On the previous two dates<\/p>\n<p>also no one had come present on his behalf. The appeal is of the year<\/p>\n<p>2004 which has not proceeded beyond the motion stage because of<\/p>\n<p>the numerous adjournments sought by the parties. Hence noticing the<\/p>\n<p>fact that the case has been called out twice during the course of the<\/p>\n<p>day and no one appeared for the appellant on 12.11.2008 and<\/p>\n<p>8.8.2008 i.e. the previous two dates and also the fact that on<\/p>\n<p>28.7.2008 on the request of the counsel for the appellant adjournment<\/p>\n<p>was granted subject to payment of Rs.1,000\/- as costs and then notice<\/p>\n<p>was also issued to him, who has still chosen not to appear, I am of<\/p>\n<p>the opinion that the appeal deserves to be dismissed for want of<br \/>\n<span class=\"hidden_text\"> R.S.A. No. 2252 of 2004             -2-<\/span><\/p>\n<p>prosecution.
