Murugesan, J.  <\/p>\n<p> 1. Petitioner has prayed for the issue of a writ of mandamus directing the  respondent to release the Tractor-cum-Trailor bearing Registration No. TN-21-Y-0151 seized  by the  respondent on 3.4.2003.\n<\/p>\n<p>  2. In an identical set of fact, the Hon&#8217;ble First Bench of this Court directed the authorities to release the vehicle in question by putting the petitioner on terms of making a payment of Rs. 5,000\/-.\n<\/p>\n<p>  3. Considering the said order passed by the Hon&#8217;ble First Bench, in this case also, the       respondents  are  directed to release the vehicle bearing  Registration No. TN-21-Y-0151 seized by the respondent on the alleged ground of infringement of Tamil Nadu Mines and Minerals Concession Rules on the petitioner&#8217;s making the payment of Rs. 5,000\/- and proving the ownership of the vehicle and further filing an affidavit as to non encumbrance and non alienation of the subject vehicle.\n<\/p>\n<p>  4. On such payment and proof of ownership and filing of the affidavit, the              respondents are directed to release the vehicle forthwith.  It is open to the authorities to adjudicate under the provisions of the Act.  With these observations, the writ petition is disposed of.
