No.18621 of 2011\n                            Raj Kumar Paswan son of Biranchi Paswan\n                                               Versus\n                                       The State Of Bihar\n                                             -----------\n<\/pre>\n<p>3.   27.7.2011               Heard     learned      Counsel    for    the<\/p>\n<p>                 petitioner and the State.\n<\/p>\n<p>                            The petitioner seeks bail in a case<\/p>\n<p>                 instituted for the offence under Section 302\/34 of<\/p>\n<p>                 the Indian Penal Code and 27 of the Arms Act.<\/p>\n<p>                         Considering         that   there     is     only<\/p>\n<p>                 circumstantial evidence against the petitioner and<\/p>\n<p>                 he has fair antecedents, let the petitioner above<\/p>\n<p>                 named, be released on bail on furnishing bail<\/p>\n<p>                 bond of Rs. 5,000\/-(Five thousand) with two<\/p>\n<p>                 sureties of the like amount each or any other<\/p>\n<p>                 surety to be fixed by the court concerned to the<\/p>\n<p>                 satisfaction of learned Chief Judicial Magistrate,<\/p>\n<p>                 Lakhisarai in connection with Halsi P.S. case<\/p>\n<p>                 No.116 of 2010, subject to the conditions (i) That<\/p>\n<p>                 one of the bailor shall be the father of the<\/p>\n<p>                 petitioner and the other bailor will be a close<\/p>\n<p>                 relative of the petitioner who will give an affidavit<\/p>\n<p>                 giving genealogy as to how he is related with the<\/p>\n<p>                 petitioner. The bailor will undertake to furnish<\/p>\n<p>                 information to the Court about any change in<\/p>\n<p>                 address of the petitioner. (ii) That the affidavit<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            shall clearly state that the petitioner is not an<\/p>\n<p>            accused in any other case and if he is he shall not<\/p>\n<p>            be released on bail, (iii) That the bailor shall also<\/p>\n<p>            state on affidavit that he will inform the court<\/p>\n<p>            concerned if the petitioner is implicated in any<\/p>\n<p>            other case of similar nature after his release in the<\/p>\n<p>            present case and thereafter the court below will be<\/p>\n<p>            at liberty to initiate the proceeding for cancellation<\/p>\n<p>            of bail on ground of misuse, (iv) That the petitioner<\/p>\n<p>            will give an undertaking that he will receive the<\/p>\n<p>            police papers on the given date and be present on<\/p>\n<p>            date fixed for charge and if he fails to do so on two<\/p>\n<p>            given dates and delays the trial in any manner, his<\/p>\n<p>            bail will be liable to be cancelled for reasons of<\/p>\n<p>            misuse, (v) That the petitioner will be well<\/p>\n<p>            represented on each date if he fails to do so on<\/p>\n<p>            two consecutive dates, his bail will be liable to be<\/p>\n<p>            cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Raj Kumar Paswan vs The State Of Bihar on 27 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
