The<br \/>\ncertificate of practicing of the petitioner was renewed upto<br \/>\n14.02.2002.  Thereafter on 03.08.2002, the petitioner applied for<br \/>\nrenewal with the requisite fee.  The renewal certificate was not<br \/>\nreturned to the petitioner.  The petitioner therefore sent a request<br \/>\nletter and the application for renewal was again made on 31.01.2005.<br \/>\nHowever, the original certificate of Notary is not returned to the<br \/>\npetitioner.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Shah, learned advocate appearing for the petitioner has submitted<br \/>\nthat the period of certificate was over on 14.02.2002.  The<br \/>\npetitioner was under the belief that the certificate of practice is<br \/>\nvalid upto 14.02.2003 but when it came to the notice of the<br \/>\npetitioner on 03.08.2002 he immediately applied for renewal of<br \/>\ncertificate of practice along with necessary renewal fee.\n<\/p>\n<p>3.1\tHe<br \/>\nhas submitted that the said action of the respondent is in breach of<br \/>\nthe section 5(2) of the Notary Act when the petitioner is entitled to<br \/>\nhave a certificate of practice renewed for the period of three years<br \/>\non each occasion.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>J.K. Shah, learned AGP has supported the action of the respondent<br \/>\nauthority and submitted that there was a delay of six months in<br \/>\nrenewing the certificate and therefore this court may not interfere<br \/>\nin the present matter.  He has also relied upon a decision of this<br \/>\ncourt passed in Special Civil Application No. 1713 of 2003 which has<br \/>\nbeen rejected  on similar grounds.\n<\/p>\n<p>5.\tThis<br \/>\ncourt has heard learned advocates for the respective parties and<br \/>\nperused the papers on record more particularly the affidavit in reply<br \/>\nfiled by the respondent authorities wherein it is mentioned that<br \/>\nthough the time limit of the certificate to practice as notary had<br \/>\nexpired on 14.02.2002 the petitioner did not apply for renewal upto<br \/>\n16.09.2002.  There was a delay of six months and no genuine reasons<br \/>\nhave been given by the present petitioners for delay and hence this<br \/>\ncertificate  is not renewed by the authority under section 10(F) of<br \/>\nthe Notary Act, 1952.  Even on earlier occasion the petitioner had<br \/>\nremained careless in getting his certificate renewed within the time<br \/>\nlimit.  The petitioner even without getting his certificate of<br \/>\npractice as notary renewed has continued unauthorisedly to practice<br \/>\nas notary which is an offence under the Notary Act.\n<\/p>\n<p>5.1\tEven<br \/>\notherwise, eight years have passed after the expiry of the<br \/>\ncertificate.  This court in Special Civil Application No. 1713 of<br \/>\n2003 has rejected the petition filed on similar grounds and the same<br \/>\nshall be applicable on the facts of the present case.  This court is<br \/>\nin complete agreement with the decision of the respondent authority<br \/>\nand do not see any reason for causing interference.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, this petition is dismissed.
