Heard the learned counsels for the<\/p>\n<p>                   petitioners and the State.\n<\/p>\n<p>                             The       petitioners           are      apprehending<\/p>\n<p>                   their    arrest       in    a     case    registered            under<\/p>\n<p>                   Sections 323, 420,467, 468, 471\/34 of the<\/p>\n<p>                   Indian Penal Code.\n<\/p>\n<p>                             It    is     alleged        that        the    land     was<\/p>\n<p>                   claimed by the informant by virtue of will<\/p>\n<p>                   for which he filed probate case no. 40 of<\/p>\n<p>                   2008    but    part    of       the   same      land     was     also<\/p>\n<p>                   claimed by one Laliteshwar Prasad Srivastava<\/p>\n<p>                   who    transferred          the    land      in    question        in<\/p>\n<p>                   favour of the petitioners.\n<\/p>\n<p>                             It     is     submitted         by       the        learned<\/p>\n<p>                   counsel       for     the         petitioners           that     the<\/p>\n<p>                   informant      has     no       claim    since      he        himself<\/p>\n<p>                   admits    that        the       probate      case        is     still<\/p>\n<p>                   pending. It appears that the title suit is<\/p>\n<p>                   also pending between the parties.<\/p>\n<p>                             Considering the aforesaid facts, let<\/p>\n<p>                   the petitioners, Bishwa Vijay Bahadur Singh<\/p>\n<p>                   and Tiwari Lokesh, be released on bail in<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        the event of arrest or surrender before the<\/p>\n<p>        learned    court       below    within      a    period      of<\/p>\n<p>        twelve weeks from today in connection with<\/p>\n<p>        Jagdishpur   P.S.       Case    No.   108       of   2009    on<\/p>\n<p>        furnishing       bail    bond    of      Rs.10,000\/-(Ten<\/p>\n<p>        Thousand) each with two sureties of the like<\/p>\n<p>        amount    each     to    the    satisfaction         of     the<\/p>\n<p>        learned C.J.M. Bhojpur, Ara, subject to the<\/p>\n<p>        conditions as laid down under Section 438(2)<\/p>\n<p>        of the Code of Criminal Procedure.<\/p>\n<pre>U. K.
