Learned Advocate  for the petitioner invited attention of<br \/>\nthe Court to page No.84 &#8211; resignation, page No.85-letter dated<br \/>\n03\/06\/2006 and page No.92 &#8211; legal notice dated 07\/06\/2006.\n<\/p>\n<p>1.1\t\tLearned<br \/>\nAdvocate for the petitioner submitted that besides the monthly salary<br \/>\n@ Rs.17,460\/- paid to the respondent, he was paid reimbursement for<br \/>\nmagazine expenses @ of Rs.200\/- per month and reimbursement for<br \/>\nmedical expenses @ Rs.17460\/- per annum (Rs.1455\/- per month), which<br \/>\nis suggestive of the fact that respondent was never working as a<br \/>\n&#8216;Workman&#8217; with the petitioner establishment.  He submitted<br \/>\nthat  respondent himself has stated in his statement of claim that<br \/>\nafter sometime from the post of &#8216;Analytical Chemist&#8217; he was promoted<br \/>\nas &#8216;Quality Control Officer&#8217; and, later on &#8216;Quality Control<br \/>\nExecutive&#8217;. He, therefore, submitted that the interim &#8211; relief<br \/>\nas prayed for may be granted.\n<\/p>\n<p>2.\t\tAs<br \/>\nagainst that, learned Advocate, Mr.Bukhari, for the respondent<br \/>\nsubmitted that it is the case of the respondent that though his<br \/>\ndesignation was &#8216;Quality Control Officer&#8217; and later on promoted as<br \/>\n&#8216;Quality Control Executive&#8217;, his work remained the same as that of<br \/>\n&#8216;Analytical Chemist&#8217;. He further submitted that he never had any<br \/>\npower to grant leave to any of his subordinate staff or to take any<br \/>\ndisciplinary action against his subordinate staff and therefore he<br \/>\nwas nothing more than the &#8216;Workman&#8217;.  In this regard, he invited<br \/>\nattention of the court to the contents of the paragraph No.9 of the<br \/>\naward.\n<\/p>\n<p>3.\t\tBe<br \/>\nthat as it may, the fact that respondent was getting salary of<br \/>\nRs.17,460\/- per month and also the magazine expenses and medical<br \/>\nreimbursement of Rs.17460\/- per annum (Rs.1455\/- per month),<br \/>\nprima-facie this Court is of the opinion that the respondent is not a<br \/>\n&#8216;Workman&#8217;.  Hence, the matter requires consideration.\n<\/p>\n<p>4.\t\t RULE.\n<\/p>\n<p> Interim-relief in terms of paragraph No.6(B).
