Mishra\n             For the Opposite Parties:        Mr. J.C. to G.P.I\n                                       ------\n2\/3.7.2009<\/pre>\n<p>          This application alleged civil contempt by disobedience of<br \/>\n             the order of this Court dated 28-11-2007 passed in W.P.S. No.<br \/>\n             3439 of 2007. By that order this Court had directed the Deputy<br \/>\n             Commissioner-cum-Chairman, Sarwa Shiksha Abhiyan, Palamau to<br \/>\n             decide the claim contained in the representation to be filed by the<br \/>\n             petitioner within eight weeks of the filing of the representation.\n<\/p>\n<p>                    The response filed by the respondents encloses a copy of<br \/>\n             the decision dated 3-3-2008 taken pursuant to this Court&#8217;s order<br \/>\n             dated 28-11-2007. It is a reasoned decision rejecting the<br \/>\n             petitioner&#8217;s claim. The petitioner claims this to be an attempt to<br \/>\n             circumvent this Court&#8217;s order, and in the alternative to be a biased<br \/>\n             decision by way of a vindictive response by the respondent.\n<\/p>\n<p>                    I have heard both sides.\n<\/p>\n<p>                    For appreciating the petitioner&#8217;s contention, the original<br \/>\n             issue between the parties needs to be examined, which is briefly<br \/>\n             stated below.\n<\/p>\n<p>                    Under the Sarwa Shiksha Abhiyan (education for all<br \/>\n             programme) certain teachers of the primary level are appointed on<br \/>\n             contractual basis. These are known as para teachers. Given the<br \/>\n             backdrop that these are short term contractual appointments, it has<br \/>\n             been provided that the selection for such appointment is to be<br \/>\n             made at a general meeting (aam sabha) of the village, which<br \/>\n             means that it is some kind of an election. The two embargos are<br \/>\n             that (1) the candidate should have passed class 10 at least, and (2)<br \/>\n             the person selected \/elected should be a resident of the same<br \/>\n             village\/tola; and only if an eligible\/qualified person of the same<br \/>\n             village\/tola is not available, then a resident of adjoining village\/ tola<br \/>\n             may be selected. Residence in the same village\/tola can be<br \/>\n             expected to ensure personal knowledge on part of the teacher<br \/>\n             about the students, their families, their circumstances etc., which<br \/>\n<span class=\"hidden_text\">                                 2.<\/span><br \/>\nmay be an important aid in dealing with the students at that<br \/>\nprimary level.\n<\/p>\n<p>       The rest of the conditions prescribed are only guidelines and<br \/>\nnot mandatory if the selection is by the general meeting. These<br \/>\nother guidelines would become relevant only in the selection is by<br \/>\nthe education committee. The reason is that while the committee<br \/>\ncannot act arbitrarily, but the policy of selection by general meeting<br \/>\nhas been provided on the supposition that the residents of the<br \/>\nvillage are in the best position to democratically look after their<br \/>\nown interest by deciding who is the best person to teach their own<br \/>\nchildren having regard to the candidate&#8217;s character, ability and<br \/>\nother antecedents. The candidates being from the same small local<br \/>\narea, it can be safely assumed that the villagers would be fully<br \/>\naware about the candidates. It is more than obvious that (1) such<br \/>\nguidelines are not capable of enforcement when selection is by<br \/>\nelection, and (2) if selection has to be a mere ministerial exercise<br \/>\nby appointing the person having highest qualification or highest<br \/>\nmarks according to the guidelines, then the general meeting will<br \/>\nbecome purposeless.\n<\/p>\n<p>       The above view is also reinforced by the fact that the<br \/>\ncommittee has been given limited grounds for interfering with the<br \/>\ngeneral body decision e.g. Where the general meeting is unable to<br \/>\nselect or selects a candidate not eligible.\n<\/p>\n<p>       The petitioner had moved this Court by W.P.S. No. 3439 of<br \/>\n2007 on the ground that he had secured higher marks in the<br \/>\nintermediate examination as compared to the selected candidate. It<br \/>\nwas not disputed that both the petitioner as well as the selected<br \/>\ncandidate were eligible for the appointment.\n<\/p>\n<p>       As stated above these higher marks may have been a<br \/>\nrelevant consideration if the selection was being made by the<br \/>\ncommittee, but not when the selection\/election is by the general<br \/>\nmeeting.\n<\/p>\n<p>       Moreover according to the decision dated 3\/3\/08 the<br \/>\ncandidate selected at the general meeting was a resident of the<br \/>\nsame Tola where the school is located, while the petitioner was a<br \/>\nresident   of    the western    Tola of       the   village Rabda. The<br \/>\nselection\/election has been justified in the decision dated 3\/3\/08 on<br \/>\nthe ground of proximity of residence. Higher marks in intermediate<br \/>\n<span class=\"hidden_text\">                                             3.<\/span><br \/>\n            examination was not a ground on which the general meeting<br \/>\n            decision could be interfered with.\n<\/p>\n<p>                     Civil contempt, which means &#8220;willful&#8221; disobedience of an<br \/>\n            order of the Court, arises either upon a clear non-compliance with<br \/>\n            the Court&#8217;s order ie. if no decision has been taken as directed by<br \/>\n            the Court. It may also include cases where the purported<br \/>\n            compliance is a mere eye wash. However, where the Court&#8217;s order<br \/>\n            has been complied with by taking a decision which may not be<br \/>\n            strictly justifiable in law, it may give rise to a cause of action for<br \/>\n            challenging that legally unsustainable order but it will not give rise<br \/>\n            to a cause of action for civil contempt. If, however, the order so<br \/>\n            passed by the authority in purported compliance of the court&#8217;s<br \/>\n            direction shows that (1) it is a mere eye wash and no genuine<br \/>\n            attempt by the authority to take a decision, or (2) an attempt to<br \/>\n            circumvent to this court&#8217;s direction by a mere sham exercise, it may<br \/>\n            still amounts to civil contempt subject of course to other<br \/>\n            circumstances.
