Justice V.RAMKUMAR\n\n Dated :26\/10\/2010\n\n O R D E R\n                         V.RAMKUMAR, J.\n              ----------------------------------------------\n              Bail Application No.6583 of 2010\n             ------------------------------------------------\n          Dated this the 26th day of October, 2010\n\n                                ORDER\n<\/pre>\n<p>      The petitioner, who is accused No.5 in Crime No.8 of 2009 of<\/p>\n<p>Excise Enforcement and Anti Narcotic Special Squad, Kottaym for<\/p>\n<p>an offence punishable under Section 21 (c) of the NDPS Act, seeks<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.<\/p>\n<p>      3.     Anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature. But at the same time, I am inclined to permit the petitioner<\/p>\n<p>to surrender before the Investigating Officer for the purpose of<\/p>\n<p>interrogation and then to have his application for bail considered<\/p>\n<p>by the Special Judge (NDPS) having jurisdiction. Accordingly, the<\/p>\n<p>petitioner shall surrender before the investigating officer on<\/p>\n<p>11\/11\/2010 or on 12\/11\/2010 for the purpose of interrogation<\/p>\n<p>and recovery of incriminating material, if any.
