Justice T.R.RAMACHANDRAN NAIR\n\n Dated :25\/03\/2009\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR, J\n            --------------------------------------------------\n                   W.P.(C) No. 8709 of 2009\n            ---------------------------------------------------\n           Dated this the 25th day of March, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>      The petitioner is a physically handicapped person having<\/p>\n<p>45% disability. She is a IInd Grade Nursing Assistant working<\/p>\n<p>in the District Hospital, Ernakulam. In view of the disability she<\/p>\n<p>was allowed to work as a Telephone Operator. The main<\/p>\n<p>grievance raised in the Writ Petition is that presently the<\/p>\n<p>accommodation given to her as Telephone Operator has been<\/p>\n<p>withdrawn and the petitioner is assigned other duties in the<\/p>\n<p>general ward which according to her is very difficult to perform.<\/p>\n<p>In view of the disability, she will not be able to perform such<\/p>\n<p>work in a satisfactory manner.\n<\/p>\n<p>      2. The learned Government Pleader on instructions<\/p>\n<p>submitted that the petitioner was appointed as PTC through<\/p>\n<p>Employment Exchange on 4.7.2000. She was promoted as<\/p>\n<p>Hospital Attendant Gr.II as per order dated 21.8.2000.<\/p>\n<p>Petitioner was allowed to work as Telephone Operator as the<\/p>\n<p>post was remaining vacant in January, 2005. Subsequently, she<\/p>\n<p>was promoted and posted as Nursing Assistant in the year 2006<\/p>\n<p>and she was permitted to continue as Telephone Operator until<\/p>\n<p>a qualified telephone operator is appointed in the post. As part<\/p>\n<p>wpc:8709 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>of providing various facilities and staff to the hospital for<\/p>\n<p>obtaining accreditation of NABH, two new qualified Telephone<\/p>\n<p>Operators were appointed and petitioner was reposted to the<\/p>\n<p>ward. There is scarcity of Nursing Assistants also. It is pointed<\/p>\n<p>out   that   considering    her   handicap    (only   45%)   the<\/p>\n<p>Superintendent has made some internal arrangement and<\/p>\n<p>posted her to OP for issuing OP tickets\/IP registration etc.<\/p>\n<p>     3. In that view of the matter, the petitioner will abide by<\/p>\n<p>the directions of the Superintendent and accept the said posting<\/p>\n<p>since the same will be entirely different from the duty as<\/p>\n<p>Nursing Assistant in the ward itself.
