Rule stands discharged so<br \/>\nfar as accused applicant nos.3 and 4 is concerned.\n<\/p>\n<p>\tThis<br \/>\nApplication has been preferred under Section 438 of the Code of<br \/>\nCriminal Procedure, praying for anticipatory bail, in connection with<br \/>\nCR I-31\/2010 registered with Nasvadi Police Station, District<br \/>\nVadodara for the offences punishable under Sections 452, 376(4) read<br \/>\nwith Section 114 of the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel Mr.Thakkar appearing for the applicant-accused and<br \/>\nlearned APP Mr.Kodekar for the State.\n<\/p>\n<p>\tAt<br \/>\nthe request of the learned counsels, reasoned order is not pressed.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, I am persuaded to exercise<br \/>\nmy discretion in favour of the applicant &#8211; accused, taking into<br \/>\nconsideration the following aspects:-\n<\/p>\n<p>(a)<br \/>\nThere is a gross delay of about one and a half\tyears in lodging the<br \/>\nF.I.R. by the prosecutrix.\n<\/p>\n<p>(b)<br \/>\nThere is no explanation worth the name for the\tsaid delay.\n<\/p>\n<p>(c)<br \/>\nIt is brought to my notice that the accused\tapplicants are witnesses<br \/>\nin a case filed by one\tRajeshbhai Laxmanbhai Panchal against the<br \/>\nthree\taccused persons. One of them is the paramour of\tthe<br \/>\nprosecutrix. It deserves to be noted that\tthe\tfirst information<br \/>\nreport is lodged by\tRajeshbhai Laxmanbhai Panchal, who happens to be<br \/>\n\tthe brother of the brother-in-law of the missing \thusband of the<br \/>\nprosecutrix.\n<\/p>\n<p>(d)\tEven<br \/>\notherwise, having regard to the nature of\tthe allegations levelled in<br \/>\nthe F.I.R. and the\tentire case put-forth, the conduct of<br \/>\nthe\tprosecutrix does not inspire confidence.\n<\/p>\n<p>(e)\tEach<br \/>\nof the accused applicants are permanent \tresidents of village<br \/>\nNasvadi, District Vadodara. \tThey have their own individual family.<br \/>\nApplicant \tno.1 is a Member of Sardar Sahakari Mandli,\tAmroli and a<br \/>\nDirector of APMC, Taluka Nasvadi.\tHe is also the President of Khedut<br \/>\nMajdur Sangh, \tTaluka Nasvadi and is in active public life and\tis<br \/>\nenjoying various posts in the Cooperative\tSocieties since many years.<br \/>\nIn the same manner,\tapplicant no.2 is also a businessman, having  a<br \/>\n\tshop and is a Trustee of Mahendaviya Community.\tNo apprehension has<br \/>\nbeen expressed as regards\tflee from trial or tampering with the<br \/>\nevidence\tand hampering the witnesses.\n<\/p>\n<p>\tTaking<br \/>\ninto consideration the relevant aspects referred to above and further<br \/>\ntaking into consideration the law laid down by the Apex Court in the<br \/>\ncase of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp;<br \/>\nOrs.,<\/a> reported<br \/>\nin (2011) 1 SCC 694, wherein the Hon&#8217;ble Supreme Court<br \/>\nreiterated the law laid down by the constitutional Bench in the case<br \/>\nof Shri Gurubaksh Singh Sibbia &amp; Ors. (1980) 2 SCC 565,<br \/>\nthe accused &#8211; applicant nos.1 and 2, namely, Siddikbhai<br \/>\nIsmail Shaikh and Nurubhai Abdulbhai Velanwala are ordered to be<br \/>\nenlarged on anticipatory bail in the event of their arrest in<br \/>\nconnection with the offence registered with Nasvadi Police Station,<br \/>\nDistrict Vadodara vide I-CR No.31\/2010, on furnishing bond of<br \/>\nRs.15,000\/- (Rupees Fifteen Thousand Only) each with one surety of<br \/>\nlike amount to the satisfaction of the trial Court, on the following<br \/>\nconditions that :-\n<\/p>\n<p>[A]\tthey<br \/>\nshall cooperate with the investigation and make themselves available<br \/>\nfor interrogation whenever required.\n<\/p>\n<p>[B]\tthey<br \/>\nshall remain present at the concerned Police Station on 18th<br \/>\nMay 2011 between 10 a.m. and 2 p.m. and mark their presence before<br \/>\nthe concerned Police Station twice in a month on every 2nd<br \/>\nand 4th Saturday till the filing of the charge-sheet;\n<\/p>\n<p>[C]\tthey<br \/>\nshall not hamper the investigation in any manner nor they shall<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nwitness so as to dissuade them from disclosing such facts to the<br \/>\nCourt or to any Police Officer;\n<\/p>\n<p>[D]\tthey<br \/>\nshall, at the time of execution of bond, furnish their address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\ntheir residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[E]<br \/>\n\tthey will not leave India without the permission of the Court and,<br \/>\nif they hold a Passport, they shall surrender the same before the<br \/>\ntrial Court within a week;\n<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>\t\tIt<br \/>\nwould be open for the Investigating Agency to apply to the competent<br \/>\nMagistrate for police remand of the applicants.  The applicants shall<br \/>\nremain present before the learned Magistrate on the first date of<br \/>\nhearing of such application and on all subsequent occasions, as may<br \/>\nbe directed by the learned Magistrate.  This would be sufficient to<br \/>\ntreat the accused in the judicial custody for the purpose of<br \/>\nentertaining application of the prosecution for police remand.  This<br \/>\nis, however, without prejudice to the right of the accused to seek<br \/>\nstay against an order of remand, if ultimately granted, and the power<br \/>\nof the learned Magistrate to consider such a request in accordance<br \/>\nwith law. It is clarified that the applicants, even if remanded to<br \/>\nthe police custody upon completion of such period of police remand,<br \/>\nshall be set free immediately, subject to other conditions of this<br \/>\nanticipatory bail order.\n<\/p>\n<p>\tWith<br \/>\nthese directions, the Application is allowed.
