SHAH\n\t\t\n\t\n\n \n\nDate\n: 27\/09\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tAs<br \/>\ncommon question of law and facts arise in all these petitions, they<br \/>\nare being disposed of by this common judgement and order.\n<\/p>\n<p>2.\t\tIn<br \/>\nall these petitions, the respective petitioners have prayed for an<br \/>\nappropriate writ, order and\/or direction, directing the concerned<br \/>\nrespondents to recover an amount as per the respective orders passed<br \/>\nby Controlling Authority under the Payment of Gratuity Act in<br \/>\nGratuity Application No.77\/2006 (Shashikant P. Pandya); Gratuity<br \/>\nApplication No.76\/2006 (Ripulkant D. Desai); Gratuity Application<br \/>\nNo.75\/2006 (Ramniklal M. Parmar); Gratuity Application No.88\/2006<br \/>\n(Prataprai A. Dave) and Gratuity Application No.25\/2006 (Navalbhai C.<br \/>\nMehta).\n<\/p>\n<p>3.\t\tMr.Neeraj<br \/>\nSoni, learned Assistant Government Pleader has appeared on behalf of<br \/>\nrespondent Nos.1 and 2 and Shri Munshaw, learned advocate has<br \/>\nappeared on behalf of respondent No.3. An affidavit-in-reply is filed<br \/>\non behalf of respondent Nos.1 and 2 and an affidavit-in-reply is also<br \/>\nfiled  on behalf of respondent No.3. From the Affidavit-in-reply<br \/>\nfiled on behalf of respondent Nos.1 and 2, it appears that in fact<br \/>\nrespondent Nos.1 and 2 had on receipt of the Recovery Certificates<br \/>\ntried to recover the amount from respondent No.3, however according<br \/>\nto respondent Nos.1 and 2 as respondent No.3 conveyed to them that<br \/>\nwhatever amount due and payable towards pension etc. has been paid to<br \/>\nthe petitioners and that they have already approached the State<br \/>\nGovernment for exemption, respondent Nos.1 and 2 thereafter did not<br \/>\ntake any further steps.\n<\/p>\n<p>4.\t\tFrom<br \/>\nthe Affidavit-in-reply filed on behalf of respondent No.3, it appears<br \/>\nthat it is the case of respondent No.3 that nothing is due and<br \/>\npayable to the petitioners and, therefore, they are not entitled to<br \/>\nthe amount of Gratuity as ordered by the Controlling Authority  under<br \/>\nthe Payment of Gratuity Act,1972. It is also case on behalf of<br \/>\nrespondent No.3 that now on and from 2008-2009, there is an exemption<br \/>\ngranted by the State Government in favour of respondent No.3<br \/>\nexempting respondent No.3 from applicability of Payment of Gratuity<br \/>\nAct. However, the fact remains that  as on today there are orders<br \/>\npassed by the Controlling Authority  under the Payment of Gratuity<br \/>\nAct, 1972 directing respondent No.3 to pay amount of Gratuity to the<br \/>\nrespective petitioners and Recovery Certificates have been issued<br \/>\naccordingly by the Controlling Authority. Therefore, unless and until<br \/>\nthe orders passed by the Controlling Authority are challenged before<br \/>\nthe Appellate Authority and there are any stay order and\/or the said<br \/>\norders are upset neither respondent Nos.1 and 2 nor respondent No.3<br \/>\ncan deny to make the payment as per the Recovery Certificate.<br \/>\nRespondent Nos.1 and 2 are not required to adjudicate the dispute and<br \/>\nquestions whether the petitioners are entitled to amount of gratuity<br \/>\nor not. Respondent Nos.1 and 2 are required to simply recover the<br \/>\namount as per the Recovery Certificates which have been issued<br \/>\npursuant to the orders passed by the Controlling Authority under the<br \/>\nPayment of Gratuity Act,1972. Respondent Nos.1 and 2 are not required<br \/>\nto consider whether the petitioners are entitled to the said amount<br \/>\nor not. Similarly, respondent No.3 also cannot be permitted to say<br \/>\nthat petitioners are not entitled to the amount of gratuity as per<br \/>\nthe orders passed by the Controlling Authority  under the Payment of<br \/>\nGratuity Act, 1972, unless and until, it is challenged by way of<br \/>\nAppeal before the Appropriate Authority. Without challenging the<br \/>\nsame, it will not be open for respondent No.3 to contend the same<br \/>\nthat too in the petitions filed by the respective petitioners for<br \/>\nrecovery of amount as per the Recovery Certificates. Under the<br \/>\ncircumstance, the action of respondent Nos.1 and 2 in not recovering<br \/>\nthe amount from respondent No.3 and\/or respondent No.3 in not paying<br \/>\nthe amount of gratuity as per the Recovery Certificates issued by the<br \/>\nControlling Authority under the Payment of Gratuity Act,1972 cannot<br \/>\nbe sustained and the same deserve to be quashed and set aside and<br \/>\npetitioners are to be paid the amount of gratuity unless it is<br \/>\nchallenged by respondent No.3 before the Appellate Authority.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the above and for the reasons stated above, all these<br \/>\npetitions succeed and respondent Nos.1 and 2 are hereby directed to<br \/>\nrecover the amount as per the Recovery Certificates issued by the<br \/>\nControlling Authority under the Payment of Gratuity Act, 1972 from<br \/>\nthe respondent No.3 within a period of six weeks from today unless<br \/>\nthere is any contrary order passed by the Appellate Authority. Rule<br \/>\nis made absolute to the aforesaid extent in each of the petitions.
