RAMKUMAR, J.\n             ========================\n                     B.A. No. 8665 of 2010\n             ========================\n          Dated this the 19th day of January, 2011.\n\n                             ORDER\n<\/pre>\n<p>     Petitioners who are accused     Nos. 1 to 3 in Crime No.801<\/p>\n<p>of 2010 of Nadakkavu Police Station for an offence punishable<\/p>\n<p>under Section 498(A) read with Section 34 I.P.C., seek<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>     2.    The    learned   Public   Prosecutor     opposed     the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated   2-12-2010     of the Apex Court       in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a> (2010 (4) KLT 930),            I am of the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer     has not had      the advantage of<\/p>\n<p>interrogating the petitioners.     But at the same time, I am<\/p>\n<p>inclined to permit the petitioners to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>B.A. No. 8665\/2010<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>have their application for bail allowed by the Magistrate or the<\/p>\n<p>Court    having jurisdiction.   Accordingly, the petitioners shall<\/p>\n<p>surrender before the investigating officer on 28.01.2011 or on<\/p>\n<p>29.01.2011 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. In case the investigating officer<\/p>\n<p>is of the view that having regard to the facts of the case arrest<\/p>\n<p>of the petitioners is imperative he shall record his reasons for<\/p>\n<p>the arrest in the case diary as insisted in paragraph 129       of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                  The<\/p>\n<p>petitioners shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.      In case the interrogation of the petitioners is<\/p>\n<p>without     arresting them,   the   petitioners shall  thereafter<\/p>\n<p>appear before the     Magistrate or the Court concerned       and<\/p>\n<p>apply for regular bail. The Magistrate or the Court on being<\/p>\n<p>satisfied that the petitioners have been interrogated by the<\/p>\n<p>police shall, after hearing the prosecution as well, release the<\/p>\n<p>petitioners on bail.\n<\/p>\n<p>      4. In case the petitioners while surrendering before the<\/p>\n<p>Investigating Officer have    deprived   the investigating officer<\/p>\n<p>B.A. No. 8665\/2010<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect          to the Magistrate or the<\/p>\n<p>Court concerned. Likewise, the Magistrate or the Court also<\/p>\n<p>will not be bound by the time limit fixed as above if sufficient<\/p>\n<p>time was not available after the production or appearance of<\/p>\n<p>the accused.\n<\/p>\n<p>      5.    The release of the petitioners shall be on each the<\/p>\n<p>petitioners executing a bond for `15,000\/- (Rupees             fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like amount<\/p>\n<p>to the satisfaction of the Court concerned and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>            1.    The   petitioners    shall   report  before   the<\/p>\n<p>            Investigating Officer between 9 a.m. and 11 a.m. on all<\/p>\n<p>            Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            2. The petitioners shall make themselves available for<\/p>\n<p>            interrogation including custodial interrogation as and<\/p>\n<p>            when required by the Investigating Officer.<\/p><\/blockquote>\n<p>            3.    Petitioners shall not influence or intimidate the<\/p>\n<p>B.A. No. 8665\/2010<\/p>\n<p><span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>            prosecution witnesses nor shall they attempt to tamper<\/p>\n<p>            with the evidence for the prosecution.\n<\/p>\n<\/p>\n<p>            4.    Petitioners shall not commit any offence while on<\/p>\n<p>            bail.\n<\/p>\n<\/p>\n<p>             5.
