Justice K.HEMA\n\n Dated :17\/10\/2008\n\n O R D E R\n                            K.HEMA, J.\n                   ------------------------------\n                      B.A. No.4442 OF 2008\n                   ------------------------------\n             Dated this the 17th day of October, 2008\n\n\n                             O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.\n<\/p>\n<p>     2. The alleged offences are under Sections 498(A) and 34 of<\/p>\n<p>I.P.C. According to prosecution, the first accused married the<\/p>\n<p>defacto complainant in the year 2004 and 40 sovereigns of gold<\/p>\n<p>were given to the defacto complainant and those were sold by<\/p>\n<p>the first accused. Rs.1,15,000\/- was also given to the first<\/p>\n<p>accused by the defacto complainant&#8217;s father for arranging a visa<\/p>\n<p>to go to gulf. He left for gulf in 2005. In the meantime, the first<\/p>\n<p>accused and the second accused were harassing the defacto<\/p>\n<p>complainant by demanding more dowry and more money.<\/p>\n<p>     3. Even after coming back from gulf 26.01.2008 the first<\/p>\n<p>accused made a demand for Rs.5 Lakhs from the defacto<\/p>\n<p>complainant and she was ousted from the marital house. The<\/p>\n<p>second accused is the brother of the first accused. It is also<\/p>\n<p>alleged that defacto complainant&#8217;s parents were prepared to give<\/p>\n<p>an extent of 10 cents of property in the name of the defacto<\/p>\n<p>B.A.4442 of 2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>complainant but the first accused was not willing to accept the<\/p>\n<p>same but he demanded more money and harassed her.<\/p>\n<p>      4. Learned counsel for the petitioners submitted that the<\/p>\n<p>allegations made against him are not correct. The first accused<\/p>\n<p>filed a petition for restitution of conjugal rights and there is a<\/p>\n<p>child in the wedlock and that after he came back from gulf in<\/p>\n<p>January 2008 they lived together, but some difference of opinion<\/p>\n<p>developed, since she insisted that he should stay in her house. It<\/p>\n<p>is also submitted that the case was referred to the Lok Adalath<\/p>\n<p>for settling the marital dispute between the parties but the<\/p>\n<p>defacto complainant was continuously absent and hence the<\/p>\n<p>matter could not be settled. In such circumstances, anticipatory<\/p>\n<p>bail may be granted, it is submitted.\n<\/p>\n<p>      5. Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting anticipatory to the second accused on<\/p>\n<p>conditions. But there are serious allegations against the first<\/p>\n<p>accused. On considering the nature of allegations made,<\/p>\n<p>anticipatory bail may not be granted to him. The Lok Adalath<\/p>\n<p>returned the file to this court, since the defacto complainant sent<\/p>\n<p>B.A.4442 of 2008<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>a letter stating her difficulty to appear before the Lok Adalath,<\/p>\n<p>since her father had an accident and he is unable to travel. It is<\/p>\n<p>also stated in the letter that no amount was paid by first accused<\/p>\n<p>towards maintenance and hence she is not able to come to the<\/p>\n<p>Lok Adalath. It also admitted that a petition for maintenance is<\/p>\n<p>pending before the court.\n<\/p>\n<p>      On hearing both sides to protect the interest of parties, I<\/p>\n<p>find that anticipatory bail can be granted on conditions.<\/p>\n<p>      Hence, the following order is passed :\n<\/p>\n<blockquote><p>          The   petitioners   shall   surrender    before   the<\/p>\n<p>          Investigating Officer within 15 days from today and<\/p>\n<p>          co-operate with the investigation and in the event<\/p>\n<p>          of their arrest, they shall be released on bail on<\/p>\n<p>          their executing bond for Rs.25,000\/- each with two<\/p>\n<p>          solvent   sureties  each    for  like  sum    to  the<\/p>\n<p>          satisfaction of the Arresting Officer on the following<\/p>\n<p>          conditions :\n<\/p><\/blockquote>\n<blockquote><p>          i. The first accused shall produce an F.D.<\/p><\/blockquote>\n<p>              Receipt for Rs.1 Lakh in the name of the<\/p>\n<p>B.A.4442 of 2008<br \/>\n<span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>               defacto complainant and the child within 15<\/p>\n<p>               days   from    today.    This   condition is<\/p>\n<p>               applicable only to the first accused.\n<\/p>\n<p>          ii. The petitioners shall not influence or<\/p>\n<p>               intimidate any witness or commit any<\/p>\n<p>               offence while on bail.\n<\/p>\n<p>          iii. The petitioners shall report before the<\/p>\n<p>               Investigating Officer as and when directed<\/p>\n<p>               and co-operate with the investigation.\n<\/p>\n<p>      After dictating the order, learned counsel for the<\/p>\n<p>petitioners submitted that he has objection in depositing the<\/p>\n<p>amount of Rs.1Lakh and that this objection may be recorded. It<\/p>\n<p>is recorded. But, it is made clear that if the first accused fails to<\/p>\n<p>deposit the amount as per the condition imposed, then the order<\/p>\n<p>will not be come into effect, as far as the first petitioner is<\/p>\n<p>concerned. Section 438 Cr.P.C. allows the court to make any<\/p>\n<p>condition as it deem fit and proper, in the circumstances.<\/p>\n<p>Though the facts are not persuasive to grant anticipatory bail, it<\/p>\n<p>is granted only since this court finds that the interest of the<\/p>\n<p>B.A.4442 of 2008<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>victim can be protected by imposing condition and allowing this<\/p>\n<p>petition.
