Respondents\n\nPRAYER\n\nWrit petition filed under Article 226 of the Constitution of India,\npraying to issue a writ of  Certiorarified mandamus, to direct the respondents 1\nto 3 to supervise and to protect the Government funds meant for '100 days\nEmployment Scheme' and consequently, take appropriate action against the fifth\nand sixth respondents with regard to the misuse of Government funds meant for\n'100 days Employment Scheme' as per Panchayat Raj Act and rules and pass such\nfurther order.\n\n!For Petitioner\t... Mr.A.Rajini\n^For RR1 to 4\t... Mr.R.Janakiramalu\n\t\t    Special Government Pleader\nFor RR5 and 6\t... No appearance\n\n\n\t\t\t\t\t  * * * *\t\n\n:ORDER\n<\/pre>\n<p>\tThis writ petition has been filed to  direct the respondents 1 to 3 to<br \/>\nsupervise and to protect the Government funds meant for &#8216;100 days Employment<br \/>\nScheme&#8217; and consequently, take appropriate action against the fifth and sixth<br \/>\nrespondents with regard to the misuse of Government funds meant for &#8216;100 days<br \/>\nEmployment Scheme&#8217; as per Panchayat Raj Act.\n<\/p>\n<p>\t2. Heard the learned counsel for the petitioner and also<br \/>\nMr.R.Janakiramalu, learned Special Government Pleader, who took notice on behalf<br \/>\nof the respondents 1 to 4.\n<\/p>\n<p>\t3. The facts giving rise to the filing of this writ petition as stood<br \/>\nexposited from the averments in the affidavit accompanying the writ petition<br \/>\ncould succinctly and precisely, tersely and briefly be set out thus:<br \/>\n\tThe petitioner is the vice-president of Marakathoor Panchayat,<br \/>\nKalayarkovil Union, Sivagangai District.  Animadverting upon the misconducts of<br \/>\nthe President of the same Panchayat, the Panchayat council passed resolution for<br \/>\ndeceiting him and such a resolution was forwarded to the first respondent viz.,<br \/>\nthe District Collector, Sivagangai District, who is inert and he is not at all<br \/>\nconsidering it.  Hence, this writ petition.\n<\/p>\n<p>\t4. Despite printing the name of the learned Additional Government Pleader,<br \/>\nhe has not appeared and no counter has been filed.\n<\/p>\n<p>\t5. Hence, in this factual matrix, the following direction is issued:<br \/>\n\tThe first respondent viz., the District Collector, Sivagangai District<br \/>\nshall on receipt of a copy of this order and after giving the opportunity of<br \/>\nbeing heard to the petitioner, consider the resolution on merits and take<br \/>\nsuitable action within a period of one month from the date of receipt of a copy<br \/>\nof this order.\n<\/p>\n<p>\t6. With the above direction, this Writ Petition is disposed of.
