{"id":210129,"date":"2011-03-07T00:00:00","date_gmt":"2011-03-06T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/om-prakash-vs-the-state-of-bihar-amp-ors-on-7-march-2011"},"modified":"2017-08-21T17:45:46","modified_gmt":"2017-08-21T12:15:46","slug":"om-prakash-vs-the-state-of-bihar-amp-ors-on-7-march-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/om-prakash-vs-the-state-of-bihar-amp-ors-on-7-march-2011","title":{"rendered":"Om Prakash vs The State Of Bihar &amp;Amp; Ors on 7 March, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Om Prakash vs The State Of Bihar &amp;Amp; Ors on 7 March, 2011<\/div>\n<pre>             IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        CWJC No.3806 of 2011\n                           OM PRAKASH .\n                               Versus\n                     THE STATE OF BIHAR &amp; ORS .\n                              -----------\n<\/pre>\n<p>02.   07.03.2011             Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                             The petitioner is an elected Mukhiya of<\/p>\n<p>                   Gram Panchayat- Bhalua, Block-Belaganj, District-<\/p>\n<p>                   Gaya, aggrieved by the order dated 11.2.2011 passed<\/p>\n<p>                   under Section 18 (5) of the Panchayat Raj Act<\/p>\n<p>                   (hereinafter referred to as the Act) by the Principal<\/p>\n<p>                   Secretary, unseating him from that post.<\/p>\n<p>                             Learned counsel submits that the petitioner<\/p>\n<p>                   is alleged to have installed a Handpump himself<\/p>\n<p>                   without appointing a contractor. He was elected on<\/p>\n<p>                   30.6.2006. Considering the hot season, on a public<\/p>\n<p>                   request he installed the Handpump on 18.6.2006. The<\/p>\n<p>                   allegations are only of procedural irregularity.<\/p>\n<p>                             Learned counsel for the State points out that<\/p>\n<p>                   the act of the Mukhiya was procedurally improper. He<\/p>\n<p>                   should not have become the contractor himself. There<\/p>\n<p>                   were procedures for installing a Handpump.<\/p>\n<p>                             There may have been procedures, from<\/p>\n<p>                   which the Mukhiya deviated. Every deviation may not<\/p>\n<p>                   constitute illegality. In his over enthusiasm, as a newly<\/p>\n<p>                   elected people representative he may have gone a little<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>overboard. His defence of the prevailing hot season<\/p>\n<p>cannot be ignored. His enthusiasm to work for his<\/p>\n<p>electorate cannot be ignored. There is no finding that<\/p>\n<p>the Handpump was never installed, that it was<\/p>\n<p>installed at a wrong place or at excessive cost. There is<\/p>\n<p>no   finding   of       any   financial   embezzlement    or<\/p>\n<p>misappropriation.\n<\/p>\n<p>          This Court has come across more than one<\/p>\n<p>order where Benches of this Court have invited the<\/p>\n<p>attention of the Principal Secretary, Panchayati Raj to<\/p>\n<p>the nature of his power under Section 18 (5) of the Act<\/p>\n<p>in   dealing   with      elected   persons.   These   orders<\/p>\n<p>adequately discuss and refer to the judgments of the<\/p>\n<p>Supreme Court in A.I.R. (2001) SC 2524 (Tarlochan<\/p>\n<p>Dev Sharma Versus State of Punjab) and A.I.R. (2010)<\/p>\n<p>2 SCC 319 (Sharda kailash Mittal versus State of M.P.)<\/p>\n<p>requiring him to exercise his statutory powers in<\/p>\n<p>accordance with the directions and observations made<\/p>\n<p>by the Supreme Court. Notwithstanding the same, it is<\/p>\n<p>unfortunate that without considering and discussing<\/p>\n<p>the law as laid down by the Supreme Court, the<\/p>\n<p>Principal Secretary continues to pass mechanical<\/p>\n<p>orders, suffering from the same infirmities repeatedly<\/p>\n<p>being pointed out by this Court in his orders under 18<\/p>\n<p>(5) of the Act, acting in absolute discretion beyond the<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>limits of the statutory power so confirmed. The<\/p>\n<p>conduct of the Principal Secretary in passing orders of<\/p>\n<p>the present nature is apposite to the observations of<\/p>\n<p>the Supreme Court in the case of Tarlochan Dev<\/p>\n<p>Sharma (supra) at paragraph-15 as follows:-<\/p>\n<blockquote><p>                     &#8220;15. In the system of Indian<br \/>\n          Democratic Governance as contemplated<br \/>\n          by the Constitution senior officers<br \/>\n          occupying key positions such as<br \/>\n          Secretaries are not supposed to<br \/>\n          mortgage there own discretion, volition<br \/>\n          and decision making authority and be<br \/>\n          prepared to give way or being pushed<br \/>\n          back or pressed ahead at the behest of<br \/>\n          politicians for carrying out commands<br \/>\n          having no sanctity in law. The Conduct<br \/>\n          Rules of Central Government Services<br \/>\n          command the civil servants to maintain<br \/>\n          at all times absolute integrity and<br \/>\n          devotion to duty and do nothing which<br \/>\n          is unbecoming of a Government servant.<br \/>\n          No Government servant shall in the<br \/>\n          performance of his official duties, or in<br \/>\n          the exercise of power conferred on him,<br \/>\n          act otherwise than in his best judgment<br \/>\n          except when he is acting under the<br \/>\n          direction of his official superior. In<br \/>\n          Anirudhsinhji Jadeja (1995) 5 SCC 302 :<br \/>\n          (1995 AIR SCW 3543 : AIR 1995 SC<br \/>\n          2390), this Court has held that a<br \/>\n          statutory     authority    vested     with<br \/>\n          Jurisdiction must exercise it according<br \/>\n          to its own discretion; discretion<br \/>\n          exercised under the direction or<br \/>\n          instruction of some higher authority is<br \/>\n          failure to exercise discretion altogether.<br \/>\n          Observations of this Court in the<br \/>\n          Purtabpur Company Ltd., AIR 1970 SC<br \/>\n          1896, are instructive and apposite.<br \/>\n          Executive officers may in exercise of<br \/>\n          their statutory discretions take into<br \/>\n          account considerations of public policy<br \/>\n          and in some context policy of Minister or<br \/>\n          the Government as a whole when it is a<br \/>\n          relevant factor in weighing the policy but<br \/>\n          they are not absolved from their duty to<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>                 exercise their personal Judgment in<br \/>\n                 individual cases unless explicit statutory<br \/>\n                 provision      has    been     made     for<br \/>\n                 instructions by a superior to bind them.<br \/>\n                 As already stated we are not recording,<br \/>\n                 for want of adequate material, any<br \/>\n                 positive finding that the impugned order<br \/>\n                 was passed at the behest of or dictated<br \/>\n                 by someone else than its author. Yet we<br \/>\n                 have no hesitation in holding that the<br \/>\n                 impugned order betrays utter non-<br \/>\n                 application of mind to the facts of the<br \/>\n                 case and the relevant law. The manner<br \/>\n                 in which the power under S. 22 has<br \/>\n                 been exercised by the competent<br \/>\n                 authority is suggestive of betrayal of the<br \/>\n                 confidence which the State Government<br \/>\n                 reposed in the Principal Secretary in<br \/>\n                 conferring upon him the exercise of<br \/>\n                 drastic power like removal of President<br \/>\n                 of a Municipality under S. 22 of the Act.<br \/>\n                 To say the least what has been done is<br \/>\n                 not what is expected to be done by a<br \/>\n                 senior    official  like   the   Principal<br \/>\n                 Secretary of a wing of the State<br \/>\n                 Government. We leave at that and say<br \/>\n                 no more on this issue.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                 The Court trusts, hopes and expects that the<\/p>\n<p>       Principal Secretary shall proceed to acquaint himself<\/p>\n<p>       with the law laid down by the Supreme Court before<\/p>\n<p>       passing orders of the present nature.\n<\/p><\/blockquote>\n<blockquote><p>                 The order dated 11.2.2011 is accordingly set<\/p>\n<p>       aside.\n<\/p><\/blockquote>\n<blockquote><p>                 The application stands allowed.\n<\/p><\/blockquote>\n<pre>P.K.
