Mengdey, learned Additional Public Prosecutor waives service<br \/>\n\tof notic of rule on behalf of the respondent No.1 and Mr.Pratik<br \/>\n\tBarot,  learned  advocate waives  the  service  of  notice on behalf<br \/>\n\tof the respondent No.2.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and with the consent of the<br \/>\n\tlearned advocates appearing on behalf of the respective parties,<br \/>\n\tpresent petition is taken up for final hearing.\n<\/p>\n<p>Present<br \/>\n\tpetition has been preferred  by the petitioner\n<\/p>\n<p>\t &#8211; original accused No.2, under sec.482 of the Code of<br \/>\n\tCriminal Procedure,  to quash and set aside the impugned<br \/>\n\tcomplaint\/FIR being CR No.I-151 of 2010 registered with Chanasma<br \/>\n\tPolice Station for the offences punishable under sections 394, 323,<br \/>\n\t504, 506(2) and 114 of Indian Penal Code  and for the offence<br \/>\n\tpunishable under sec.135 of Bombay Police Act and for the offences<br \/>\n\tpunishable under sections 3(1)(10) of the Scheduled Caste and the<br \/>\n\tScheduled Tribes (Prevention of Atrocities Act, 1989 (Act No.33 of<br \/>\n\t1989)  (hereinafter referred to as &#8220;Atrocities Act&#8221; for<br \/>\n\tconvenience).\n<\/p>\n<p>Mr.Chaudhary,<br \/>\n\tlearned<br \/>\n\tadvocate appearing on behalf of the petitioner &#8211; original<br \/>\n\taccused No.2 has stated at the bar that the petitioner  is<br \/>\n\tpressing and\/or praying to quash and set aside the aforesaid First<br \/>\n\tInformation Report in question so far as the offence under<br \/>\n\tsec.3(1)(10) of the Atrocities Act only and he does not press the<br \/>\n\tpresent petition to quash and set aside the impugned FIR for the<br \/>\n\trest of the offences.\n<\/p>\n<p>Mr.Chaudhary,<br \/>\n\tlearned<br \/>\n\tadvocate appearing on behalf of the petitioner  has<br \/>\n\ttaken the Court to the necessary averments made in the impugned FIR<br \/>\n\tagainst the petitioner\n<\/p>\n<p>\t &#8211; original accused No.2 for the offences punishable<br \/>\n\tunder sec.3(1)(10) of the Atrocities Act and has also taken the<br \/>\n\tCourt to other correspondences taken place earlier by other persons,<br \/>\n\tsubmitting that  the original complainant had threatened  in past<br \/>\n\talso that he will file false complaint for the offence under the<br \/>\n\tAtrocities Act.\n<\/p>\n<p>After<br \/>\n\tmaking some submissions and looking to the nature of allegations<br \/>\n\tmade against the petitioner\n<\/p>\n<p>\t &#8211; accused No.2 in so far as offence punishable under<br \/>\n\tsec.3(1)(10) of the Atrocities Act is concerned, Mr.Barot, learned<br \/>\n\tadvocate appearing on behalf of the respondent No.2 &#8211;<br \/>\n\toriginal complainant  has submitted that in the peculiar facts and<br \/>\n\tcircumstances of the case, if  the impugned FIR of the offences<br \/>\n\tpunishable under sec.3(1)(10) of the Atrocities Act against the<br \/>\n\tpetitioner\n<\/p>\n<p>\t &#8211; original accused No.2, is quashed and set aside, he<br \/>\n\thas no objection and for that, he does not invite any further<br \/>\n\treasoned order. However, he has requested to make suitable<br \/>\n\tobservations that the  same shall be QUA petitioner<br \/>\n\t herein &#8211; original accused No.2 only and the<br \/>\n\tother accused, against whom specific averments and allegations are<br \/>\n\tmade in the complaints,  shall not be entitled to take benefit of<br \/>\n\tthe same.\n<\/p>\n<p>Mr.M.R.\n<\/p>\n<p>\tMengdey, learned Additional Public Prosecutor has requested to pass<br \/>\n\tappropriate order in so far as the offence punishable under<br \/>\n\tsec.3(1)(10) of the Atrocities Act  against the petitioner<br \/>\n\t is concerned.\n<\/p>\n<p>In<br \/>\n\tthe peculiar facts and circumstances of the case and considering the<br \/>\n\t allegations made against the petitioner\n<\/p>\n<p>\t &#8211; original accused No.2 in the impugned FIR for the<br \/>\n\toffence punishable under sec.3(1)(10) of the Atrocities Act  and<br \/>\n\tconsidering the earlier correspondence annexed with the petition,<br \/>\n\tand considering the stand taken by Mr.Pratik Barot, learned<br \/>\n\tadvocate appearing on behalf of the respondent No.2 &#8211;<br \/>\n\toriginal complainant, it appears that to continue the complaint<br \/>\n\tagainst the petitioner<br \/>\n\t for the offence punishable under sec.3(1)(10) of the<br \/>\n\tAtrocities Act would be abuse of process of law and therefore, the<br \/>\n\timpugned FIR qua for the offence punishable under sec.3(1)(10) of<br \/>\n\tthe Atrocities Act against the petitioner<br \/>\n\t deserves to be quashed and set aside.\n<\/p>\n<p>While<br \/>\n\tquashing the impugned  FIR qua for the offence punishable under<br \/>\n\tsec.3(1)(10) of the Atrocities Act against the petitioner,<br \/>\n\tthis Court has not passed reasoned order, as the learned advocate<br \/>\n\tappearing on behalf of the respective parties have requested not to<br \/>\n\tassign reasons, as the investigation is going on and in case of<br \/>\n\tfiling of the Chargesheet, further trial is to be conducted.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above, the impugned<br \/>\n\tFirst Information<br \/>\n\tReport<br \/>\n\tbeing  CR No.I-151<br \/>\n\tof 2010 filed by the respondent No.2 &#8211; original complainant<br \/>\n\twith Chanasma Police Station against petitioner<br \/>\n\t herein &#8211;\n<\/p>\n<p>\taccused No.2 is quashed and set in so far as the offences alleged<br \/>\n\tagainst the petitioner<br \/>\n\t herein &#8211;\n<\/p>\n<p>\toriginal accused No.2, for the punishable under sec.3(1)(10) of the<br \/>\n\tAtrocities Act QUA petitioner<br \/>\n\t herein &#8211;\n<\/p>\n<p>\toriginal accused herein only and the rest of the First Information<br \/>\n\tReport in question shall stand as it is for the other offences and<br \/>\n\tfor other offences, the impugned First Information Report is<br \/>\n\tnot quashed and set aside and the petitioner<br \/>\n\t herein &#8211; original complainant will have to face<br \/>\n\tthe trial for the offences other than  the offence under<br \/>\n\tsec.3(1)(10) of the Atrocities Act. This order is passed in view of<br \/>\n\tthe peculiar facts of the case and in view of the stand taken by the<br \/>\n\tlearned<br \/>\n\tadvocate appearing on behalf of<br \/>\n\tthe respondent No.2 &#8211; original accused for the<br \/>\n\tpetitioner<br \/>\n\t herein -original accused No.2 only and hence the<br \/>\n\tother accused shall not claim and shall not be entitled to claim<br \/>\n\tbenefit of this order.
