On 13-6-1992, son of owner of respondent firm<br \/>\nhas taken him for labour work with three other labourers.  While<br \/>\ndoing the work, the appellant herein has suffered injury and three<br \/>\nfingers of his leg were fractured.  The appellant had taken treatment<br \/>\nin Irvin Hospital.  Inspite of that permanent disability has remained<br \/>\nin the body of the appellant and, therefore, he had given notice to<br \/>\nthe respondent to pay compensation.  However, since said amount was<br \/>\nnot paid, the appellant had filed aforesaid Compensation Case with a<br \/>\nprayer to grant Rs.1,03,990\/- as compensation.\n<\/p>\n<p>4.\tSaid<br \/>\nclaim of the workmen was resisted by the respondent by filing reply.<br \/>\nIt is stated by the respondent that the appellant has not gone for<br \/>\nwork with son of owner of respondent firm.  It is also denied that<br \/>\nthe  appellant has sustained injury during the course of employment.<br \/>\nIt is stated that if the workmen has sustained injuries while doing<br \/>\nwork of any other firm, for that the respondent cannot be held<br \/>\nliable.  It is also stated that the appellant is doing same work even<br \/>\nafter accident and, therefore, it is prayed that the claim of the<br \/>\nappellant may be dismissed.\n<\/p>\n<p>5.\tAfter<br \/>\nconsidering the evidence on record, Workmen Compensation Commissioner<br \/>\ndismissed the application of the appellant. Being aggrieved by it,<br \/>\nthe appellant has filed present appeal.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate for the appellant has raised contention that the Workmen<br \/>\nCompensation Commissioner committed an error by not considering that<br \/>\nthe appellant was a &#8216;workman&#8217; as per the provisions of Workmen&#8217;s<br \/>\nCompensation Act, 1923.  He also submitted that it is the duty of the<br \/>\nrespondent to prove that the appellant is not a workman of the<br \/>\nrespondent.  He also submitted that since the appellant has sustained<br \/>\ninjuries during the course of employment, compensation is required to<br \/>\nbe paid to the appellant.  He,<br \/>\ntherefore, prayed that this appeal may be allowed by setting aside<br \/>\norder of  the Workmen<br \/>\nCompensation Commissioner.\n<\/p>\n<p>7.\tLearned<br \/>\ncounsel  for  the respondent submitted that the appellant is not<br \/>\n&#8216;workmen&#8217; as per the definition given in Workmen Compensation Act.<br \/>\nHe also submitted that even otherwise, the appellant has not<br \/>\nsustained any injury during the course of employment.  He also<br \/>\nsubmitted that since there is no decrease in earning capacity of the<br \/>\nappellant and since the appellant is continuing to do the same work,<br \/>\naward of the the Workmen<br \/>\nCompensation Commissioner may not be interfered with.  In view<br \/>\nof above submissions, he prayed that this appeal may be dismissed.\n<\/p>\n<p>8.<br \/>\n\tI have considered the<br \/>\nsubmissions made on behalf of both the side and also gone through the<br \/>\njudgment of the trial Court and other relevant documents. At the time<br \/>\nof deciding the issue, the Workmen Compensation Commissioner has<br \/>\nconsidered the definition of &#8216;workman&#8217; given under the Act and, as<br \/>\nper the same, the appellant cannot be said to be &#8216;workman&#8217;.<br \/>\nTherefore, it is rightly held that the appellant is not entitled to<br \/>\nany compensation under the Workmen Compensation Act.    I am in<br \/>\ncomplete agreement with the reasonings given and finding arrived at<br \/>\nby the Workmen Compensation Commissioner while passing impugned<br \/>\norder.  No other evidence is shown to me to take a contrary view and<br \/>\nthis appeal is devoid of any merits.
