RAMKUMAR, J.\n              ---------------------------------------------\n                Bail Application No.54 of 2011\n              ----------------------------------------------\n           Dated this the 12th day of January, 2011\n\n                                ORDER\n<\/pre>\n<p>     Petitioners, who are accused Nos.2 to 4 in Crime No.890 of<\/p>\n<p>2010 of Valapattanam Police Station for offences punishable<\/p>\n<p>under Sections 147, 148 I.P.C. &amp; Secs. 3 &amp; 5 of Explosives Act,<\/p>\n<p>seek anticipatory bail.\n<\/p>\n<p>     2.    The    learned      Public     Prosecutor       opposed the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated     2-12-2010        of the Apex Court     in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a> (2010 (4) KLT 930), I am of the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer has not had the advantage of<\/p>\n<p>interrogating the petitioners.         But at the same time, I am<\/p>\n<p>inclined to permit the petitioners to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>B.A.No.54\/2011<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>have their application for bail considered by the Magistrate or<\/p>\n<p>the Court having jurisdiction.   Accordingly, the petitioners shall<\/p>\n<p>surrender before the investigating officer on 24\/01\/2011 or on<\/p>\n<p>25\/01\/2011 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. In case the investigating officer<\/p>\n<p>is of the view that having regard to the facts of the case arrest<\/p>\n<p>of the petitioners is imperative he shall record his reasons for<\/p>\n<p>the arrest in the case-diary as insisted in paragraph 129 of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                  The<\/p>\n<p>petitioners shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.   In case the interrogation of the petitioners are<\/p>\n<p>without arresting them, the petitioners shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned and apply for<\/p>\n<p>regular bail on the same day or the next day. The Magistrate or<\/p>\n<p>the Court on being satisfied that      the petitioners have been<\/p>\n<p>interrogated by the police shall, after hearing the prosecution as<\/p>\n<p>well, consider and dispose of their application for regular<\/p>\n<p>bail preferably on the same date on which it is filed.<\/p>\n<p>B.A.No.54\/2011<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>      4.    In case the petitioners while surrendering before<\/p>\n<p>the Investigating Officer have deprived the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect to the Magistrate or the Court<\/p>\n<p>concerned.
