{"id":210261,"date":"2011-01-19T00:00:00","date_gmt":"2011-01-18T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/j-aeronimuse-vs-m-arulappan-on-19-january-2011"},"modified":"2017-07-06T13:57:01","modified_gmt":"2017-07-06T08:27:01","slug":"j-aeronimuse-vs-m-arulappan-on-19-january-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/j-aeronimuse-vs-m-arulappan-on-19-january-2011","title":{"rendered":"J.Aeronimuse vs M.Arulappan on 19 January, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Madras High Court<\/div>\n<div class=\"doc_title\">J.Aeronimuse vs M.Arulappan on 19 January, 2011<\/div>\n<pre>       \n\n  \n\n  \n\n \n \n BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT\n\nDATED: 19\/01\/2011\n\nCORAM\nTHE HONOURABLE MR.JUSTICE M.VENUGOPAL\n\nC.R.P(NPD)(MD)No.1066 of 2004\n\nJ.Aeronimuse\t   \t\t..Appellant\/Petitioner\/\n\t\t\t  \t  Petitioner\nvs\t\t\n\nM.Arulappan\t\t\t..Respondent\/Respondent\/\t\t\t\n\t\t\t\t..Respondent\n\nPRAYER\n\nCivil Revision Petition filed under Article 115 of Civil Procedure Code\nagainst the order and decretal order dated 27.08.2002 made in I.A.No.29 of 2001\nin A.S.S.R.No.418 of 1997 on the file of the Principal District Judge,\nNagercoil.\n\n!For Petitioner ...Mr.K.Sreekumaran Nair\n^For Respondent ...Mr.S.C.Herold Singh,\n\t\t   Govt.Advocate.\t\t\n\n:ORDER\n<\/pre>\n<p>\tThe Revision petitioner\/Plaintiff has filed the present Civil Revision<br \/>\nPetition as against the order dated 27.08.2002 in I.A.No.29 of 2001 in<br \/>\nA.S.S.R.No.418 of 1997 passed by the learned  Principal District Judge,<br \/>\nNagercoil.\n<\/p>\n<p>\t2.The learned Principal District Judge, while passing the orders in<br \/>\nI.A.No.29 of 2001 on 27.08.2002 has among other things observed that since the<br \/>\nI.A.No.28 of 2001 filed for excuse of delay 1322 days has been dismissed, the<br \/>\npresent I.A.No.29 of 2001 is also dismissed without costs.\n<\/p>\n<p>\t3.The learned Counsel for the Revision Petitioner\/plaintiff submits that<br \/>\nthe order of the learned Principal District Judge, Nagercoil, in dismissing the<br \/>\nI.A.No.29 of 2001 in A.S.S.R.No.418 of 1997 dated 27.08.2002 is contrary to the<br \/>\nlaw and the same is vitiated by material irregularity in regard to the exercise<br \/>\nof jurisdiction.\n<\/p>\n<p>\t4.It is the contention of the learned Counsel for the Petitioner\/Plaintiff<br \/>\nthat there is only shortage of 15 days in filing of an Appeal and this aspect<br \/>\nhas not been properly appreciated by the learned Principal District Judge,<br \/>\nNagercoil, while dismissing the I.A.No.29 of 2001 and in any event, the learned<br \/>\nPrincipal District Judge, Nagercoil, should have allowed the I.A.No.29 of 2001<br \/>\nin the interest of justice.\n<\/p>\n<p>\t5.In I.A.No.29 of 2001, the Revision Petitioner\/Plaintiff has among other<br \/>\nthings averred that &#8216;the last date of filing of Appeal fell on 20.01.1997, but<br \/>\nthe Revision Petitioner has fallen sick and admitted as an inpatient in<br \/>\nJ.J.Hospital, Kottar, on 16.01.1997, but he has undergone an operation for a<br \/>\ngrowth in the middle of the chest and is still continued to be in the Hospital.<br \/>\nFurther he has not been in a position to give instructions to his Advocate to<br \/>\nprefer the appeal and there is a casual delay of 15 days.&#8217;    \t<\/p>\n<p>\t6.In the counter filed by the Respondent\/Defendant it is mentioned that<br \/>\nI.A.No.29 of 2001 filed by the Revision Petitioner\/Plaintiff is not<br \/>\nmaintainable, no proper or legal reason is assigned in the affidavit in<br \/>\nI.A.No.29 of 2001 filed by the petitioner and since the I.A.No.29 of 2007 is not<br \/>\nmaintainable and the said I.A.No.29 of 2001 is to be dismissed in furtherance of<br \/>\nsubstantial cause of justice.\n<\/p>\n<p>\t7.On going through the order of the learned Principal District Judge,<br \/>\nNagercoil, in I.A.No.29 of 2001, it is quite evident that the learned Principal<br \/>\nDistrict Judge, Nagercoil, has dismissed, the I.A.No.29 of 2001 on the ground<br \/>\nthat he has already dismissed, the I.A.No.28 of 2001 after hearing of both<br \/>\nsides.\n<\/p>\n<p>\t8.At this stage, the learned Counsel for the Respondent\/Defendant submits<br \/>\nthat the learned Principal District Judge, Nagercoil, after dismissing the<br \/>\nI.A.No.28 of 2001 has passed consequential order of dismissing the I.A.No.29 of<br \/>\n2001.  Furthermore, the Learned Principal District Judge, Nagercoil, while<br \/>\ndismissing the I.A.No.29 of 2001 has not adverted to the merits of the averments<br \/>\nmade by the Revision Petitioner in I.A.No.29 of 2001.\n<\/p>\n<p>\t9.It is to be noted that in the affidavit filed by the Revision Petitioner<br \/>\nin I.A.No.29 of 2001 the reason assigned by the Revision Petitioner is different<br \/>\nfrom the reason assigned in the affidavit filed in I.A.No.28 of 2001.<br \/>\nConsequently, in I.A.No.29 of 2001  the Revision Petitioner\/Plaintiff has stated<br \/>\nthat he has fallen ill and he has admitted as an inpatient in J.J.Hospital,<br \/>\nKottar, on 16.01.1997 and he has undergone an operation for a growth in the<br \/>\nmiddle of the chest and because of the said reason, he has not been in a<br \/>\nposition to give instructions to his Counsel to prefer the appeal in time.\n<\/p>\n<p>\t10.However,  a perusal of the counter filed by the Respondent\/Defendant<br \/>\nshows that the factum of Revision Petitioner falling ill and being admitted in<br \/>\nJ.J.Hospital,Kottar, on 16.01.1997 has not been denied by the<br \/>\nRespondent\/Defendant. The only averment is that I.A.No.29 of 2001 is not<br \/>\nmaintainable.  Also, it is mentioned that the petition copy served on the<br \/>\nrespondent&#8217;s side has been undated.  Added further, the Respondent\/Defendant has<br \/>\nmentioned that no proper or legal reason has been assigned in the affidavit in<br \/>\nI.A.No.29 of 2001.\n<\/p>\n<p>\t11. The learned Counsel for the Respondent\/Defendant has brought to the<br \/>\nnotice of this Court that the Revision Petitioner\/Plaintiff in I.A.No.29 of 2001<br \/>\nhas averred in paragraph &#8216;4&#8217; that he has produced herein medical certificate,<br \/>\nbut neither the same has been filed in the Court nor the same has been marked as<br \/>\nexhibit in the Court on the side of the Revision Petitioner\/Plaintiff and as<br \/>\nsuch, the Revision Petitioner\/Plaintiff has not proved the illness alleged by<br \/>\nhim.  But at this stage, this Court is of the considered view that though the<br \/>\npetitioner has averred that he has produced the medical certificate and the same<br \/>\nhas not been marked as exhibit in I.A.No.29 of 2001 on the side of the<br \/>\npetitioner, yet the fact that the Revision Petitioner has fallen ill and<br \/>\nadmitted as an inpatient in J.J.Hospital, Kottar, has not been categorically<br \/>\ndenied by the Respondent\/Defendant.  Even the absence of Medical Certificate<br \/>\nbeing marked as exhibit on the side of the Revision Petitioner\/Plaintiff is not<br \/>\nfatal to the case of the Revision Petitioner\/Plaintiff, in the considered<br \/>\nopinion of this Court.  It is to be remembered that the Court of law has to<br \/>\ndeliver substantial justice between the parties overriding technicalities in<br \/>\ndelay condonation application or representation of delay matters.  The pedantic<br \/>\napproach or a Court of law and even the length and the breath of delay are not<br \/>\nmaterial or relevant factors.  Normally, a litigant does not stand to benefit by<br \/>\nfiling an appeal belatedly.  On the other hand, he runs a serious risk.  If the<br \/>\ncondonation of delay or representation of delay is allowed by a Court, then a<br \/>\nlitigant will be allowed to take part in the main arena of proceedings so that<br \/>\nhis cause can be decided on merits,  by the Court,  of course, after hearing<br \/>\nboth sides on merits.
