Since there was delay in filing<br \/>\n\tthe appeal, the petitioner filed delay condonation application being<br \/>\n\tCivil Misc. Appeal No. 97 of 2007 seeking condonation of delay of 98<br \/>\n\tdays.  On the said application, the learned Additional District<br \/>\n\tJudge and Presiding Officer, 5th Fast Track Court,<br \/>\n\tJunagadh passed an order on 15.03.2008 condoning delay on condition<br \/>\n\tof deposit Rs.2,000\/- by way of cost within 15 days from the date of<br \/>\n\tthe order.  Since the petitioner could not deposit the said sum, he<br \/>\n\tfiled an application dated 16.06.2008 produced at Annexure-D<br \/>\n\t(Colly.) stating, inter alia, that he is engaged in labour work.<br \/>\n\tHe, therefore, could not collect Rs.2,000\/- in short time permitted.<br \/>\n\tHis wife was unwell and thereafter, the Court went till summer<br \/>\n\tbreak.  On all these grounds, he could not deposit Rs.2,000\/- within<br \/>\n\tthe time permitted.  Such delay may be condoned and amount be<br \/>\n\taccepted.  On this application, the learned Judge passed the<br \/>\n\timpugned order on 16.06.2008 stating that the case has been disposed<br \/>\n\tof.  The application is, therefore, dismissed.\n<\/p>\n<p>I<br \/>\n\tfind that the learned Judge ought not to have treated the issue in<br \/>\n\tsuch summary fashion.  The petitioner had shown sufficient reasons<br \/>\n\tpreventing him from depositing the amount within the time permitted.<br \/>\n\t As noted herein that he is engaged in labour work.  His wife was<br \/>\n\tnot well. Sometime after the Court&#8217;s order, there was vacation in<br \/>\n\tthe Court.  All these grounds prevented him from making the deposit<br \/>\n\twithin the time permitted. For such minor lapse, substantive right<br \/>\n\tof the parties cannot be damaged without adjudication.  The<br \/>\n\tapplication itself could have been treated as one seeking extension<br \/>\n\tof time and recalling the order of dismissing the appeal for<br \/>\n\tnon-fulfillment of the condition of condonation of delay.  However,<br \/>\n\tif there was any technical error in drafting of the application<br \/>\n\tdated 16.06.2008, the petitioner could have been given sometime to<br \/>\n\tfile appropriate application or to amend the prayer to include<br \/>\n\tsetting aside of dismissal of the appeal.  Unfortunately, in one<br \/>\n\tline order, the entire appeal came to be finally turned down, only<br \/>\n\ton the ground that the petitioner could not raise the amount of cost<br \/>\n\twithin 15 days permitted by the learned Judge.  If this order is<br \/>\n\tallowed to stand, the effect thereof would be that the appeal of the<br \/>\n\tpetitioner would never be heard on merits.\n<\/p>\n<p>Only<br \/>\n\tfor this reason, I do not find it appropriate to call upon the other<br \/>\n\tside to respond to the High Court&#8217;s notice.  This petition is,<br \/>\n\ttherefore, dispose of permitting the petitioner herein to file an<br \/>\n\tappropriate application before the learned Judge concerned seeking<br \/>\n\trecalling of the said order dated 16.06.2008 and also praying for<br \/>\n\tsetting aside of dismissal of the appeal filed by the petitioner.\n<\/p>\n<p>If<br \/>\n\tthe petitioner files such an application within one week from today<br \/>\n\tand also tenders cost of Rs.2,000\/- as directed by the learned Judge<br \/>\n\tunder his order dated 15.03.2008, such application shall be decided<br \/>\n\tbearing in mind the above observations.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of accordingly.\n<\/p>\n<p>Direct<br \/>\n\tservice is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(Akil<br \/>\nKureshi, J.)<\/p>\n<p>mrpandya*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Harijan vs Harijan on 24 September, 2008 Author: Akil Kureshi,&amp;Nbsp;
