                            The present petition has been filed<\/p>\n
                 by the above named petitioner with the prayer<\/p>\n
                 of quashing the order dated 7.2.2004 passed<\/p>\n
                 in    Complaint     Case    No.2797    of    2003,       Trial<\/p>\n
                 No.1527 of 2010 passed by the Chief Judicial<\/p>\n
                 Magistrate,        Patna     on   7.2.2004.        By      the<\/p>\n
                 impugned    order     the    learned    Chief      Judicial<\/p>\n
                 Magistrate, Patna after holding an enquiry in<\/p>\n
                 the truthfulness of the allegations made in<\/p>\n
                 the complaint petition noted above summoned<\/p>\n
                 the    petitioner     and    other     accused      persons<\/p>\n
                 named in the petition of complaint as accused<\/p>\n
                 to stand their trial for committing offences<\/p>\n
                 under Sections 386, 506, 420, 468 and 120B of<\/p>\n
                 the IPC.\n<\/p>\n
                            The facts are broadly not disputed.<\/p>\n
                 The wife of the complainant, i.e., Sarita Roy
\n                    2<\/span><\/p>\n
was the owner of the flat bearing no.201 of<\/p>\n
Juhu     Prices         Co-operative             Housing     Society<\/p>\n
Ltd.,     Juhu      Tara       Road,        Mumbai-400       049     on<\/p>\n
account       of    the        same        being    purchased       on<\/p>\n
27.7.1987 and she became a member of the said<\/p>\n
housing       society       on        account       of     the     said<\/p>\n
purchase. The flat was purchased from Mohini<\/p>\n
Bhatia       who   was     the    previous          owner    of     the<\/p>\n
same.\n<\/p>\n
             It is alleged that on 6.3.1991 some<\/p>\n
ante-social        elements           of    the     locality       came<\/p>\n
into the above noted flat of the complainant<\/p>\n
and after putting the entire family of the<\/p>\n
complainant in fear of death forced his wife<\/p>\n
Sarita       Roy   to    put     her        signatures      on     some<\/p>\n
blank        stamped       and        unstamped-papers.             The<\/p>\n
criminals who did the above act pointed out<\/p>\n
to     the    complainant         that        Sudhir       Roy,     the<\/p>\n
younger       brother       of        the     complainant,          was<\/p>\n
running in heavy debts due to gambling                              and<\/p>\n
the flat was to be sold                      by them so as to<\/p>\n
paying up his debts. It was further alleged<\/p>\n
that    on    28.9.1992          the       other    sets    of     some<\/p>\n
other criminals again did the same thing. It<\/p>\n
was     alleged         that     on        the     basis    of     the<\/p>\n
signatures         obtained       on        blank    stamped        and
\n                   3<\/span><\/p>\n
unstamped       papers       Powers        of     Attorney      were<\/p>\n
created and       ultimately on             that strength an<\/p>\n
illegal sale deed was executed showing the<\/p>\n
sale of the said flat to accused no.2 who was<\/p>\n
the Director of A.N.Properties Ltd. It was<\/p>\n
alleged that the deed of sale and transfer in<\/p>\n
favour of accused no.2 was a sham and void<\/p>\n
transaction.\n<\/p>\n
           It   is also stated in the complaint<\/p>\n
petition that the accused no.1 Nafis Ahmad<\/p>\n
Khan     and    other        accused       persons       who    were<\/p>\n
criminal       characters          of   Mumbai      coerced      the<\/p>\n
complainant      and        his    wife    to    hand    over    the<\/p>\n
keys of the flat. Subsequently, accused Nafis<\/p>\n
Ahmad Khan reached Patna and in league with<\/p>\n
other     criminals          of     Patna        threatened      the<\/p>\n
complainant       and       demanded       Rs.30,00,000\/-         as<\/p>\n
also asked him to sign some blank papers, and<\/p>\n
accordingly,          the    complainant           out   of     fear<\/p>\n
signed    some    blank           papers    on    6.3.1991      upon<\/p>\n
which another Power of Attorney was notarized<\/p>\n
on 13.3.1991. It is further alleged that the<\/p>\n
wife of the complainant was also coerced to<\/p>\n
sign a few papers upon which another Power of<\/p>\n
Attorney said to be executed by the wife of<\/p>\n
the     complainant,          namely,       Sarita       Roy     was
\n                     4<\/span><\/p>\n
notarized at Patna on 29.4.1992. Those Powers<\/p>\n
of     Attorney were created in favour of Md.<\/p>\n
Taufique      Khan       accused      no.3     who    appears    to<\/p>\n
have    sold        the       flat      in    favour      of    the<\/p>\n
petitioner in 1992. It is not denied by the<\/p>\n
complainant in his complaint petition that he<\/p>\n
was not in possession of the flat and some<\/p>\n
other persons were in possession of the same<\/p>\n
as    may    appear      from     the      statements    made    in<\/p>\n
paragraph-17 and 18. It futher appears from<\/p>\n
the statements made in paragraphs19, 20 and<\/p>\n
21    that    the       accused      persons       including    the<\/p>\n
present petitioner committed theft of house<\/p>\n
hold articles, like, T.V., Refrigerator, Sofa<\/p>\n
etc and threatened him of dire consequences<\/p>\n
if he did not withdraw the petition filed by<\/p>\n
him     under           the      Maharashtra         Cooperative<\/p>\n
Societies         Act    challenging         the     transfer    in<\/p>\n
favour of the petitioner in 1992. It is not<\/p>\n
denied that in the above noted proceedings<\/p>\n
which       was     placed        before       the      competent<\/p>\n
authority      under       the    Maharashtra        Cooperative<\/p>\n
Societies Act, the present petitioner was not<\/p>\n
made a party and that the said petition was<\/p>\n
dismissed         for    default      on     20.4.2000.    It    is<\/p>\n
indicated         that    the     present      petitioner       had
\n                   5<\/span><\/p>\n
purchased the flat on 25.4.2000 from accused<\/p>\n
no.2, i.e., A.N. Properties Private Ltd.<\/p>\n
           It is too well known to be pointed<\/p>\n
out that if the allegations on the face of it<\/p>\n
appear         patently        absurd     and         inherently<\/p>\n
improbable the proceedings cannot be allowed<\/p>\n
to continue. It is also a known position of<\/p>\n
law that if a prosecution appears stemming<\/p>\n
from a sense of vengeance or with a sense of<\/p>\n
heaping humiliation upon the accused, then in<\/p>\n
that case also the same could not be allowed<\/p>\n
to be continued. For examining the summoning<\/p>\n
order the admitted facts or facts which are<\/p>\n
already        available       on   record      may     also    be<\/p>\n
considered.\n<\/p>\n
           I     have      already       noted        down     the\n\nadmitted        facts     of    the     case.     The     patent\n\n<\/pre>\n
absurdity and the inherent improbability in<\/p>\n
the case appears the fact that in spite of<\/p>\n
being coerced to sign a few papers as back as<\/p>\n
in 1991 and 1992, the complainant does not<\/p>\n
appear taking steps against the said criminal<\/p>\n
acts and was pointing the above facts in the<\/p>\n
year 2003. Those acts which have been alleged<\/p>\n
committed by the accused persons in the years<\/p>\n
1991 and 1992 so as to creating Powers of
\n                  6<\/span><\/p>\n
Attorney       said     to     be     executed      by     the<\/p>\n
complainant and his wife could really attract<\/p>\n
serious     penal      consequences.           Independently<\/p>\n
also,     they       were     serious     acts      and     no<\/p>\n
reasonable person could have slept over those<\/p>\n
incidents and could not have tolerated those<\/p>\n
criminal acts. Likewise, no reasonable person<\/p>\n
could be handing over the keys of his house<\/p>\n
to any criminal element and if he could do it<\/p>\n
he could take resort to recourse prescribed<\/p>\n
under   law    and     could   never     be     expected    to<\/p>\n
forget about it so as to recall it                   in the<\/p>\n
year 2003 after more than a decade.<\/p>\n
           It is not denied that there was some<\/p>\n
dispute       which     was     brought         before     the<\/p>\n
competent      authority       under     the    Maharashtra<\/p>\n
Cooperative Societies Act vide Case No.344 of<\/p>\n
1996 as appears admitted by the complainant<\/p>\n
in paragraph-21 of the complaint petition. It<\/p>\n
further appears from the same paragraph that<\/p>\n
a   revision     had   also    been     filed    before    the<\/p>\n
Registrar Cooperative Societies,                 Maharashtra<\/p>\n
which bears Revision No.461 of 2002 and those<\/p>\n
litigations were brought by the complainant.<\/p>\n
It was contended before me that having lost<\/p>\n
his case before the authority in Case No.344
\n                           7<\/span><\/p>\n
        of    1996      the    complainant       had   filed    the<\/p>\n
        Revision       Bearing    No.461    of    2002.    It   was<\/p>\n
        contended that the whole allegations are a<\/p>\n
        hoax and       do not merit being taken cognizance<\/p>\n
        of. It was contended that no ransom or amount<\/p>\n
        was paid nor any extortion appears committed<\/p>\n
        likewise no offence appears committed under<\/p>\n
        Sections 420 of the Penal Code.\n<\/p>\n
                   I   have    examined    the    contentions    of<\/p>\n
        the learned counsel for the petitioner and I<\/p>\n
        find that on admitted facts as also on facts<\/p>\n
        which    were    alleged    by    the    complainant    the<\/p>\n
        allegations       appear     completely        absurd   and<\/p>\n
        improbable. It appears that the complainant<\/p>\n
        was     acting    with     some    purpose      which   was<\/p>\n
        probably to settle some scores or to force<\/p>\n
        the accused persons so as to corner them to a<\/p>\n
        particular point. There was no real reason<\/p>\n
        for the court below to summon the petitioner.<\/p>\n
        The proceeding initiated on the basis of said<\/p>\n
        complaint petition by order dated 7.2.2004 is<\/p>\n
        hereby quashed.\n<\/p>\n
                   The petition is allowed.\n<\/p>\n<\/p>\n
