No. 903 OF 2002\n                            ---------------------\n                Dated this the 27thday of August, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>            This appeal is preferred against the order of the<\/p>\n<p>Employees&#8217; Insurance Court, Palakkad, in I.C. No.84\/00.              The<\/p>\n<p>applicant before the said court contended that it is not liable to pay<\/p>\n<p>interest in the light of the fact that there was a bonafide dispute<\/p>\n<p>regarding its liability and that litigations were pending in various<\/p>\n<p>forums regarding its liability to pay the amount.      Ultimately it has<\/p>\n<p>been decided that the establishment is liable to be covered under the<\/p>\n<p>Act. So the main contention argued by the Learned counsel for the<\/p>\n<p>appellant is that really there was a bonafide dispute regarding its<\/p>\n<p>liability to pay the amount. By virtue of the challenge of the various<\/p>\n<p>orders issued, it should not be directed to pay the interest as claimed<\/p>\n<p>by the ESI Corporation. The matter has come up for consideration<\/p>\n<p>before the Division Bench of this court reported in <a href=\"\/doc\/515903\/\">Cannanore Drug<\/p>\n<p>Lines v. E.S.I. Corporation<\/a> [2007 (1) KLT 880].        This court held as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>         &#8220;Merely because the appellant failed to pay<br \/>\n         contribution    allegedly        under      a bonafide<br \/>\n         impression or belief that the establishment was<\/p>\n<p><span class=\"hidden_text\">MFA No.903\/02                      2<\/span><\/p>\n<p>       not covered under the provisions of the E.S.I. Act<br \/>\n       cannot absolve the appellant from the liability of<br \/>\n       paying interest on the delayed payment of E.S.I.<br \/>\n       Contribution under S.39(5) read with Regulation<br \/>\n       31A. Neither the provisions in the E.S.I. (General)<br \/>\n       Regulations give any discretion to the respondent<br \/>\n       to exempt the appellant from the liability to pay<br \/>\n       interest on the delayed payment of E.S.I.<br \/>\n       Contribution.     The bonafide impression of the<br \/>\n       appellant that his establishment was not covered<br \/>\n       under the provisions of ESI Act or the pendency<br \/>\n       of a dispute before the ESI Court regarding the<br \/>\n       appellant&#8217;s liability to pay ESI contribution cannot<br \/>\n       be a valid ground for exempting the appellant<br \/>\n       from paying interest in terms of S.39(5)(a) and<br \/>\n       Regulation 31A.        When the statute does not<br \/>\n       provide for any such exemption the respondent<br \/>\n       cannot exclude the amount of interest from the<br \/>\n       demand made against the appellant.&#8221;<\/p><\/blockquote>\n<p>          In the light of this decision, it has to be held that the<\/p>\n<p>appellant is not entitled to any exemption from paying interest. I do<\/p>\n<p>not find any ground to interfere with the decision rendered by the EI<\/p>\n<p>Court. Therefore the appeal lacks merit and it is dismissed.
