WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal  by special  leave arises from the judgment<br \/>\nof the Division Bench of the High court of Punjab &amp; Haryana,<br \/>\nmade on 31.5.1996 in CWP No. 19006\/65.\n<\/p>\n<p>     The  admitted   position  is  that\t the  appellant\t was<br \/>\nappointed as  a constable  initially on 19.11.1981 in Hissar<br \/>\nrange. She  secured rank  No.2 out  of 218  candidates as an<br \/>\nall rounder,  while Asha  Rani, respondent No.6, had secured<br \/>\nrank No.85  in the same range. When &#8216;C&#8217; list was prepared in<br \/>\nSeptember  1985,   both\t of   them  were  promoted  as\tHead<br \/>\nConstables on\tOctober\t 3, 1985  and the  confirmation also<br \/>\ncame to\t be made  on January  31, 1988.\t In an\tIntermediate<br \/>\nschool Course  conducted by  the authorities,  the appellant<br \/>\nwas depute  in\tSeptember  1989\t while\t6th  respondent\t was<br \/>\ndeputed in March 1990. The appellant was brought in &#8216;D&#8217; List<br \/>\non April  4, 1990.  The appellant  was promoted as Assistant<br \/>\nsub-Inspector on  November 16, 1989 while 6th respondent was<br \/>\nconfirmed as  ASI on July 31, 1992 but was not confirmed for<br \/>\nno reason  whatsoever. But  when she  was  in  Upper  school<br \/>\nCourse in  April 1991, she become all rounded No.1 while 6th<br \/>\nrespondent was\tsent for  the said  course and\ttraining  in<br \/>\nApril 1993.  The appellant  was promoted as sub-Inspector on<br \/>\nMay 29, 1991 from P.T.C while 6th respondent was promoted on<br \/>\nAugust 5, 1992. Thus it could be seen that the appellant has<br \/>\nbeen stealing  a march over respondent No.6 right from March<br \/>\n1989 and  she distinguished  herself in\t the posts  held  in<br \/>\nseveral Places much earlier to respondent No.6.\n<\/p>\n<p>     It would  appear that on a requested by 6th respondent,<br \/>\nshe was\t transferred to\t Rohtak range  while  the  appellant<br \/>\nremained in  Hissar Range and was deputed, being a competent<br \/>\nofficer, to  train the trainees in the Training School. When<br \/>\ndeputation period was over, she was sought to be reverted to<br \/>\nthe  rank   of\tAssistant   Sub-Inspector.  The\t action\t was<br \/>\nobviously illegal  and arbitrary. It would, now, appear that<br \/>\nafter deputation  period was  over, she\t was transferred  to<br \/>\nRohtak range  and appointed  as\t S.H.O\tin  Police  Station,<br \/>\nSonipat, Sixth respondent also has been continuing in Rohtak<br \/>\nRange. Thus,  belatedly, the  Mischief is  averted  and\t her<br \/>\nposition is restored.\n<\/p>\n<p>     Under these  Circumstances,  the  respondent  state  is<br \/>\ndirected to  continue  to  maintain  the  seniority  of\t the<br \/>\nappellant over\tthe 6th\t respondent in\tthe respective posts<br \/>\nthough initially  they were  Temporary, Since  she had given<br \/>\nbetter performance as all rounder.\n<\/p>\n<p>     The appeal is accordingly allowed, No costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Luxmi Devi vs The State Of Haryana &amp; Ors on 31 March, 1997 Bench: K.
