That on 16-12-1985, while discharging his duties as a driver<br \/>\non tempo no. GRN 3049, which is of the ownership of opponent no.1,<br \/>\nthe deceased was proceeding from Bhiloda to Himmatnagar on National<br \/>\nHighway No.8 and during that time tempo met with an accident in the<br \/>\nsim of village Karanpur.  In the said accident, said Babubhai<br \/>\nreceived injuries and as a result of it, Babubhai died on spot.  It<br \/>\nis also stated that at the time of accident the deceased was 23 years<br \/>\nof age. It is also the say of the claimants that the accident has<br \/>\noccurred during the course of employment and, therefore, opponent<br \/>\nno.1 is liable to pay compensation as admissible under Workmen<br \/>\nCompensation Act.  It is also the say of the claimants that since the<br \/>\ntempo was insured with opponent no.2, opponent no.2 is liable to<br \/>\nindemnify liability of opponent no.1.   It is also contended that for<br \/>\nsaid purpose notice was given to the opponents, but the opponents<br \/>\nhave not paid any amount, therefore, the claimants have filed Workmen<br \/>\nCompensation Application before Workmen Compensation Commissioner,<br \/>\nHimmatnagar.  Said application was resisted by opponents by filing<br \/>\nwritten statement at Exh.34 contending that it is for the claimants<br \/>\nto prove that the deceased was 23 years of age at the time of the<br \/>\naccident.  However, factum regarding death of deceased during the<br \/>\ncourse of employment as well as the fact that he was drawing monthly<br \/>\nsalary of Rs.600\/- are admitted.  However, it is stated that it is<br \/>\nfor the claimants to prove that they are dependents of the deceased<br \/>\nand prayed for dismissal of application.  Opponent no.2 has also<br \/>\nresisted the application by filing written statement at Exh.11 and<br \/>\ncontended that liability of the insurance company is limited either<br \/>\nunder the Motor Vehicles Act or as per the policy of insurance<br \/>\ncompany.  It is also contended by insurance company that the deceased<br \/>\nwas not possessing valid driving license therefore, the claim is not<br \/>\nrequired to be granted.  It is also contended that the claim of the<br \/>\nclaimants is excessive and, therefore, claim application is required<br \/>\nto be dismissed.  After considering the evidence on record, Workmen<br \/>\nCompensation Commissioner allowed said application and awarded<br \/>\nRs.52,788\/- as compensation and also directed to pay penalty to the<br \/>\ntune of 25% on the total compensation amount.\n<\/p>\n<p>4.\tBeing<br \/>\naggrieved and dissatisfied with the judgment and award passed by the<br \/>\nlearned Workmen Compensation Commissioner, Himmatnagar, the<br \/>\nappellant-insurance company has preferred present appeal.\n<\/p>\n<p>5.\tHeard<br \/>\nMr.S.V.Raju, learned Advocate appearing for the appellant-insurance<br \/>\ncompany.  He has submitted that the amount awarded by the learned<br \/>\nWorkmen Compensation Commissioner, Himmatnagar has not been rightly<br \/>\nawarded as there is a clause in the insurance policy which provides<br \/>\nthat in case of accident, insurance company is not liable to pay the<br \/>\namount of penalty.  He has also submitted that there is no statutory<br \/>\nliability under the Workmen&#8217;s Compensation Act, 1923 on the insurance<br \/>\ncompany to pay the amount of penalty.  He has further submitted that<br \/>\nit is a matter of contract between the insurance company and the<br \/>\ninsured and it is always open to the insurance company to refuse to<br \/>\ninsured.  The insurance company is also entitled to provide the terms<br \/>\nin the contract that the insurance company will not be liable to pay<br \/>\npenalty amount.  Relying upon the decision of the Apex Court rendered<br \/>\nin S.L.P. (Civil) No.341 of 2003 in case of P.J.Narayan<br \/>\nVs. Union of India and Ors., Mr. Raju submitted that in<br \/>\nabsence of any statute to this effect the insurance company cannot be<br \/>\nforced by the Court to take the liability which is not contemplated<br \/>\nunder the policy. Mr.Raju, learned Advocate has also relied upon the<br \/>\ndecision of the Hon&#8217;ble the Supreme Court in<br \/>\ncase of  New India Assurance Co.Ltd. v.\n<\/p>\n<p>Harshadbhai Amrutbhai Modhiya, reported in AIR SC Weekly Vol.3,<br \/>\n2006, 2353, wherein<br \/>\n the Hon&#8217;ble the Supreme Court has held that the Insurance Company is<br \/>\nnot liable for the interest. The Hon&#8217;ble the Supreme Court, in the<br \/>\ngiven case, construing the contract involved, held that the insurer<br \/>\nhas specifically excluded any liability for interest or penalty under<br \/>\nthe Workmen&#8217;s Compensation Act and confined the liability to<br \/>\nindemnify the employer only against the amount of compensation to be<br \/>\npaid under the Workmen&#8217;s Compensation Act.\n<\/p>\n<p>6.\tThe<br \/>\nlearned Advocate for the respondent Nos.1 to 3 has submitted that the<br \/>\nlearned Workmen Compensation Commissioner, Himmatnagar, has rightly<br \/>\nawarded the compensation amount with penalty by considering the age<br \/>\nof the deceased and the salary which was being paid to the deceased.<br \/>\nThe learned Advocate has further submitted that the learned<br \/>\nCommissioner, Himmatnagar, has rightly come to the conclusion that<br \/>\nsince appellant herein failed to pay or deposit the amount of<br \/>\ncompensation it is liable to pay penalty on said amount.  Therefore,<br \/>\nit is rightly held that the insurance company is also liable to pay<br \/>\ncompensation amount and penalty thereon. The learned Advocate has<br \/>\nsubmitted that the respondent No.1 herein has produced all necessary<br \/>\ndocumentary evidences in support of claim for amount of compensation<br \/>\nrelying on which the learned Commissioner, Himmatnagar has rightly<br \/>\nawarded compensation and penalty interest thereon.\n<\/p>\n<p>7.\tI<br \/>\nhave considered the submissions made by learned advocates for both<br \/>\nthe sides. I have also gone through the documents on record and<br \/>\nimpugned judgment of the Commissioner as well as decisions cited by<br \/>\nlearned advocate for the appellant. Looking to the settled legal<br \/>\nposition of law as held by the Hon&#8217;ble the Supreme Court in case of<br \/>\nNew India Assurance Co.Ltd. v. Harshadbhai Amrutbhai Modhiya<br \/>\n(supra),<br \/>\nthe Court is of the opinion that the Insurance Company is not<br \/>\nrequired to make payment towards penalty on compensation amount.<br \/>\nTherefore, submissions of the learned Advocate appearing for<br \/>\nInsurance Company are required to be accepted. Therefore, order<br \/>\nimpugned herein is required to be modified accordingly.\n<\/p>\n<p>8.\tWith<br \/>\nthe above observations, appeal is partly allowed. The appellant<br \/>\nherein will not be required to make any payment towards penalty.<br \/>\nHowever, it is held liable to pay  principal amount of compensation<br \/>\nas awarded by Workmen Compensation Commissioner.
