                       IN THE HIGH COURT OF JUDICATURE AT PATNA\n                           Civil Writ Jurisdiction Case No.16239 of 2011\n                                              Ajay Kumar\n                                                 Versus\n                                 The State Election Commission,\n                                    ----------------------------------\n<\/pre>\n
2   28\/09\/2011.               Mr Rajiv Verma, learned Sr.Advocate          for the<\/p>\n
                  petitioner, AC to SC 22 for the State respondents, Mr Sanjiv<\/p>\n
                  Nikesh for the State Election Commission and Mr S.K.Sinha for<\/p>\n
                  respondent no.5, are present.\n<\/p>\n
                               Petitioner has come to this Court for quashing order<\/p>\n
                  dated 23.6.2011, passed in Case no. 31 of 2011, whereby<\/p>\n
                  respondent no.2, the State Election Commission has set aside<\/p>\n
                  the election of the petitioner for the post of Mukhia.<\/p>\n
                              Respondent no.5 files counter affidavit with service<\/p>\n
                  of    copy to the counsel for the petitioner, State and the<\/p>\n
                  Commission today in the court itself.<\/p>\n
                              As prayed by the parties, list this matter within top<\/p>\n
                  ten cases on 13.10.2011.\n<\/p>\n
                              Counsel for the Commission submits that process of<\/p>\n
                  election is not going to take place in the near future, much less<\/p>\n
                  in October or November, 2011.\n<\/p>\n
                              In view of the submissions of the counsel appearing<\/p>\n
                  for the Commission, this court does not propose to pass any<\/p>\n
                  interim order.\n<\/p>\n
