Justice M.SASIDHARAN NAMBIAR\n\n Dated :01\/07\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.R.P.No.121 of 2003\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner, the accused in C.C.No.128\/1998 on<\/p>\n<p>the file of Additional Chief Judicial Magistrate&#8217;s<\/p>\n<p>Court (Economic Offences), Ernakulam, was convicted<\/p>\n<p>and sentenced to rigorous imprisonment for two<\/p>\n<p>months and a compensation of Rs.5,000\/- and in<\/p>\n<p>default, simple imprisonment for two months for the<\/p>\n<p>offence under Section 138 of Negotiable Instruments<\/p>\n<p>Act.   First   respondent   is   the   complainant.<\/p>\n<p>Petitioner challenged the conviction and sentence<\/p>\n<p>before  Sessions  Court,  Ernakulam  in   Crl.A.No.<\/p>\n<p>254\/2000. Learned Additional Sessions Judge, on re-<\/p>\n<p>appreciation of evidence, confirmed the conviction,<\/p>\n<p>but, modified the sentence to simple imprisonment<\/p>\n<p>from rigorous imprisonment. It is challenged in the<\/p>\n<p>revision.\n<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and first respondent were heard.\n<\/p>\n<p><span class=\"hidden_text\">CRRP 121\/03               2<\/span><\/p>\n<p>     3. Exhibit P1, the dishonoured cheque, is for<\/p>\n<p>Rs.17,802.70 and was issued on 30.11.1994. The fact<\/p>\n<p>that    the  cheque  was dishonoured  for want   of<\/p>\n<p>sufficient funds and first respondent had complied<\/p>\n<p>with all statutory formalities are not disputed.<\/p>\n<p>Learned    counsel  appearing for   the  petitioner<\/p>\n<p>submitted that subsequent to the filing of the<\/p>\n<p>complaint, petitioner paid Rs.8,000\/- to the first<\/p>\n<p>respondent and that fact was admitted by PW1 before<\/p>\n<p>the trial court and it is recorded by the learned<\/p>\n<p>Magistrate in paragraph 10 of the judgment. It is<\/p>\n<p>also submitted that as directed by this Court, for<\/p>\n<p>getting    suspension of  the sentence,  petitioner<\/p>\n<p>deposited half of the cheque amount before the<\/p>\n<p>trial court and by depositing half of the cheque<\/p>\n<p>amount and paying Rs.8,000\/-, as admitted by PW1,<\/p>\n<p>petitioner has already paid Rs.16,900\/- and only<\/p>\n<p>less    than  Rs.1,000\/- remains  to  be paid   and<\/p>\n<p>therefore, interest of justice will be met if the<\/p>\n<p>sentence is modified.\n<\/p>\n<p><span class=\"hidden_text\">CRRP 121\/03               3<\/span><\/p>\n<p>     4. Learned counsel appearing for the first<\/p>\n<p>respondent submitted that though first respondent<\/p>\n<p>has received Rs.8,000\/-, as admitted by PW1, he has<\/p>\n<p>no information about the deposit before the trial<\/p>\n<p>court    and the  sentence  could  be  modified   in<\/p>\n<p>accordance with law.\n<\/p>\n<p>     5. On going through the judgments of the courts<\/p>\n<p>below, I find no reason to interfere with the<\/p>\n<p>conviction for the offence under Section 138 of<\/p>\n<p>Negotiable Instruments Act. But, considering the<\/p>\n<p>fact that petitioner has paid Rs.8,000\/- out of<\/p>\n<p>Rs.17,802.70, due under the dishonoured cheque,<\/p>\n<p>interest of justice will be met if the sentence is<\/p>\n<p>modified to imprisonment rill rising of court and a<\/p>\n<p>compensation of Rs.12,000\/- to be paid to the first<\/p>\n<p>respondent and in default simple imprisonment for<\/p>\n<p>one month.\n<\/p>\n<p>     Revision is allowed in part. Conviction of the<\/p>\n<p>petitioner for the offence under Section 138 of<\/p>\n<p>Negotiable   Instruments  Act   is  confirmed.   The<\/p>\n<p><span class=\"hidden_text\">CRRP 121\/03               4<\/span><\/p>\n<p>sentence is modified to imprisonment till rising of<\/p>\n<p>court and a compensation of Rs.12,000\/- to be paid<\/p>\n<p>to the first respondent and in default simple<\/p>\n<p>imprisonment   for  one  month.  If  petitioner   has<\/p>\n<p>deposited   any   amount before  the  Magistrate   as<\/p>\n<p>directed by this Court to suspend the sentence, he<\/p>\n<p>need deposit only the balance amount. Petitioner is<\/p>\n<p>also permitted to pay the balance amount directly<\/p>\n<p>to the first respondent and produce the receipt and<\/p>\n<p>satisfy the Magistrate that compensation has been<\/p>\n<p>paid.    Petitioner  is directed  to  appear   before<\/p>\n<p>Additional    Chief  Judicial  Magistrate   (Economic<\/p>\n<p>Offences), Ernakulam on 10.08.2010.
