n<p>examination. Therefore, this court will not be justified in issuing<\/p>\n<p>any direction to the University, to permit the petitioners to appear<\/p>\n<p>for the examination.\n<\/p>\n<p>        3.
