2. The essential facts leading to this appeal are<\/p>\n
that on 2s.os.2oo7 at about 7.00 pm, NarayanV:A’rl\u00a7’as’ali,<\/p>\n
husband of first respondent and the father”-of .-eepoadentll
\nNos.2 to S was walking on the sldelfof  road;”heV:Vwa’s hit  if
\nby a Tata Indica Car bearing<\/p>\n

admitted to the hospital. Afte’r’is.efrei1..daysA,’he died due to
\nthe injuries suffered  the  The cause of<\/p>\n

injuries, _r:.ol?’evreg_e*.of”.insu_ran.L:e of the vehicle involved in
\nthe accident, lfieibiliaty oi”‘–t_he”appelIant — insurance company
\nherein are ncitin’ dispute.\n<\/p>\n

 .V_ch_aiiAe’e<\u00a7l_nVg  the quantum of compensation awarded by<\/p>\n
the Tr.i_buaAe'll. It is the case of the appellant — insurer that<\/p>\n
 the deceased whe was aged 48 years at the time of death

\nevidence  .’.:,clei.f;’11″a’nts to show that the
\ndeceaeed”x\u00a3les  goidsmith in addition to
\natterid\u00e9hlg to  activity and the aepellant -~<\/p>\n
insuifer elseV_Vchel”E-enge\u00e9'”awarding the amount in a sum of<\/p>\n
  tolilvertisv loss of estate, in addition to, loss of<\/p>\n
i  calculated on notional earning of the<\/p>\n
dejeeased awarded compensation under the said head.<\/p>\n
5. Heard the learned Counsel for both the parties.<\/p>\n

6. The point that arises for consideration in this
\nappeal is “whether the Court below in the absence _._of proof<\/p>\n
and evidence adduced by the claimant was  in<\/p>\n
holding that the deceased was doing agricLfiiVtu’ral’.\u00a5.?vork~’–uas.\u00e9<\/p>\n
well as the work of goldsmithssand  .<\/p>\n
Rs.6,000\/- per month?”   ‘ <\/p>\n
7. It is seen thVat.4__except”the sqizniainie <\/p>\n
deceased as ‘Akkasaii’ which’is_V’attached.to his name, there
\nis nothing on record;::iio..sho’\u00a7vt.he.deceased was doing<\/p>\n
go\u00a5dsmi_tnA ‘4Tlfhe__\\oviiJence of the PW–1 who is none
\nother ‘thanli\ufb01rst.  widow of the deceased who is<\/p>\n
asiriterested__V’VWitness” regarding the evocation of the<\/p>\n
  ‘as goldsrnith cannot be reiied upon. Except the<\/p>\n

of the family. However, there is loss toth\u00e9j”f\u00a7nai:lyn_insot”a,rl <\/p>\n
as supervision of the agrictiittiralb_:A\u00e9(;tE\u00a7.’lt)?”_its:’C<;r!}C\u00e9[i}ed_ 2<\/p>\n
Hence, the said loss vC'0.i_Jid 'i:e"'i-rightist.Aassessedi Vat'<\/p>\n
Rs.3,0\u20ac)0\/- per month. Them, the~.,\u00a2As;\ufb01ipe'ii;aVtion that
\nthe claimants areentitledW_Li:ideit:'the head of toss of
\ndependency is 2,500  <\/p>\n

\nimmediately,  the deceased was admitted<\/p>\n
