He filed<\/p>\n<p> WP(C)No.8003 of 2009, being aggrieved by the<\/p>\n<p> refusal on the part of the Secretary, RTA in not<\/p>\n<p> transferring the permit to the petitioner covered<\/p>\n<p> by  vehicle   KL-8V\/5617   running  in  the   route<\/p>\n<p> Mattichoor-Thrissur.  According to the Secretary,<\/p>\n<p> another vehicle KL-09K\/9463, which was running in<\/p>\n<p> the route, had committed default in welfare fund<\/p>\n<p> dues to the second respondent and hence, unless<\/p>\n<p> the dues are cleared, transfer of permit cannot<\/p>\n<p> be allowed.   The learned single Judge held that,<\/p>\n<p> as the welfare fund is a charge on the vehicle,<\/p>\n<p> the    respondents   are    entitled   to    refuse<\/p>\n<p> endorsement.\n<\/p>\n<p> WA694\/09<\/p>\n<p><span class=\"hidden_text\">                        -:2:-<\/span><\/p>\n<p>2.The appellant contends that, when the welfare<\/p>\n<p> fund    dues are in arrears, true, by virtue of an<\/p>\n<p> amendment, there is a charge on the vehicle.<\/p>\n<p> But, here, the vehicle in question KL-09k\/9463 is<\/p>\n<p> the vehicle in respect of which dues are in<\/p>\n<p> arrears.    What is sought to be transferred is<\/p>\n<p> only the permit and now he is running with a new<\/p>\n<p> vehicle, KL-8V\/5617.     In so far as the vehicle<\/p>\n<p> to be run in the route, with the permit granted<\/p>\n<p> to     KL-09K\/9463, is concerned, the fact that<\/p>\n<p> there is any arrears in respect of the vehicle<\/p>\n<p> KL-09K\/9463,   cannot   be   a ground  to   refuse<\/p>\n<p> transfer of permit.    But it is fairly submitted<\/p>\n<p> by the appellant that the vehicle KL-09K\/9463 is<\/p>\n<p> now in garage.   Therefore, even if we direct that<\/p>\n<p> the vehicle KL-09K\/9463 over which there is a<\/p>\n<p> charge in respect of the welfare fund dues, it<\/p>\n<p> cannot be disputed that the said vehicle cannot<\/p>\n<p> be proceeded for realisation of the dues.      In<\/p>\n<p> such circumstances, the learned counsel offers to<\/p>\n<p> WA694\/09<\/p>\n<p><span class=\"hidden_text\">                        -:3:-<\/span><\/p>\n<p> furnish   bank   guarantee   for   an  amount   of<\/p>\n<p> Rs.21,000\/-, which is alleged to be the arrears<\/p>\n<p> of the vehicle KL-09K\/9463.     According to him,<\/p>\n<p> even though there may be a charge on the vehicle,<\/p>\n<p> KL-09K\/9463, the primary liability is always on<\/p>\n<p> the employer, namely erstwhile registered owner<\/p>\n<p> of the vehicle KL-09K\/9463, since, the dues now<\/p>\n<p> in arrears is prior to the transfer.<\/p>\n<p>3.We heard the learned Government Pleader.  We find<\/p>\n<p> force in the contention.    Hence, we direct that,<\/p>\n<p> the Secretary, RTA, shall accord permission for<\/p>\n<p> the transfer of the permit and replacement of the<\/p>\n<p> vehicle with a new one.      The petitioner shall<\/p>\n<p> furnish a bank guarantee for Rs.21,000\/- valid<\/p>\n<p> for one year.   The second respondent may proceed<\/p>\n<p> to recover the dues in arrears, if any, in<\/p>\n<p> respect of the vehicle KL-09K\/9463 by proceeding<\/p>\n<p> against the erstwhile registered owner, namely<\/p>\n<p> the third respondent.       However, in case the<\/p>\n<p> WA694\/09<\/p>\n<p><span class=\"hidden_text\">                       -:4:-<\/span><\/p>\n<p> amount could not be realised, they can invoke the<\/p>\n<p> bank guarantee after nine months.
