Petitioners are whipping up a dead horse and<br \/>\nare wanting their pre-absorption service to be counted<br \/>\ntowards their seniority with consequential benefits.<br \/>\nTheir cause is age-old and has been declared so even by<br \/>\nthe Supreme Court decades back but they still want to<br \/>\nreopen it by catching at straws.\n<\/p>\n<p> 2. Petitioners were originally appointed as LDCs<br \/>\nor in equivalent grades in the lower formations of the<br \/>\nArmy between 1941-1948 and were later absorbed in the<br \/>\nArmed Forces Headquarters &#8220;AFHQ&#8221; from 1951-1958 after<br \/>\nbeing declared surplus. When they had joined service,<br \/>\none Govt. Memo of 1949 provides for determination of<br \/>\nseniority on the basis of length of service. But<br \/>\nsubsequently OMs dated 12-8-59 and 21-12-63 were issued<br \/>\nproviding for counting of their service in LDC grade<br \/>\nfrom the date of their appointment in the &#8220;AFHQ&#8221; for<br \/>\npurposes of their seniority. They filed CWP Nos. 192 &amp;<br \/>\n941\/72 against this which were dismissed by order dated<br \/>\n22-4-76 on grounds of delay and latches. While doing so<br \/>\nthe Court observed:-\n<\/p>\n<p>  &#8220;Both 1959 and 1963 Memorandum could not be<br \/>\nsaid to conform to the model provided by 1949 M.O.<br \/>\nand to the extent of inconsistency they are<br \/>\ninvalid.\n<\/p>\n<p> It also said:-\n<\/p>\n<p>  &#8220;This is therefore a strong case for an<br \/>\nexecutive review at an appropriate level within a<br \/>\nreasonable time&#8230;..&#8221;\n<\/p>\n<p> 3. Petitioner made representations on the<br \/>\nstrength of this which were considered and decision<br \/>\ncommunicated to them on 1-2-1980. Petitioners filed CWP<br \/>\nNo. 5942\/80 against this before the Supreme Court which<br \/>\nwas also dismissed by order dated 27-8-1987 observing<br \/>\nthat the matters in dispute were stale.\n<\/p>\n<p> 4. While all this was going on, the &#8220;AFHQ&#8221;<br \/>\nclerical rules of 1968 were challenged by some employees<br \/>\nin CWP No. 423\/75 claiming that seniority in the grade<br \/>\nof LDCs should be determined on the basis of length of<br \/>\nservice and not on the date of confirmation. This<br \/>\npetition was allowed by judgment dated 8-4-81 and was<br \/>\neventually affirmed by the Supreme Court in C.A. No.<br \/>\n4133\/84 (D.P. Sharma v. UOI), benefit in whereof was also<br \/>\nextended later to writ petitioner in CWP No. 493\/90<br \/>\n(R.K. Khosla v. UOI). In compliance to all this, a<br \/>\nseniority list dated 20-4-92 was issued under O.M.<br \/>\ndated 21-12-63 and promotions to the grade of UDC,<br \/>\nAsstt. and ACSO were reviewed on the basis of that.\n<\/p>\n<p> 5. Petitioners found a fresh cause in this and<br \/>\nfiled OA No. 1782\/92 which was dismissed and so was the<br \/>\nreview taken against it. Hence this petition<br \/>\nrepresenting petitioners last-ditch effort to revive the<br \/>\notherwise dead issue.\n<\/p>\n<p> 6. While dismissing petitioners&#8217; OA, Tribunal<br \/>\nnoted:-\n<\/p>\n<p>  &#8220;Applicants seek to support this claim on<br \/>\nthe basis of the Delhi High Court&#8217;s Single Bench<br \/>\njudgment dated 8.4.81 in CWP No. 423\/75 and<br \/>\nconnected cases, which was eventually upheld by<br \/>\nthe Hon&#8217;ble Supreme Court in D.P. Sharma&#8217;s case<br \/>\n(Supra), which was later extended in R.K. Khosla&#8217;s<br \/>\ncase (Supra) and still later in H.L. Gauba&#8217;s case<br \/>\n(Supra), on the basis of which respondents<br \/>\npublished the final seniority list of LDCs in AFHQ<br \/>\non 20-4-92 but it must be remembered that in CWP<br \/>\nNo. 423\/75 the issue before the Delhi High Court<br \/>\nSingle Bench was not whether LDCs who joined AFHQ<br \/>\nfrom lower formations in defense Ministry were to<br \/>\nbe allowed to count their services outside AFHQ<br \/>\nfor the purpose of seniority as LDCs in AFHQ or<br \/>\nnot, but whether their seniority as LDCs in AFHQ<br \/>\nwould count from the date of their joining AFHQ<br \/>\n(the principle of length of service) or from the<br \/>\ndate of confirmation upon their passing the UPSC<br \/>\ntyping test. It is the principle of length of<br \/>\nservice (i.e. from the date of joining AFHQ)<br \/>\nwhich was upheld by the Delhi High Court Single<br \/>\nBench in CWP No. 427\/75 and was subsequently<br \/>\nupheld in D.P. Sharma&#8217;s case (Supra) and later<br \/>\nextended in R.K. Khosla&#8217;s case (Supra) and<br \/>\nH.L. Gauba&#8217;s case, on the basis of which<br \/>\nRespondents have issued their final seniority list<br \/>\nof LDCs in AFHQ on 20.4.92.\n<\/p>\n<p> 7. This should have answered petitioners&#8217;<br \/>\ngrievance squarely, but their counsel, Mr. Garg has taken<br \/>\na new route and is seeking enforcement of the<br \/>\nobservation of this court in judgment dated 22.4.76<br \/>\nwhereby petitioners&#8217; CWPs 192 and 941\/72 were dismissed<br \/>\nthough observing that MO of 1962 was invalid for<br \/>\ninconsistency with Memorandum of 1949. He submits that<br \/>\nonce it was declared invalid, it could not have been<br \/>\nacted upon again in drawing up the seniority list dated<br \/>\n20-4-92. The submission appears attractive on the face<br \/>\nof it but fails on scrutiny because petitioners overlook<br \/>\nthat their writ petitions were dismissed and any<br \/>\nobservation made in these by the Court was not<br \/>\nenforceable. Their cause stands sealed by the dismissal<br \/>\nof their petition on the subject matters by the Supreme<br \/>\nCourt also. They should, therefore, reconcile to the<br \/>\nsettled position and give up their chase for good.\n<\/p>\n<p> Petition is dismissed with this.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delhi High Court Sh.
